BACKGROUND
• In October 2022, the 2021-2029 6th Cycle Housing
Element was certified by California Department of
Housing and Community Development (HCD)
• The Housing Element established goals and
policies addressing housing -related issues. The
Housing Implementation Program identifies
specific actions the City intends to take to achieve
these goals.

• The proposed amendments are City Initiated and
would modify Article 9 (Land Use) of the Tustin City
Code to align with state housing laws and
implement programs of the Housing Element of the
General Plan, specifically the following:
• Program 1.5(a): Streamline requirements for
triplexes and residential uses by removing
Conditional Use Permit requirements
• Program 2.1(a): Define and permit transitional
and supportive housing as residential uses per
state law ,

State Law Overview
• AB 2162 requires the following:
• Local agencies shall permit supportive housing by right in zones where
multi -family and mixed -use development is permitted
• Requires local entities to streamline the approval of housing projects
containing supportive housing
• Removes the requirement for CEQA analysis and CUP or other similar
discretionary entitlements
• Supportive housing to be a use by right in zones where multi -family and mixed -
uses are permitted, including non-residential zones permitting multi -family
uses, if the proposed housing development satisfies certain requirements
(Government Code 65651)

Council adopt Ordinance No.
1543
That the City Council
RECOMMENDATION conduct first reading of
Ordinance No. 1543J. by title
only, for Code Amendment
2024-0004 and set second
reading to the next available
Council meeting.
