SUBJECT: ADOPT RESOLUTION 24-51, AUTHORIZING THE CITY
MANAGER, OR THEIR DESIGNEE, TO EXECUTE ALL
PERMANENT LOCAL HOUSING ALLOCATION DOCUMENTS
SUMMARY
The Tustin Housing Authority is seeking City Council authorization for the City Manager,
or their designee, to execute all Permanent Local Housing Allocation (PLHA)
documents as required by the State of California Department of Housing and
Community Development (HCD).
RECOMMENDATION
It is recommended the City Council adopt City Council Resolution 24-51, authorizing the
City Manager, or their designee, to execute all PLHA documents as required by HCD.
FISCAL IMPACT
In FY 2024-25, the City will receive $330,525 in PLHA funds. The allocation will
partially fund the Tustin Temporary Emergency Shelter.
CORRELATION TO THE STRATEGIC PLAN
PLHA funding contributes to Goal A of the City's Strategic Plan, enhancing the vibrancy
and quality of life in all neighborhoods and areas of the community.
BACKGROUND/DISCUSSION
On May 19, 2020, the City Council approved the City of Tustin's Five -Year PLHA
Plan and authorized by resolution former City Manager, Matthew S. West, to
execute all PLHA documents as required by HCD. Staff provided documentation to
HCD demonstrating Nicole Bernard was the Acting City Manager when she signed
the 2023 PLHA Formula Allocation Application for $330,525 on May 8, 2024, and
were prepared to provide similar documentation for City Manager Aldo. E. Schindler.

HCD has indicated their legal counsel has not previously accepted such
documentation and requires a new City Council -approved resolution when the
authorized representative named in the resolution is no longer in the position. As HCD
recommended, staff have prepared a new resolution that only lists the title of the
authorized representative and leaves out their name.
Staff recommends the City Council adopt City Council Resolution 24-51, authorizing the
City Manager, or their designee, to execute all PLHA documents as required by HCD.

RESOLUTION NO. 24-51
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA
AUTHORIZING THE CITY MANAGER, OR THEIR DESIGNEE, TO EXECUTE ALL
REQUIRED PERMANENT LOCAL HOUSING ALLOCATION DOCUMENTS
WHEREAS, the State of California (the "State") Department of Housing and
Community Development ("Department") is authorized to provide up to $296 million under
the SB 2 Permanent Local Housing Allocation Program Formula Component from the
Building Homes and Jobs Trust Fund for assistance to Cities and Counties (as described
in Health and Safety Code section 50470 et seq. (Chapter 364, Statutes of 2017 (SB 2);
and
WHEREAS, the Department issued a Notice of Funding Availability ("NOFA") dated
December 29, 2023, under the Permanent Local Housing Allocation ("PLHA") Program; and
WHEREAS, the City of Tustin, an eligible Local government, entered into a Standard
Agreement, 20-PLHA-15547, with the Department on June 25, 2021, to administer one or
more eligible PLHA activities with its PLHA formula allocation; and
WHEREAS, the Department may approve funding allocations for the PLHA Program,
subject to the terms and conditions of the Guidelines, NOFA, Program requirements, the
Standard Agreement and other contracts between the Department and PLHA grant
recipients; and
WHEREAS, on May 19, 2020, the City Council of the City of Tustin passed and
adopted Resolution No. 20-28 authorizing Matthew S. West, then City of Tustin City
Manager, to execute all required PLHA documents; and
WHEREAS, Mr. West is no longer the City of Tustin City Manager and the City
Council now desires to update its authorization to extend to the City Manager, or his
designee in general, such that any person appointed by the City Council as City Manager
in accordance with Tustin City Code Section 1411 shall be authorized to execute all
required PLHA documents.
NOW THEREFORE BE IT RESOLVED THAT:
1. The foregoing recitals are true and correct; and
2. The City of Tustin City Manager, or their designee, is authorized to execute the PLHA
Program Application, the PLHA Standard Agreement and any subsequent amendments
or modifications thereto, as well as any other documents which are related to the
Program or the PLHA grant awarded to Applicant, as the Department may deem
appropriate.
