A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF TUSTIN, CALIFORNIA, ADOPTING THE
MITIGATED NEGATIVE DECLARATION FOR DESIGN
REVIEW 2023-0009 FOR THE DEVELOPMENT OF TWO
NEW INDUSTRIAL BUILDINGS LOCATED AT 1562,1,15641
AND 15661 RED HILL AVENUE.,
The Planning Commission does hereby resolve as follows:
I. The Planning Commission finds and determines as follows:
A. That a proper application has been submitted by Centurion Plaza LLC, a
California limited liability company, requesting authorization to demolish
three existing office buildings and a parking structure to construct two new
industrial buildings including a 49,552 square foot building with five dock
doors (Building 1) and a 93,372 square foot building with 11 dock doors
(Building 2) on approximately 6,.17 acres located at 15621,15641 and '15661
Red Hill Avenue;
B. That the Development Application requests Design Review(DR) 2023-0009
approval for site layout and building design;
C. That the subject property is located within the Planned Community
lndustrial/Business (PC IND/BUS) zoning district and is regulated by
Ordinance No. 8,16 (International Rectifier Planned Community District
Regulations) and has a Planned Community Commercial Business General
Plan land use designation;
D. That the City of Tustin prepared an Initial Study to evaluate the potential
environmental impacts associated with DR 2023-0009 that concluded
potential impacts are at a level of insignificance and a Draft Mitigated
Negative Declaration (MND) was prepared. The Draft MND was made
available for public review;
E. That a Notice of Intent to Adopt a MND was filed with the California State
Clearinghouse, SCH No, 2024040618, for posting and provided to
members of the public using a method permitted under CEQA Guidelines
Section 15072(b). The Initial Study and Draft MND were made available for
a 20-day public review and comment period from April 12, 2024, to May 2,
2024, in compliance with Sections 15072 and 15105 of the State CEQA
Guidelines;
F, That public comments were received and a Final MND with responses to
submitted comments was prepared and is attached hereto as Exhibit C;

G. That whenever a lead agency approves a project requiring the
implementation of measures to mitigate or avoid significant effects on the
environment, CEQA also requires a lead agency to adopt a Mitigation
Monitoring and Report Program (MMRP) to ensure compliance with the
mitigation measures during project implementation;
H. That the City is the lead agency on the project and the Planning
Commission is the decision-making body for the proposed project;
1. That the Planning Commission conducted a duly noticed public hearing on
May 28, 2024, to consider the Initial Study, proposed' MND along with its
MMRP, and DR 202,3-0009 at which hearing members of the public were
afforded an opportunity to comment upon the project; and
J. That the Planning Commission has considered the Initial Study/MND, the
MMRP, and response to comments received during the public review
process, attached hereto as Exhibits A, B and C.
K That the Planning Commission has considered public comments received
and determines as follows:
a. None of the comments provide substantial evidence that the project will
have significant environmental effects which WOUId require preparation
of an Environmental Impact Report;
b. None of the information in the letters or responses, constitute the type of
significant new information that requires recirculation of the MNI:D for
further public review;
c. None of the new material indicates that the project will result in a,
significant new environmental impact not previously disclosed in the
Project MND- and

cl, None of the information indicates that there would be a substantial
increase in the severity of a previously identified environmental impact
that will not be mitigated, or that there would be any of the other
circumstances requiring recirculation described in State CEQA
Guidelines Section 15073,5.
11, The Planning Commission hereby adopts the MND attached hereto as Exhibit A
and its MMRP attached hereto as Exhibit B for DR 2023-0009 relating to two new
industrial warehouse facilities located at 15621,15641 and 15661 Red Hill Avenue,
111. That the facts and reasons for said recommendation of adoption of the Initial
Study/MND and MMRP are hereby found and declared to be as follows:
The Planning, Commission, as a result of its consideration and evidence presented
at the hearing on this matter, determined that, as required pursuant to CEQA ,and
the State CEQA Guidelines, the MIND and MMRP adequately address the
expected environmental impacts of the project. On the basis of this review, the
Planning Commission finds that there is no evidence from which it can be fairly
argued that the project will have a significant adverse effect on the environment,
PASSED AND ADOPTED by the Planning Commission of the City of Tustin at a regular
meeting on the 28th day of May, 2024.
