HomeMy WebLinkAboutZA ACTION AGENDA 11-14-05 ACTION AGENDA ZONING ADMINISTRATOR REGULAR MEETING NOVEMBER 14, 2005 **** CALL TO ORDER: 10:34 a.m. Community Development Department Conference Room ROLL CALL: Dana Ogdon, Acting Zoning Administrator Staff present: Minoo Ashabi, Associate Planner Eloise Harris, Recording Secretary PUBLIC CONCERNS: (Limited to 3 minutes per person for items not on the agenda) CONSENT CALENDAR: No Items on Consent Calendar PUBLIC HEARINGS: 1. Conditional Use Permit 05-035 a request to establish a pilates studio for individuals or group of not more than two (2) persons within a commercial retail center. The project is located on 17390 Seventeenth Street, Suite F within the Planned Community Commercial (PC-COMM) zoning district. APPLICANT! STUDIO J ATTN: JULIA J. HINCHMAN PROPERTY OWNER: EMS DEVELOPING CO. ATTN: MAURICE A. ENDERLE RECOMMENDATION That the Zoning Administrator adopt Zoning Administrator Action 05-022 approving Conditional Use Permit 05-035. The Public Hearing opened at 10:35 a.m. The Acting Zoning Administrator introduced the staff present, explained the process to the applicant's representative, asked him to introduce himself, and asked whether he had received and understood the staff report. Robert Pearson indicated he was present as a representative for his daughter, Julia Hinchman; and, indicated he thought the space was 650 square feet. Mr. Pearson also stated that he had reviewed and understood the staff report and had no issues or concerns except the need to make the tenant site's restroom conform to ADA requirements. Zoning Administrator Agenda November 14, 2005 Page 2 Minoo Ashabi stated the space is approximately 400 square feet according to the plans provided by the applicant. Mr. Pearson stated he understood the issues of the bathroom access and technical compliance being required; added that Ms. Hinchman is only licensed to teach individuals who are not disabled; and, asked if moving the privacy wall would be the best way to accommodate the restroom. It was suggested that the building department staff could answer this question. The Acting Zoning Administrator explained the reasons for the disabled restroom access required by Condition 3.2. Minoo Ashabi indicated that a 50-inch clearance would be necessary. The Acting Zoning Administrator adopted Zoning Administrator Action 05-022 approving Conditional Use Permit 05-035. REGULAR BUSINESS: None ADJOURNMENT: The Acting Zoning Administrator closed the Public Hearing and adjourned the meeting at 10:40 a.m. The date of the next regular meeting of the Zoning Administrator will be scheduled when items are set for hearing.
