2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN APPROVING AMENDMENT NO. 2 TO VESTING
3 TENTATIVE TRACT MAP NO. 14410, LOCATED AT THE
NORTHWESTERLY CORNER OF PIONEER ROAD AND PETERS
4 CANYON ROAD.
5 The City Council of the City of Tustin does hereby resolve
as follows:

I. The City Council finds and determines as follows:

Ao That Amendment No. 2 to Vesting Tentative Tract
8 Map 14410 was submitted to the Planning
Commission by Lewis Homes of California for
9 consideration to eliminate three (3) previously-
approved product types and to add two (2) new
10 product types on Tract 14410, located at the
northwesterly corner of Pioneer Road and Peters
11 CanyOn Road; and
12 B. That a public hearing was duly called, noticed
and held for. said Amendment by the Planning
13 Commission on November 25, 1996, whereby the
Planning Commission recommended approval of said
14 Amendment to the City Council; and
15 C. That a public hearing was duly called, noticed
and held for said Amendment on December 16, 1996
16 by the City Council; and
17 C. That an Environmental Impact Report EIR 85-2, as
amended, for the East Tustin Specific Plan has
18 been certified in conformance with the
requirements of the California Environmental
19 Quality Act for the subject project; and
20 D. That the proposed subdivision is in conformance
with the Tustin General Plan, adopted East Tustin
21 Specific Plan~ Development Agreement and
Subdivision Map Act; and

E. The 1.5198 acres of parkland required for this
23 development was previously dedicated with
recordation of Tract 13627; and

Fo That the City has reviewed the status of the
25 SchoOl Facilities Agreements between.the Irvine
Company and the Tustin Unified School District
26 for the impact of Amendment to Vesting Tentative
Tract 14410 on School District facilities, and
27 changes in State law. Impacts associated with
this appr6val on School District facilities are
28 adequately addressed; and

Go That the site is physically suitable for the type
2 of development proposed; and
3 H. That the site is physically suitable for the
proposed density of development; and

I. That the design of the subdivision or the
5 proposed improvements are not likely to cause
substantial environmental damage or substantially
6 and avoidably injure fish or wildlife in their
habitat; and
7
Jo That the design of the subdivision or the type of
8 improvements proposed ~will not conflict with
easement acquired by the public at large, for
9 access through or use of the property within the
proposed subdivision; and

K. That the design of the subdivision or the types
11 of improvements proposed are not likely to cause
serious public health problems.

L. The project has been determined to be exempt from
13 the provisions of Measure "M" because
entitlements specified in the East Tustin
14 Development Agreement entered into in 1985, and
the estimated project generated traffic does not
15 cause the roadway system to exceed established
levels of service standards.

II. The City Council hereby approves Amendment No. 2 to
17 Vesting Tentative Tract Map 14410, authorizing the,
elimination of three (3) previously approved approved
18 product types and the addition of two (2) new product
types' on Tract 14410, located at the northwesterly
· 19 corner of Pioneer Road and Peters Canyon Road, subject
to the Conditions contained in Exhibit A of Planning
20 Commission Resolution No. 3470, incorporated herein by
reference.
