SUBJECT: AMENDMENTS TO THE 1999-00,2002-03, AND 2005-06 ACTION PLANS FOR
COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDS AND CITIZEN
PARTICIPATION COMMITTEE APPOINTMENTS FOR CDBG PROGRAM
YEAR 2007-08
RECOMMENDATION
That the City Council:
1) Adopt Resolution No. 06-124 amending the Action Plans for Fiscal Years
1999-00, 2002-03, and 2005-06 to transfer unused funds to CDBG projects
that can be immediately implemented; and,
2) Appoint two at-large representatives for the 2007-08 Citizen Participation
Committee.
FISCAL IMPACT
The proposal involves the reallocation or redistribution of CDBG funds from previously
approved projects and the selection of volunteer community members. No impacts to
the General Fund are anticipated.
PROPOSED AMENDMENTS / FUNDS REALLOCATIONS
The Community Development Department is proposing to amend the 1999-00, 2002-03
and 2005-06 CDBG Action Plans which described the activities the City were to
undertake during the program years to address the priority needs of housing and
Community Development. The proposed amendment would reallocate funds from slow
moving activities to activities that can be immediately active. Federal Law Section
573.902(a)(1 )(i) related to CDBG programs indicates that HUD will consider an
entitlement recipient (City) to be failing to carry out its CDBG activities in a timely
manner if, sixty days prior to the end of current program year, the amount of entitlement
grant funds available is more than 1.5 times the entitlement grant amount for the current

program year. The proposed reallocations, if approved by the City Council, would allow
the City to expedite draw down of COBG funds to meet the timeliness requirements, In
addition, the reallocation will alleviate HUO's inquiry about the City's longstanding
incompleted activities,

In accordance with Federal Law, the City has published a notice in the local newspaper
with regard to the proposed amendments, Staff recommends that the City Council
support the amendments to the FY 1999-00, 2002-03, and 2005-06 Action Plans to
transfer unused funds to COGB projects that can be immediately implemented.
CITIZEN PARTICIPATION COMMITTEE
In January 2003, the City Council adopted the City's Citizen Participation Plan (the
Plan) which provides a public participation process by a citizen participation committee
in identifying needs, setting priorities, allocating funds to eligible activities, and
overseeing the overall COBG program implementation and performance, The Plan
defines the roles, responsibilities, and composition of the Citizen Participation
Committee as follows:
1. Citizen Participation Committee Membership
The Citizen Participation Committee is an Ad Hoc Committee comprised of seven
(7) members. Committee members should be active community leaders who are
aware of the needs of the community and who will assist in obtaining citizen input

concerning the CDBG Program, The composition of the Citizen Participation
Committee is as follows:
. One representative from the Planning Commission
. One representative from the Parks and Recreation Commission
. One representative from the Cultural Resources Advisory Committee
. One representative from the Senior Advisory Board
. One representative from the Tustin Audit Committee
. Two at large representatives appointed by the City Council
2. The Citizen Participation Committee duties and responsibilities are as follows:
. To provide citizen and community input in an advisory fashion on the
development, implementation, evaluation, and amendments to the CDBG
Program,
. To hold at least one public hearing during the development of the Action Plan
and/or Consolidated Plan to obtain citizens views and to respond to citizen
proposals and requests, to assist in the determination of the community
development and housing needs and priorities, and to obtain comments on the
City's CDBG program performance,
. To encourage broad citizen and community participation on the CDGB
Program,
Pursuant .to the CDBG Citizen Participation Plan, the City Council is requested to appoint
two at-large representatives on the 2007-08 Citizen Participation Committee, The meeting
date for Citizen Participation Committee is tentatively scheduled for February 13, 2007,

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, APPROVING AMENDMENTS TO
THE CITY'S 1999-00, 2002-03, AND 2005-06 COMMUNITY
DEVELOPMENT BLOCK GRANT (CDBG) PROGRAM
ACTION PLANS BY REALLOCATING $65,000 OF
UNUSED CDBG FUNDS TOWARDS AN OLD TOWN
PARKING STUDY AND AUTHORIZING SUBMISSION OF
THE AMENDMENT TO THE FEDERAL DEPARTMENT OF
HOUSING AND URBAN DEVELOPMENT
WHEREAS, under the Housing and Community Development Act of 1974, as
amended, Federal assistance may be provided for the support of community
development activities which are directed toward certain specific objectives as set forth
in the Act as the Community Development Block Grant; and
WHEREAS, previously funded programs and projects have not been initiated and
remain inactive and funds remain unexpended; and
WHEREAS, it is important that the City of Tustin expend CDBG funds
expeditiously to meet the timeliness requirement; and
WHEREAS, funds must be reallocated to other eligible activities prior to
expenditure; and
WHEREAS, citizens were notified of the proposed changes in use of CDBG
funds through a legal notice published in the local newspaper; and
WHEREAS, the City Council considered the amendment at the meeting on
November 20, 2006,
NOW THEREFORE BE IT RESOLVED, the City Council of the City of Tustin
resolves as follows:
Section 1: The amendment to the City of Tustin's 1999-00, 2002-03, and
2005-06 Action Plans shall be as follows:

Section 2: Staff is hereby directed to prepare and submit the amended Action
Plans for 1999-00, 2002-03, and 2005-06 program years to the Federal Department of
Housing and Urban Development reflecting Council's direction for the City's funding
allocations to eligible program activities,
Section 3: The City Manager of the City of Tustin or his designated
representative, such as the Director of Community Development, is authorized to
execute documents, certifications, contracts, or other instruments as may be required to
carry out the City's Community Development Block Grant (CDBG) Program,
Section 4: The City Clerk shall certify to the adoption of this Resolution and shall
file a copy of said application with the minutes of this City Council meeting.
