REQUEST: TO AUTHORIZE THE SALE OF BEER WINE AND DISTILLED SPIRITS FOR ON 47) IN A BONA CONSTRUCT AN RESTAURANT. RECOMMENDATION 1 -SITE CONSUMPTION (ABC LICENSE TYPE FIDE PUBLIC EATING PLACE AND TO OUTDOOR DINING AREA AT AN EXISTING That the Zoning Administrator adopt Zoning Administrator Action 05-009 approving Conditional Use Permit 05-006. Zoning Administrator Report Conditional Use Permit 05-006 May 23, 2005 Page 2 Site and Surrounding Properties The site is located within the Enderle Center at the southeast corner of 17'h Street and Yorba Street within the Planned Community Commercial District (PC -COMM) (Attachment A- Location Map). Enderle Center is bounded by Enderle Center Drive, Vandenberg Lane, Yorba Street and 17th Street and is comprised of four (4) multi -tenant buildings and three (3) free standing restaurant buildings. The restaurant is within a free- standing building at 17320 E. 17'h Street where the former Hof's Hut Restaurant was located. Prosect Description The applicant is currently remodeling the existing Hof's Hut Restaurant, which includes adding an indoor bar area and take-out bakery, and proposing to upgrade the alcoholic beverage sales to include distilled spirits and to construct an outdoor dining area with small bar (Attachment B — Submitted Plans). The business would operate as follows: Monday -Thursday 11:00 a.m. to 10:00 p.m. Saturday 9:00 a.m. to 11:00 p.m. Friday 11:00 a.m. to 11:00 p.m. Sunday 9:00 a.m. to 10:00 p.m. The applicant is requesting authorization to upgrade the existing ABC license for the on- site sale of beer and wine (ABC license Type "41 ") in conjunction with a restaurant to include distilled spirits (ABC license Type "47"). Alcoholic beverage sales establishments are permitted in association with a restaurant use subject to the approval of a conditional use permit. The applicant is also requesting to establish an outdoor seating area within an area previously containing landscaping. Architecture The architecture of Enderle Center is primarily Spanish Colonial with a tile mansard roof and colonnades along the perimeter of the buildings. The multi -tenant buildings are generally consistent in architectural style and materials; however, the freestanding restaurantS such as EI Torito, Hof's Hut and Olive Garden are eclectic in design and color. As part of the restaurant remodel, the applicant is proposing to paint the entry tower and building elevation at the bakery entrance "Pumpkin Cream" by Benjamin Moore, which is a rich orange color, and the remaining building walls would be painted "Shoot Star' by Benjamin Moore, a soft cream color. A polished metal would be installed on the walls within the entry recess, the awnings would be replaced with new fabric awnings with matching building colors and flame graphics, and a new stone veneer would be installed on a new fireplace feature facing the outdoor dining area. The patio enclosure will have a low, solid combination planter wall and glass, with a stone water and fire feature in the corner of the patio. New landscaping would be installed around the patio enclosure between the parking lot, new walkway, and patio wall (Attachment B —Submitted Plans). Condition Nos. 2.8 and 2.9 are included to require the applicant to maintain the patio Zoning Administrator Report Conditional Use Permit 05-006 May 23, 2005 Page 3 furniture, umbrellas, awnings, and landscaped areas at the perimeter of the outdoor seating in good condition and to replace dilapidated furniture within thirty (30) days upon notification by the City (Attachment C- Zoning Administrator Action 05-009). Parking Requirements/Summary The previous restaurant was permitted up to 274 seats; the applicant is proposing 170 indoor seats and twenty-six (26) outdoor seats for a total of 196 seats. The overall center is required to provide 660 standard parking spaces for various retail and restaurant uses. This number was reduced from 771 spaces by a 0.85 Multi -Use Parking Adjustment Factor originally approved with development of the center, not including compact spaces. Of the 714 standard and compact parking spaces available, forty-eight (48) are considered excess parking spaces given the existing mix of uses in the center. As a result, the proposed restaurant will comply with the City of Tustin parking requirements. Alcoholic Beverage Sales Regulations and Guidelines Staff has reviewed the proposed use for conformance with the City's Alcohol Beverage Sales Establishment Guidelines as amended by the Planning Commission on May 14, 2001, and the applicable zoning code regulations. With the addition of on-site sale and consumption of distilled spirits with beer and wine, there is the potential for an ancillary bar use to be established at this location which may be subject to distance separation requirements contained in the Tustin City Code. As such, Condition No. 2.15 is included to require the applicant to submit the audited financial statements of the proposed restaurant on a quarterly basis for verification that food sales exceed sales of alcoholic beverages. This would ensure that no ancillary bar use could be established where it could not meet the City's minimum distance separation requirements. Conditions 2.3 and 2.5 are also included to ensure food is available in the restaurant during business hours, and the sale of alcohol is contingent upon the business remaining a restaurant. Staff has included conditions pertaining to the City's Alcoholic Beverage Sales Establishment Guidelines in Zoning Administrator Action 05-009 (Attachment C) to mitigate concerns related to the on-site sale and consumption of beer, wine, and distilled spirits in conjunction with the restaurant. FINDINGS A decision to approve this request may be supported by the finding that the establishment, maintenance, and operation of selling alcoholic beverages for on-site consumption within a bona fide restaurant, and establishment of an outdoor dining area will not be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood, nor be injurious or detrimental to the property and improvements in the neighborhood of the subject property, or to the general welfare of the City of Tustin, in that: Zoning Administrator Report Conditional Use Permit 05.006 May 23, 2005 Page 4 a.
