APPROVAL OF MINUTES — THE REGULAR MEETING OF THE CITY COUNCIL HELD ON SEPTEMBER 17, 2024. Motion: The City Council approved the Action Minutes of the City Council Meeting held on September 17, 2024. 3. RATIFICATION OF PAYROLL AND DEMANDS The City Council has approved the use of Government Code Section 37208 to expedite the payment of City of Tustin obligations that are in accordance with the approved budget or continued operations authorizations. SECOND READING AND ADOPTION OF ORDINANCE NO. 1543 (CODE AMENDMENT 2024-0004) - UPDATES RELATIVE TO THE IMPLEMENTATION OF THE 6TH CYCLE 2021-2029 HOUSING ELEMENT Adoption of Ordinance No. 1543 will amend various sections of Article 9 (Land Use) of the Tustin City Code by implementing Program 1.5(a) and Program 2.1(a) of the City's adopted Housing Element of the General Plan: • Program 1.5(a) — Streamlines the requirements for triplexes in the R-2 and R-3 zones and for residential uses Citywide in all zones by removing the Conditional Use Permit requirements. • Program 2.1(a) — Adds definitions for transitional and supportive housing and consider transitional and supportive housing to be a residential use and explicitly permits them subject only to those zoning regulations that apply to other residential dwellings of the same type in the same zone as required by AB 2162. ORDINANCE NO. 1543 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADOPTING ORDINANCE NO. 1543, AMENDING VARIOUS SECTIONS OF TUSTIN CITY CODE ARTICLE NINE (LAND USE) TO IMPLEMENT THE HOUSING IMPLEMENTATION PROGRAM OF THE 6TH CYCLE 2021-2029 HOUSING ELEMENT OF THE GENERAL PLAN (CODE AMENDMENT 2024-0004) Fiscal Impact: There was no fiscal impact associated with this item. 5. SECOND READING AND ADOPTION OF ORDINANCE NO. 1546 AMENDING WASTE REDUCTION AND RECYCLING PROGRAM REQUIREMENTS Adoption of Ordinance No. 1546 amends Section 4351 of the Tustin City Code to simplify the collection of deposits associated with the City's Waste Reduction and Recycling Program for construction and demolition debris. APPROVE PLANS AND SPECIFICATIONS AND AUTHORIZE ADVERTISEMENT FOR BIDS FOR THE OLD TOWN IMPROVEMENTS PROJECT The plans and specifications for the Old Town Improvements Project, Capital Improvement Project No. 70254, have been completed and approved by the City Engineer. Motion: The City Council: 1. Adopted Resolution No. 24-64 approving the plans and specifications for the Old Town Improvements project (CIP No. 70254); and 2. Authorized the City Clerk to advertise to receive bids. RESOLUTION NO. 24-64 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA APPROVING PLANS AND SPECIFICATIONS FOR THE OLD TOWN IMPROVEMENTS PROJECT, CIP NO. 70254 AND AUTHORIZING ADVERTISEMENT FOR BIDS Fiscal Impact: Sufficient funds have been budgeted and appropriated in this Fiscal Year 2024-2025 Capital Improvement Program for the Old Town Improvements project. The engineer's estimate for the Old Town Improvements project is $3,787,892. The project is funded through a combination of Community Development Block Grant funds (Fund 120) and Land Sale Proceeds funds (Fund 189). 11. ACCEPT IMPROVEMENTS AND FILE A NOTICE OF COMPLETION FOR THE FISCAL YEAR 2023-2024 ANNUAL ROADWAY REHABILITATION AND SIDEWALK REPAIR PROJECT — ZONE 5 Construction of the Fiscal Year 2023-2024 Annual Roadway Rehabilitation and Sidewalk Repair Project — Zone 5, Capital Improvement Project No. 70023 has been completed to the satisfaction of the City Engineer and is now ready for City Council Acceptance. Adopted Resolution No. 24-66 accepting the improvement of the Fiscal Year 2023-2024 Annual Roadway Rehabilitation and Sidewalk Repair Project, Capital Improvement Project No. 70023; and 2. Authorized the City Engineer to execute and file the Notice of Completion with the Orange County Recorder's Office. RESOLUTION NO. 24-66 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING THE PUBLIC WORKS AND IMPROVEMENT AND AUTHORIZING THE RECORDATION OF THE NOTICE OF COMPLETION FOR THE FISCAL YEAR 2023-2024 ANNUAL ROADWAY REHABILITATION AND SIDEWALK REPAIR PROJECT — ZONE 5 (CIP NO. 70023) Fiscal Impact: The final construction cost for the Annual Roadway Rehabilitation and Sidewalk Repair Project — Zone 5, is $3,604,192 with no contract change orders. Sufficient funds were budgeted and appropriated in the Capital Improvement Program using Senate Bill 1 funds (Fund 140) and Gas Tax funds (Fund 130). 12. INTRODUCTION OF ORDINANCE NO. 1552 REGARDING THE CITY PURCHASING SYSTEM At the September 17, 2024 meeting, the Council received a presentation of the options for potential amendments to the City's Purchasing Policy and Procedures, as outlined in the Tustin City Code sections 1621-1630. The Council discussed the options and provided direction to staff. This report, incorporating the Council's directions, presents the proposed updates to the City's Purchasing System as codified in the Tustin City Code. Motion: The City Council introduced Ordinance No. 1552 in the form attached as Attachment 1 for first reading by title only and set the next available Council meeting for second reading and adoption. ORDINANCE NO. 1552 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN REPLACING AND SUPERSEDING ARTICLE 1, CHAPTER 6, PART 2 OF THE TUSTIN CITY CODE REGARDING THE CITY PURCHASING SYSTEM. Fiscal Impact: There was no direct fiscal impact associated with this item. 13. AMENDMENT AND EXTENSION OF EXCLUSIVE NEGOTIATING AGREEMENT WITH THE IRVINE COMPANY LLC FOR PORTIONS OF TUSTIN LEGACY DISPOSITION AREAS 2113, 2C AND 8 Request for approval of an amendment and extension of the Exclusive Negotiating Agreement with The Irvine Company LLC to continue the negotiating period for the disposition and development of portions of Disposition Areas 2B, 2C and 8 at Tustin City Council October 1, 2024 Meeting Minutes Page 8 of 14 Docusign Envelope ID: C5E14E88-9E29-4329-AOE1-877BE86D4AE6 Legacy for a multifamily residential project until March 31, 2025, with one additional 90-day extension at the discretion of the City Manager. Motion: Authorized the City Manager to execute an amendment to the Exclusive Negotiating Agreement with The Irvine Company LLC, approving an extension of the Exclusive Negotiating Agreement until March 31, 2025, with one additional 90-day extension at the discretion of the City Manager subject to non -substantive additions or modifications as may be deemed necessary and/or recommended by the City's special real estate counsel or the City Attorney prior to the end of the Exclusive Negotiating Agreement Negotiating Period. Fiscal Impact: There was no fee associated with the Exclusive Negotiating Agreement amendment or extension. The Irvine Company LLC has a deposit account with the City that will continue to fund the City transaction expenses incurred by staff and third -party consultants including the retention of legal counsel associated with the negotiation and drafting of the Disposition and Development Agreement and related agreements. REGULAR BUSINESS ITEMS (14-16) 14. SALARY RESOLUTIONS FOR UNREPRESENTED EXECUTIVE MANAGEMENT, MANAGEMENT, SUPERVISORY, AND CONFIDENTIAL EMPLOYEES City Attorney David E. Kendig provided the following verbal report: "The Ralph M. Brown Act requires that a verbal summary be provided before final action is taken on salaries, salary schedules, and compensation paid in the form of fringe benefits affecting a local agency executive as defined in State law. Item 14 on the agenda proposes a revision to the Executive Management and Management Salary Resolution. As it relates to local agency executives, the Resolution would increase the base salary of Executive Management positions for purposes of internal and external equity. Specifically, it would increase the base hourly salary ranges to the following amounts, effective the pay period that includes October 1, 2024: Assistant City Manager ($106.66 to $136.60), Director of Community Development ($86.89 to $110.89), Director of Finance ($86.06 to $109.84), Director of Human Resources ($82.80 to $105.67), Director of Parks and Recreation ($82.80 to $105.67), Director of Public Works ($88.37 to $112.79), and Police Chief ($101.47 to $136.60). Effective July 1, 2025 and July 1, 2026, the salary range of each Executive Management classification will be increased by 4%. Public Input — None It was moved by Mayor Pro Tern Gallagher and seconded by Mayor Lumbard to adopt Resolution No. 24-72 and Resolution No. 24-73 to amend the City's Classification and Compensation Plans for unrepresented Executive Management, Management, Supervisory, and Confidential employees. Roll Call Vote — City Clerk Motion carried: 4-0 RESOLUTION NO. 24-72 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, RELATING TO COMPENSATION AND BENEFITS FOR UNREPRESENTED EXECUTIVE MANAGEMENT AND MANAGEMENT EMPLOYEES, AND SUPERSEDING RESOLUTION 24-49 RESOLUTION NO. 24-73 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, RELATING TO COMPENSATION AND BENEFITS FOR UNREPRESENTED SUPERVISORY AND CONFIDENTIAL EMPLOYEES, AND SUPERSEDING RESOLUTION 21-82 Fiscal Impact: The provisions of these Resolutions will result in an additional cost of approximately $321,962 in Fiscal Year 2024-25. By FY 2026-27, the additional ongoing cost to the City is estimated to be $1,371,073 per year. Staff is not requesting any supplemental budget appropriations associated with these Resolutions at this time; any supplemental appropriations will be incorporated with the mid -year budget review, which will be presented to the City Council in February 2025. 15. AUTHORIZING THE TEMPORARY POST -RETIREMENT EMPLOYMENT OF KEN NISHIKAWA Adoption of the attached Resolution will authorize the City to employ Ken Nishikawa on a temporary part-time basis in the retired annuitant position of Deputy Director of Public Works — Engineering sooner than 180 days after his upcoming retirement. Roll Call Vote — City Clerk Motion carried: 4-0 RESOLUTION NO. 24-71 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING THE POST -RETIREMENT EMPLOYMENT OF KEN NISHIKAWA SOONER THAN 180 DAYS AFTER RETIREMENT Fiscal Impact: Authorization of this position will result in a cost of up to approximately $93,000 on an annualized basis. Staff is not requesting any supplemental budget appropriations associated with this action at this time; any supplemental appropriations will be incorporated with the mid -year budget review, which will be presented to the City Council in February 2025. 16. OCTOBER 2024 SUMMARY OF PROJECTS Associate Planner Jorge Maldonado provided a PowerPoint presentation. The report summarizes Community Development Department's programs and activities conducted from January to September 2024. The report highlights activities under the following categories: Current Planning - Industrial, commercial, mixed -use, and residential development and projects under review. Advance Planning - General Plan and code amendments, historic preservation, and Community Development Block Grant activities. Public Input — None The City Council received and filed the report. Schindler Announced staff has been working with Congresswoman Young Kim's office to secure funding in the fiscal year 2025-2026 federal budget for new security cameras for the South City Council October 1, 2024 Meeting Minutes Page 11 of 14 Docusign Envelope ID: C5E14E88-9E29-4329-AOE1-877BE86D4AE6 Hangar, city parks, the Tustin Family and Youth Center, and the Columbus Tustin Recreation Center; staff requested 2.5 million dollars for a security camera project and is on track to be incorporated into the fiscal federal year 2025-2026 appropriation bill at the federal level; the bill should be heard by Congress over the next few months; staff will continue to track the funding and report back to City Council once we have more information to share. COUNCIL MEMBER COMMENTS AND REPORTS Council Member Gomez September 5 Attended the Tustin Senior Advisory Board meeting; reported the following: • On September 14, 2024, the Senior Center held a Resource Fair and Community Flea Market event; the Resource Fair had over 30 vendors including free flu shots, an onsite dental clinic, and information on the medical insurance and assisted/ senior living; the Community Flea Market event was very successful with 33 vendors; and • The Senior Center had an information booth at the Tustin Parks and Recreation Sunset Market event on September 19, 2024; and • The Board annual retreat has been rescheduled for November 7, 2024; and • Amy Nakamoto was appointed as Chair for the Senior Advisory Board; and • The Senior Center received the following maintenance updates during its annual maintenance week; new flooring was installed, carpets were cleaned, shelving was reinforced, and some repainting was accomplished. • Save the date for Friday, March 21, 2025, for a Casino Night event benefiting the Tustin Area Senior Center. Shared she continues to receive positive feedback regarding the Tustin Police Department's Open House; encouraged more community events to engage the public with Tustin's police officers. September 19 • Attended a talk with Mike Madrid, at the University of California, Irvine (UCI), an author and political strategist; discussed the demographics of the current electorate and the upcoming election. • Attended the Orange County Mosquito and Vector Control Board's Policy Personnel Committee meeting; discussed employee negotiations; received reports on vendor vector operations and outreach activities; the October 17, 2024, Board meeting will be canceled due to the California League of Cities Conference. • Attended the City of Tustin's Bench Dedication event for Margaret Pottenger; the family was thrilled with the placement of the bench and the overall event; mentioned many community members Margaret worked with were present and were very thankful the City of Tustin was able to honor her. September 25 Attended the Tustin Unified School District (TUSD) and Tustin Public Schools Foundation's Celebration of Schools event at the Legacy Magnet Academy; reported great news and City Council October 1, 2024 Meeting Minutes Page 12 of 14 Docusign Envelope ID: C5E14E88-9E29-4329-AOE1-877BE86D4AE6 progress by our students in TUSD; Tustin's school board has done a great job of establishing and maintaining programs that provide regular and enrichment programs for the students; reported the graduation rates are outstanding keeping Tustin a great community to raise a family. September 27 Attended Assemblywoman Cottie Petrie -Norris' Hands Only CPR event; there is a great need for more community safety workshops. Council Member Clark September 18 Attended the Newport Bay Watershed Executive Committee meeting; the committee only meets a few times a year. September 24 Attended the Orange County Equity Coalition Book Fair event; read Mommy is the Mayor. September 25 Attended the Tustin Unified School District and Tustin Public Schools Foundation Celebration of Schools event at the Legacy Magnet Academy with my colleagues. September 27 Attended the Orange County Black Chamber's 40t" Anniversary Banquet event at The City National Grove of Anaheim. September 28 Attended NPB Design Studio's She Makes History event at the Tustin Ranch Golf Course; was one of the honorees. Thanked Director of Community Development, Justina Willkom, and Community Development Senior Planner, Erica Demkowicz for hosting a job shadowing opportunity for her daughter through the Girls in Government event, stated her daughter is aspiring to be an architect; was a great opportunity for her to meet the Planning Division and see women in those roles. Thanked Townsend Public Affairs for advocating on the City of Tustin's behalf to Congresswoman Young Kim's office for the 2.5 million dollar security camera project; stated the City Council made the crucial decision to retain the firm several years ago; mentioned the city is seeing the benefits of working with them; was very pleased with their efforts. September 23 Attended the memorial ceremony for Ursula Kennedy; stated Ursula was Tustin's first Mayor; was a mentor to the six women who have served on the City Council in the City of Tustin's history; was inspired to see so many people come out for her; being a politician was a small part of Ursula's life; Ursula was a mom, grandma and held so many other roles; was inspiring to see. City Council October 1, 2024 Meeting Minutes Page 13 of 14 Docusign Envelope ID: C5E14E88-9E29-4329-AOE1-877BE86D4AE6 Mayor Pro Tem Gallagher Attended a couple of Orange County Sanitation District (OC San) meetings; reported the District approved a Supercritical Water Oxidation unit project; stated this piece of equipment could change the whole industry; the project brings benefits to the environment including destroying per -and polyfluoroalkyl substances (PFAS), microplastics, biosolids, and reduces truck trips having more energy efficient disposal with less carbon emissions driving to Arizona; the project could be energy neutral or even energy positive; OC San has taken a leadership role by bringing this project to Orange County and plans to have it running by the first quarter of next year; Orange County will be the second in the nation to have this technology; is very excited to see Orange County take a leadership role; the project is both environmental and tax -friendly; visited one of the operating supercritical water oxidation units on September 29, 2024. September 19 • Attended the City of Tustin's Bench Dedication event for Margaret Pottenger; appreciated the opportunity to be a part of a touching event. • Attended the Tustin Parks and Recreation Sunset Market event; was the last of the first of its kind; was excited to see the community respond positively to the event; thanked city staff for turning the event into something special for the community. Announced will be attending the Tustin Police Department's Walk to School Day event on October 2, 2024; is looking forward to the event. Mayor Lumbard Attended the City of Tustin's Bench Dedication event for Margaret Pottenger; thanked City Clerk, Erica Yasuda, Communications Manager, Stephanie Najera, Management Analyst II, Carrie Woodward, and the City Clerk's Office staff for putting on a nice event; the event underscored what a wonderful woman Margaret was and how special Old Town is; was a beautiful setting that showcased how special Tustin's historical town is; the City of Tustin has some excitement coming with the Old Town projects and Sunset Market events; Old Town is very unique and the City of Tustin is shining a light on it; thanked city staff for giving the community a venue for the remembrance of Margaret Pottenger.
