SUBJECT: APPROVAL OF GRANT DEEDS TO THE STATE OF CALIFORNIA IN
CONJUNCTION WITH THE RED HILL AVENUE WIDENING PROJECT AT THE
1-5 FREEWAY (CIP NO. 7133)
SUMMARY
The Grant Deeds from the City of Tustin to the State of California will transfer a portion of land
recently acquired for the Red Hill Avenue Widening Project at the 1-5 Freeway (CIP No. 7133). The
transferred land is on Red Hill Avenue within the access control area of the 1-5 Freeway.
RECOMMENDATION
It is recommended that the City Council approve Grant Deeds 102318, 102319, and 102320 granting
certain real property to the State of California and authorize the Mayor and City Clerk to execute the
Grand Deeds on behalf of the City.
FISCAL IMPACT
None.
BACKGROUND
In order to construct the Red Hill Avenue Widening Project at the 1-5 Freeway (CIP No. 7133), an
encroachment permit was required, as well as a right-of-way certification from Caltrans. Before
issuing the right-of-way certification, Caltrans stipulated that the City agree to grant certain land to
Caltrans upon completion of the project. The area to be granted to Caltrans is on Red Hill Avenue
within their access control area of the 1-5 Freeway. Caltrans access control areas are typically within
one hundred feet of a freeway on-ramp or off-ramp.
DISCUSSION
The subject Grant Deeds include a legal description and diagram of the areas to be granted to
Caltrans. The areas are adjacent to AI's Woodcraft at the northwest corner of Red Hill Avenue and
Nisson Road, Wendy's Restaurant at the southeast corner of Red Hill Avenue and EI Camino Real,
and the Starbuck's Center at the southwest corner of Red Hill Avenue and EI Camino Real. The
property acquired by the City outside of the Caltrans access control area at each of the three
locations remains City right-of-way.
The City Attorney has reviewed the three Grant Deeds and has signed them Approved as to Form.
