CONDITIONAL USE PERMIT 05-003 - Authorization to provide 15 outdoor seats, five (5) tables, and three (3) umbrellas for a coffee house. The project is located at 1621 Edinger Avenue, Unit S, within the Industrial (M) zoning district. APPLICANT: MCG ARCHITECTURE ATTN: ABBEY SAHLE PROPERTY OWNER: DAVID SPIEGEL RECOMMENDATION That the Zoning Administrator adopt Zoning Administrator Action 05-006 approving Conditional Use Permit 05-003. Due to the applicant's time constraints, this item was taken out of order. The Public Hearing opened at 10:36 a.m. The Acting Zoning Administrator asked the applicant if she had seen the staff report, understood and agreed to the conditions of approval, and/or had any concerns. Abbey Sahle, the applicant, responded that she understood the report had no concerns. The Acting Zoning Administrator adopted Zoning Administrator Action 05-006 approving Conditional Use Permit 05-003. Zoning Administrator Agenda May 23, 2005 Page 2 2. CONDITIONAL USE PERMIT 05-006 - Authorization for the sale of beer, wine, and distilled spirits for on-site consumption (ABC License Type 47) in a bona fide public eating place and to construct an outdoor dining area at an existing restaurant. The project is located at 17320 1 ih Street, within the Planned Community Commercial (PC-COM) zoning district. APPLICANT: FIRE DANCE GRILL ATTN: CHRIS SPENCE PROPERTY OWNER: EMS DEVELOPMENT COMPANY MAURICE A. ENDERLE RECOMMENDATION That the Zoning Administrator adopt Zoning Administrator Action 05-009 approving Conditional Use Permit 05-006. The Acting Zoning Administrator asked the applicant if he had seen the staff report, understood and agreed to the conditions of approval, had any concerns, and whether he was aware of the change required due to a typographical error in the Action and the revision based upon the correction provided by Mr. West. Chris Spence, the applicant, answered that he had no concerns and was aware of the modification. The Acting Zoning Administrator asked Mr. West to clarify the modification to the revised Action. Mr. West stated that the staff report formerly indicated there would be 170 indoor seats and 26 outdoor seats; the Action was modified to state 180 indoor seats and 26 outdoor seats. The Acting Zoning Administrator asked the applicant if he had any questions or concerns. Mr. Spence replied in the negative. The Acting Zoning Administrator adopted Zoning Administrator Action 05-009 approving Conditional Use Permit 05-006. 3. CONDITIONAL USE PERMIT 05-010 - Authorization to re-establish an existing temporary soil remediation system and establish a temporary groundwater remediation system at an existing service station for three (3) years. The project is located at 14231 Red Hill Avenue, within the Retail Commercial (100, C-1, 10,000) zoning district. APPLICANT: ATLANTIC RICHFIELD COMPANY ATTN: DARRELL FAH Zoning Administrator Agenda May 23, 2005 Page 3 PROPERTY OWNER: JOHN PEDICINI RECOMMENDATION That the Zoning Administrator adopt Zoning Administrator Action 05-010 approving Conditional Use Permit 05-010. The Acting Zoning Administrator noted that neither the applicant nor any members of the public were in attendance. The Acting Zoning Administrator adopted Zoning Administrator Action 05-010 approving Conditional Use Permit 05-010. The Public Hearing closed and the meeting adjourned at 10:45 a.m. REGULAR BUSINESS: None ADJOURNMENT: The date of the next meeting of the Zoning Administrator will be scheduled when items are set for hearing.
