2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN FINDING THAT THE FINAL ENVIRONMENTAL IMPACT
3 REPORT (EIR) PREPARED FOR THE EAST TUSTIN SPECIFIC
PLAN (FINAL EIR 85-2, AS MODIFIED BY SUBSEQUENTLY
4 ADOPTED SUPPLEMENTS AND ADDENDA) IS ADEQUATE TO
SERVE AS THE PROGRAM EIR FOR AMENDMENT. NO. 2 TO
5 VESTING TENTATIVE TRACT MAP 14410 AND APPLICABLE
MITIGATION MEASURES HAVE BEEN INCORPORATED AS
6 REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUALITY
ACT.

The City Council of the City of Tustin does hereby resolve as
8 follows:
9 Io The City Council finds and determines as follows:
10 A. That Amendment No. 2 to Vesting Tentative Tract Map
14410 and respective development plans are
11 considered "projects" pursuant to the terms of the
California Environmental Quality Act; and

B. That the projects are covered by a previously
13 certified Final Environmental Impact Report 85-2,
.as amended, for the East TustinSpecific Plan which
14 serves as a Program EIR for the proposed project.
15 IIo The East Tustin Specific Plan Final Environmental impact
Report (85-2), previously certified on March 17, 1986, as
16 modified by subsequently adopted supplements and addenda,
was considered prior to approval of this project. The
17 City Council hereby finds: this project is within the
scope of the East Tustin specific Plan previously
18 approved; the effects of this project, relating to
grading, drainage, circulation, public services and
19 utilities, were examined in the Program EIR. The
applicablemitigation measures and alternatives developed
20 in the Program EIR are incorporated into this project.
The Final EIR, is therefore determined to be adequate to
21 serve as a Program EIR for this project and satisfies the
requirements of the California Environmental Quality Act.

Further, the City Council finds the project involves no
23 potential for any adverse effect, either individually or
cumulatively, on wildlife resources; and therefore, makes
24 a De Minimus Impact Finding related to AB 3158, Chapter
1706, Statutes of 1990.

Applicable mitigation measures identified in the Final
3 EIR have been incorporated into this project which
mitigate potential significant environmental, effects
4 thereof. The mitigation measures are identified as
Conditions on Exhibit-A-of Planning Commission Resolution
5 No. 3470 recommending approval of Amendment No. 2 to
Vesting Tentative Tract Map 14410, Exhibit A of Planning
6 Commission Resolution No. 3467'approving Amendment No. 2
to Hillside Review 95-001 and Exhibit A of Planning
7 Commission Resolution No. 3468 approving Design Review
96-037.
