HomeMy WebLinkAboutCC RES 96-1231 RESOLUTION NO. 96-123 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 3 TUSTIN, FINDING THAT FINAL ENVIRONMENTAL IMPACT REPORT (EIR) FOR THE EAST TUSTIN SPECIFIC PLAN 4 (FINAL EIR 85-2, AS MODIFIED BY SUBSEQUENTLY ADOPTED SUPPLEMENTS AND ADDENDA) IS ADEQUATE TO 5 SERVE AS THE PROGRAM EIR FOR TENTATIVE TRACT MAP 15350 AND ALL FEASIBLE MITIGATION MEASURES HAVE 6 BEEN INCORPORATED AS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. 7 8 The City Council of the City of Tustin does hereby resolve as follows: 9 I. The City Council finds and determines as follows: 10 A. That Tentative Tract Map 15350 and respective 11 development plans are considered "projects" pursuant to the terms of the California 12 Environmental Quality Act; and 13 B. That the projects are covered by a previously certified Final Environmental Impact Report 85-2, 14 as amended, for the East Tustin Specific Plan which serves as a Program EIR for the proposed project. 15 II. The East Tustin Specific Plan Final Environmental Impact 16 Report (85-2), previously certified on March 17, 1986, as modified by subsequently adopted supplements and addenda, 17 was considered-prior to approval of this project. The City Council hereby finds: this project is within the 18 scope of the East Tustin Specific Plan previously approved; the effects of this project, relating to 19 grading, drainage, circulation, public services and utilities, were examined in the Program EIR. All 20 feasible mitigation measures and alternatives developed in the Program EIR are incorporated into this project. 21 The Final EIR is, therefore., determined to be adequate to serve as a Program EIR for this project and satisfies all 22 .requirements of the California Environmental Quality Act. Further, the Planning Commission finds the project 23 involves no potential for any adverse effect, either individually or cumulatively, onwildlife resources; and, 24 therefore, makes a De Minimis Impact Finding related to AB 3158, Chapter 1706, Statutes of 1990. 25 Applicable mitigation measures identified in the Final 26 EIR have been incorporated into this project which mitigates any potential significant environmental effects 27 thereof., The mitigation measures are identified as Conditions on Exhibit A of Planning Commission Resolution 28 No. 3482 recommending approval of Tentative Tract 15350 Resolution No.. 96-123 Page 2 1 2 and Exhibit A'of Planning Commission Resolution No. 3484 3 approving Design Review 96-038. 4 PASSED AND ADOPTED by the City Council of the City of Tustin, 5 at a regular meeting on the 18th day of November 1996. 6 7 8 Mayor 9 P ' ~.ILA' ~'T%KER 11 City Clerk 12 STATE OF CALIFORNIA ) COUNTY .OF ORANGE ) 13 CITY OF TUSTIN ) 14 I, Pamela Stoker, City Clerk and ex-officio Clerk of the City 15 Council of the City of Tustin, California, do hereby certify that the whole number of the members of the City Council of 16 the City of Tustin is five; that the above and foregoing Resolution No. 96-123 was duly passed and adopted at a regular 17 meeting of the Tustin City Council, held on the 18th day of November, 1996, by the following vote: 18 COUNCILMEMBER AYES: WORLEY, THOMAS, DOYLE, SALTARELLI 19 COUNCILMEMBER NOES .- NONE COUNCILMEMBER ABSTAINED: NONE 20 COUNCILMEMBER ABSENT: POTTS 21 22 PAMELA STOKER City Clerk 23 24 25 26 27 28
