PUBLIC HEARINGS:
1. CONDITIONAL USE PERMIT 06-009 and DESIGN REVIEW 06-014 - A request
for alteration of an existing historical building (Tustin Garage) to establish a
restaurant with on-site beer and wine sales (Type 41) in Old Town Tustin.

RECOMMENDATION:
That the Zoning Administrator adopt Zoning Administrator Action No. 06-
008 approving Conditional Use Permit 06-009 and Design Review 06.014.

The Public Hearing opened at 10:06 a.m.
Minoo Ashabi presented the staff report.
The Zoning Administrator asked for confirmation of the hours of operation.
Staff stated the hours of operation are from 11 :00 a.m. to 10:00 p.m.

The Zoning Administrator asked the applicant if he had read the staff report and agrees to
the conditions of approval.
The applicant answered in the affirmative.
The Zoning Administrator asked if the applicant had other comments.
The applicant stated that he is excited about the prospect of upgrading an historical
building and believes this will bean appropriate use of the site.
Mr. Dale Boosey, 460 EI Camino Real, stated that his home was built in 1905 and he
recently received an invitation to place an historic plaque on the property; seven
generations of his family grew up in the house; there are still four private residences on
the block, the owners of which are concerned regarding the proliferation of uses involving
liquor licenses and the seeming lack of regard for the private homeowners; there have
been continuing concerns regarding unruly behavior by inebriates; the property is
approximately 270 feet from the proposed restaurant; there are concerns regarding the
use of the parking structure for the required parking since there have been incidents of
vandalism and unruly behavior previously associated with that parking structure; the issue
is protecting the privacy and quiet for the residents living along EI Camino Real.
The Zoning Administrator stated that the proposed use will be a bona fide eating
establishment; the City also has concerns regarding the establishments serving alcohol;
Conditions 2.10 through 2.18 have been included in the conditions of approval and are
designed to mitigate the unsavory impacts and ensure a calm environment for the
homeowners; while this is a commercial business district, staff wishes to ensure the
protection of the residential neighbors.
The applicant stated that he fully understood Mr. Boosey's concerns regarding drinking
establishments; the Beach Pit Barbecue is a family restaurant where no hard liquor will be
served; the targeted patrons will be families with children; the more vibrant businesses
such as the one proposed that locate in Old Town, the more people will be encouraged to
work together to respect the area.
Mr. Boosey emphasized that the primary problem with the parking structure is created by
teenagers who use the structure as a party area. The Tustin Police Department has been
very responsive to the problem.
The applicant suggested that the on-street parking available at the comer of Sixth and EI
Camino Real should require only minimal use of the parking structure; there is also an
arrangement with Jamestown Square; the intention is to be a good neighbor; the alcohol
served at his current business in Costa Mesa is approximately two percent of the total
sales.
The Zoning Administrator thanked the applicant and Mr. Boosey for their comments and
closed the Public Hearing at 10:24 a.m.
The Zoning Administrator adopted Zoning Administrator Action No. 06.()OB
approving Conditional Use Permit 06-009 and Design Review 06.()14.
