Community Development Department Conference Room The Acting Zoning Administrator noted there was no one in attendance besides staff even though a notice and a copy of the staff report with conditions of approval were mailed to the applicant. Recording Secretary PUBLIC CONCERNS: (Limited to 3 minutes per person for items not on the aidenda) CONSENT CALENDAR: No Items on Consent Calendar PUBLIC HEARINGS: 1. CONDITIONAL USE PERMIT 05-043 - A request for authorization to temporanly operate soil and groundwater remediation equipment to remove subsurface hydrocarbons lor no longer than two years, APPLICANT: FREY ENVIRONMENTAL, INC. ATTN: ED RANDS PROPERTY OWNER: MAKENA GREAT AMERICA RECOMMENDATION: That the Zoning Administrator adopt Zoning Administrator Acllon No. 06-011 approving Conditional Use Permit 05 043. Presentation: Chad Ortlieb, Associate Planner The Public Hearing opened at1 0:52 a.m. Zoning Administrator Agenda December 18,2006 Page 2 The Acting Zoning Administrator noted the report states the remediation equipment may be used for up to two years; proposed Condition 1.8 would allow the applicant to request an extension ilevidence is provided indicating the remediation is not yet complete. This is an appropriate condition due to the fact that soil remediation is difficult to perform. The Acting Zoning Administrator also noted that Condition 1.9 recommends that the facility be fenced, screened, and that landscaping be placed on the facility with a climbing vine to screen It from view since IllS somewhat close to the site's parking lot and an on- ramp to the 1-5 freeway. Condition 1.9 also requires that all the above mentioned requirements be removed from the site upon completion of the remediation treatment. Staff's recommendations are in keeping with environmental clean up and protection of the aesthetics of the site. The Acting Zoning Administrator approved Zoning Administrator Action No. 06-011 approving Conditional Use Permit 05-043 with one correction. Condition 2.7 should be amended to add at the end of the first sentence "and be covered with a vine treatment." The Acting Zoning Administrator noted 101 the record that the staff report and notice were sent to the applicant, even though no one attended the hearing. Staff will prepare and send the approvals to the applicant and the property owner. The appeal period is 5:30 p.m., seven days from this date, December 18, 2006. REGULAR BUSINESS: None ADJOURNMENT: The Public Hearing closed at 10:55 a.m. The date 01 the next meeting of the Zoning Administrator will be scheduled when items are set for hearing.
