CALL TO ORDER — #3057 at 7:06 p.m. PRESENTATION OF COLORS, INVOCATION AND PLEDGE OF ALLEGIANCE — American Legion CLOSED SESSION REPORT — Acting City Attorney Michael Daudt: The City Council appointed a new City Manager, Aldo Schindler by a vote of 4-0-1 with Council Member Gomez abstaining. At the Mayor's discretion, Regular Business Item No. 15 was moved as the first item for consideration. 15. CITY MANAGER EMPLOYMENT AGREEMENT Following the conclusion of labor negotiations with a candidate for City Manager, the City Council will consider approval of an Employment Agreement with the candidate to serve as City Manager. Public Input — None It was moved by Mayor Pro Tern Gallagher and seconded by Mayor Lumbard to approve the proposed Employment Agreement with Aldo E. Schindler. Roll Call Vote — City Clerk Motion carried: 4-0-1 (Council Member Gomez abstained) PRESENTATIONS — Mayor Lumbard recognized Police Service Dog Ragnar for Five Years of Service as a Tustin Police Canine. Mayor Lumbard proclaimed May 7, 2024 — May 14, 2024 as Historic Preservation Week, followed by a PowerPoint presentation by the Historic Preservation Team. Recreation Superintendent Marilyn Buescher provided a PowerPoint presentation on the upcoming Sunset Market in Old Town. WAIVE READING IN FULL OF ALL ORDINANCES AND RESOLUTIONS ON THE AGENDA Motion: The City Council waived reading in full of all ordinances and resolutions on the agenda and declared that said titles which appear on the public agenda shall be determined to have been read by title and further reading waived. 2. APPROVAL OF MINUTES — THE REGULAR MEETING OF THE CITY COUNCIL HELD ON APRIL 16, 2024. Motion: The City Council approved the Action Minutes of the City Council Meeting held on April 16, 2024. 3. RATIFICATION OF PAYROLL AND DEMANDS City Council May 7, 2024 Meeting Minutes Page 4 of 15 DocuSign Envelope ID: 4E0478D2-AE17-425E-94E8-D61FlAAB2766 The City Council has approved the use of Government Code Section 37208 to expedite the payment of City of Tustin obligations that are in accordance with the approved budget or continued operations authorizations. Motion: The City Council approved Payroll in the amount of $947,913.91 and Demands in the amount of $10,235,678.36. 4. QUARTERLY INVESTMENT REPORT FOR THE CITY OF TUSTIN AND THE SUCCESSOR AGENCY FOR THE TUSTIN COMMUNITY REDEVELOPMENT AGENCY FOR THE QUARTER ENDING MARCH 31, 2024 Government Code Section 53646 requires that the Treasurer make an Investment Report to the City Council at least quarterly showing balances by authorized investment and certifying its compliance with the adopted Investment Policy. Motion: Received and filed. 5. AN APPROPRIATION TO PURCHASE THE MODERATE INCOME AFFORDABLE HOUSING UNIT AT 133 LIBERTY STREET The Tustin Housing Authority ("Authority") is seeking an appropriation to purchase the moderate income affordable housing unit at 133 Liberty Street under the terms of a Settlement Agreement with the homeowner. Motion: The City Council appropriated $466,651 from unappropriated reserves of the General Fund to purchase the moderate income affordable housing unit at 133 Liberty Street. 6. AGREEMENT FOR TRANSFER OF OWNERSHIP OF POLICE SERVICE DOG Officer Taylor Ryan rotated out of the Canine Program and into the Patrol Division as a Sergeant, effective March 25, 2024. Police Service Dog (PSD) Ragnar will be retired from active service. Ragnar is a 5-year-old Belgian Malinois and has served as a Tustin Police Canine for five years. Based on the unique bond between canine and handler, Sergeant Taylor Ryan has agreed to accept ownership of Ragnar. The Agreement for Transfer of Ownership of a Police Service Canine has been reviewed and approved by the City Attorney. Motion: Approved the Agreement for Transfer of Ownership for a Police Service Dog between the City of Tustin and Sergeant Taylor Ryan so that Ragnar can live out the remainder of his days with the Ryan family. 7. ADOPT RESOLUTION NO. 24-24 TO APPROVE THE CITY OF TUSTIN VEHICLE MILES TRAVELED ANALYSIS GUIDELINES UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT Senate Bill 743 (SB 743) was passed in 2013 establishing new requirements under the California Environmental Quality Act (CEQA) which evaluates Vehicle Miles City Council May 7, 2024 Meeting Minutes Page 5 of 15 DocuSign Envelope ID: 4E0478D2-AE17-425E-94E8-D61FlAAB2766 Traveled (VMT) metrics in -lieu of congestion or vehicle delay metrics previously used in determining a project's potential transportation impacts as it relates to CEQA. Although SB 743 was passed in 2013, public agencies were not required to start using VMT to measure traffic impacts until July 1, 2020. Similar to many neighboring agencies, and since July 2020, the City has used the guidelines and VMT metrics for CEQA as set forth by the California Office of Planning and Research (OPR) when analyzing projects within the City. To ensure continuity within the City's planning processes and ensure consistency within our local traffic network, the City hired RK Engineering Group, Inc. (RKE) to prepare the City of Tustin Vehicle Miles Traveled Analysis Guidelines. Motion: The City Council adopted Resolution No. 24-24 certifying the VMT Analysis Guidelines in compliance with new CEQA requirements. RESOLUTION NO. 24-24 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN ADOPTING THE CITY OF TUSTIN VEHICLE MILES TRAVELED ANALYSIS GUIDELINES UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT 8. JOHN WAYNE AIRPORT NOISE ABATEMENT QUARTERLY REPORT — Q3 & Q4, 2023 This agenda report transmits the John Wayne Airport (JWA) Noise Abatement Quarterly Report for the third and fourth quarters of 2023. The City of Tustin is within the JWA's "Noise Impact Area" since it has the potential to be exposed to an average Community Noise Equivalent Level (CNEL) of more than 65 decibels (dB). CNEL is a weighted average of noise levels over a 24-hour period, and is a measurement frequently used in regulating the impacts of airport noise on the surrounding community. The average noise level measured at Tustin's monitoring station (NMS 1 ON), which is located at Columbus Tustin Middle School on Beneta Way (Figure 1), remained below the City, County, and State maximum criteria of 65 dB CNEL during the third and fourth quarter reporting periods. Motion: The City Council received and filed this report. 9. LEGISLATIVE UPDATE Staff and the City's consultant Townsend Public Affairs (TPA) have prepared a summary of state legislative activity. Motion: 1. Took an OPPOSE UNLESS AMENDED position on AB 1886 (Alvarez) Housing element law: substantial compliance: Housing Accountability Act 2. REVIEW OF CITY'S CONFLICT OF INTEREST CODE The Political Reform Act requires that no later than July 1 st of each even -numbered year, the City Council direct a review of the City's Conflict of Interest Code. Motion: The City Council directed the City Manager, or designee, to have the City's Conflict of Interest Code reviewed, file a statement of review with the City Council no later than October 1, 2024, and revise the Conflict of Interest Code based upon such review, if necessary. 11. AUDIT COMMISSION VACANCY Due to a resignation by a member of the Audit Commission, staff is requesting that the City Council provide direction to fill the vacancy. Motion: The City Council directed the City Clerk to solicit applications to fill the Audit Commission vacancy. 12. SIDE LETTERS OF AGREEMENT TO THE MEMORANDA OF UNDERSTANDING WITH THE TUSTIN POLICE OFFICERS ASSOCIATION — POLICE OFFICER REPRESENTATION UNIT AND THE TUSTIN POLICE OFFICERS ASSOCIATION — POLICE MANAGEMENT REPRESENTATION UNIT Adoption of the attached Resolutions and Side Letters of Agreement to the Memoranda of Understanding will modify terms and conditions of employment for employees in classifications represented by the Tustin Police Officers Association — Police Officer Unit (TPOA) and the Tustin Police Officers Association — Police Management Unit (TPMA) in accordance with City Council direction. Motion: Adopted Resolution No. 24-26 and Resolution No. 24-27 amending the City's Classification and Compensation Plans and approving Side Letters of Agreement to the Memoranda of Understanding with TPOA and TPMA for the period July 1, 2021 through June 30, 2025. APPROVE THE ENGINEER'S REPORT FOR THE TUSTIN LANDSCAPE AND LIGHTING DISTRICT AND SET A PUBLIC HEARING TO CONSIDER LEVYING FISCAL YEAR 2024-2025 ASSESSMENTS Council Member Clark, Council Member Gomez and Council Member Schnell recused themselves due to a potential conflict in real property interest. Due to a lack of quorum, Council Member Clark, Council Member Gomez, and Council Member Schnell drew sticks to determine who will remain at the dais to participate in the discussion. Council Member Schnell drew the shortest stick; therefore, he remained to participate in the discussion and Council Member Clark and Council Member Gomez exited the Council Chamber during the discussion. Acting Assistant Director of Public Works Stacey Cuevas provided a PowerPoint presentation. At the February 6, 2024 meeting, the City Council ordered the preparation of an Engineer's Report for the Levy of Annual Assessments for the Tustin Landscape and Lighting District. The Engineer's Report is now complete and ready for City Council approval. Additionally, it is requested that the City Council declare its intention to levy annual assessments and set a public hearing for June 4, 2024. Public Input — None It was moved by Mayor Pro Tern Gallagher and seconded by Mayor Lumbard to: 1. Adopt Resolution No. 24-30 approving the Engineer's Report for the Tustin Landscape and Lighting District for Fiscal Year 2024-2025; and 2. Adopt Resolution No. 24-31 declaring its intention to levy annual assessments for Fiscal Year 2024-2025 and setting a public hearing for June 4, 2024. COUNCIL MEMBER COMMENTS AND REPORTS Council Member Gomez April 17 Attended Tustin Effective Apartment Managers (TEAM) luncheon meeting. April 18 Attended the Orange County Mosquito and Vector Control Board Meeting; reported the following: • A presentation on the new vector management program was given; and • To date the district has received twelve travel related dengue cases to investigate and one flea borne typhus case; the district expects the numbers to increase with travel related cases; and • The mosquito counts are higher than the five-year averages due to the abundance of rain and increasing breeding sources for the mosquitos; and • The communications staff kicked off the 2024 summer campaign, "Fight Back OC" to educate the public on vector control; and • The best way to repel mosquitoes when traveling is to wear EPA approved repellent and wear light colored, loose clothing; and • With many areas experiencing an increase in dengue fever it is important for residents to know how to protect themself and their families while travelling. April 20 Was a judge for the Tustin Host Lions Club's Regional Student Speaker Contest in La Habra. April 22 Attended the Orange County District Attorney's Office Crime Victims' Rally event; was well attended by families, victims, and survivors of crime; reported many local officials and law enforcement officers were in attendance. April 23 Attended the Senior Fund Annual Director's meeting; reviewed the accomplishments of the past year and determined the future projects for the center. May 1 Attended the Orange County Mosquito and Vector Control District Budget Workshop meeting. May 2 Attended the Senior Advisory Board meeting; provided the following updates: • Made nominations for the new board; and • Announced the Senior Center is looking for participants to take an assessment survey on the center; stated this survey is important for future programs and services; stated if anyone would like to take the survey, go to the Senior Center or call to have one mailed to you; and • Reported the March Casino Night was sold out; had great attendance; and • Stated the "Community Tour" concert t-shirts are still available for purchase at the Senior Center and at city events; and • Announced the following upcoming events at the Senior Center; contact the Senior Center on these and other activities: o Mother's Day Luncheon, Friday, May 10, 2024, and o Get Fit Week, May 13-17, 2024. May 3 Attended Parks and Recreation Department's Cinco de Mayo event at Frontier Park; reported there were great performances by local groups, many booths, and games for people to enjoy. May 4 Attended Family Promise of Orange County Pickleball Tournament event; stated Family Promise of Orange County is one of the city's partners. Announced she is looking forward to Parks and Recreation Department's Sunset Market on Thursdays this summer. Council Member Schnell April 24 Attended the Foothill/Eastern Transportation Corridor Agency (TCA) Joint Operations Finance Committee meeting; reviewed the 2024-2025 budget; the organization is in a very good financial state; reported there are a large number of projects to help with transportation for South Orange County residents. April 30 Attended the Queen's Home Ribbon Cutting event; Queen's Home is a fifteen -room affordable senior housing facility; was happy to attend. May 4 Attended the Orange County Fire Authority's (OCFA) and Orange County Local 3631 Firefighters' Fire Ops 101 educational training event with Mayor Pro Tern Gallagher; reported OCFA Division Chief Scott, was in attendance; was able to see a day in the life of a firefighter; stated it is tough to be a firefighter; reported 75% of the calls for firefighters are for health issues/medical emergencies and only 4% are for fire response. Announced he will be attending the following: • Tustin Chamber of Commerce Board meeting on Wednesday, May 8, 2024; and • Foothill/Eastern Transportation Corridor Agency (TCA) Board of Directors meeting, Thursday, May 9, 2024; and • Alley Grove Promenade Ribbon Cutting event, Thursday, May 9, 2024; stated is a 2.4-acre tree lined walking path; and • Mayor's Celebration event, Thursday, May 9, 2024. Wished Council Member Clark and Council Member Gomez a Happy Mother's Day; asked everyone to thank mothers this Mother's Day. Council Member Clark Visited Lendistry's Open House event on the top floor of FLIGHT at Tustin Legacy; 50-60 people were in attendance from the Orange County Hispanic Chamber of Commerce; was great to see how far FLIGHT has come through the years. Mentioned she was a guest speaker at the Tustin Host Lions Club event at the Santa Ana Elks Lodge; was invited by Cherill Cady; was happy to be a speaker; gave an update on the Navy North Hangar and other events in Tustin. Attended the Girls Inc. of Orange County Gala event; stated this organization supports girls to be strong, smart, and bold; was a great gala. Announced she will be a judge at the Mr. Tustin Pageant event at the Santa Ana Elks Lodge on Saturday, May 11, 2024. Announced she is looking forward to the Mayor's Celebration event on Thursday, May 9, 2024. Attended two Orange County Sanitation District (OC San) meetings; recognized the graduates of OC San's Wastewater 101 program; the program is a great opportunity for individuals to participate and understand how Orange County's wastewater system works; anyone interested in the program to reach out and he will make sure they are on a waiting list for next year's Wastewater 101 program; announced OC San's new facility in Fountain Valley will be having its Open House event on June 8, 2024, from 9:00 AM — 12:00 PM; guided tours, giveaways, raffles and entertainment will be happening. Mayor Lumbard April 18 Was a speaker at the Tustin Legacy Magnet Academy for the Future Business Leaders of America class; spoke about what it means to be in local government and how it can apply to business leadership. April 24 Attended the Tustin Community Foundation monthly nonprofit and inter -faith meeting. May 2 Attended the Southern California Associations of Government's Regional Conference and General Assembly event in Desert Springs. May 3 Attended Parks and Recreation Department's Cinco de Mayo event at Frontier Park; thanked city staff and Congresswoman Young Kim for participating. Thanked the Acting City Manager, Nicole Bernard, and everyone else for their dedication to the community.
