SCHINDLER, CITY MANAGER FROM: DAVID KENDIG, CITY ATTORNEY SUBJECT: FIRST READING OF ORDINANCE REVISING THE START TIME OF REGULAR MEETINGS OF THE CITY COUNCIL AND PLANNING COMMISSION SUMMARY At the Mayor's request, the City Council is requested to consider adopting the attached Ordinance No. 1548 to revise the Tustin City Code to change the starting time of the Council's regular meetings to 4:30 p.m. for closed sessions during regular meetings and 6:00 p.m. for open session regular meetings, and to revise the start time for the Planning Commission's regular meetings to 6:00 p.m. Under the schedule in the proposed ordinance, the City Council's meetings would still be scheduled on the first and third Tuesdays of each month, and the Planning Commission's meetings would occur on the second and fourth Tuesday of each month. RECOMMENDATION It is recommended that the City Council: 1. Introduce and approve first reading by title only of Ordinance No. 1548 replacing and superseding Tustin City Code section 1301 regarding regular meetings of the City Council, and Tustin City Code section 1515 regarding regular meetings of the Planning Commission; and 2. Schedule adoption of Ordinance No. 1548 at the City Council's Regular Meeting on December 3, 2024. FISCAL IMPACT No direct fiscal impact is anticipated to occur by revising the start time of regular meetings. STRATEGIC PLAN Starting the open session meetings of regular meetings an hour earlier will enhance public participation by helping to ensure that meetings end at an earlier hour in the evening, advancing Goal E of the City's Strategic Plan ("Organization Excellence and Docusign Envelope ID: 986AA054-0725-4395-8229-B3E25F62944C City Council Agenda Report November 19, 2024 Revising the Start Time of Regular Meetings of the Council and Planning Commission Page 2 Customer Service") to be a high performance organization with effective customer service provided by a professional workforce. BACKGROUND AND DISCUSSION Tustin City Code section 1301 establishes the start time of the regular meetings of the City Council, and City Code section 1515 establishes the regular meeting schedule for the Planning Commission. The current schedule and the revised schedule for regular meetings proposed by Ordinance 1548 are as follows: Existing Proposed Start Time: Start Time: City Council (1 st & 3rd Tuesdays of each month) Closed sessions: 5:30 p.m. 4:30 p.m. Open Sessions: 7:00 p.m. 6:00 p.m. Planning Commission 7:00 p.m. 6:00 p.m. (2nd & 4t" Tuesday of each month). In addition, the proposed ordinance would provide that an alternative time or location for one or more regular meetings, or for one or more closed sessions, may be approved by a City Council Resolution, provided the Resolution is approved at least seven (7) calendar days prior to the rescheduled meeting date. Similarly, an alternative time or location for one or more regular meetings of the Planning Commission could be approved by a Planning Commission Resolution, provided that Resolution is approved at least seven (7) calendar days prior to the meeting date. The location of all regular meetings would continue to be at the Tustin's City Council Chambers. If the proposed Ordinance is adopted at the December 3, 2024, City Council meeting, the Ordinance would take effect on January 2, 2024. As a result, the first City Council meeting that would begin at the proposed new times would be on January 7, 2025, and the first Planning Commission to begin under the proposed start time would be on January 14, 2025. Docusign Envelope ID: 986AA054-0725-4395-8229-B3E25F62944C ORDINANCE NO. 1548 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN REPLACING AND SUPERSEDING TUSTIN CITY CODE SECTION 1301 REGARDING REGULAR MEETINGS OF THE CITY COUNCIL, AND TUSTIN CITY CODE SECTION 1515 REGARDING REGULAR MEETINGS OF THE PLANNING COMMISSION THE CITY COUNCIL OF THE CITY OF TUSTIN DOES ORDAIN AS FOLLOWS: SECTION I: Section 1301 of Chapter 3 of Article 1 of the Tustin City Code is replaced and superseded in its entirety to read as follows: 1301 - REGULAR MEETINGS OF THE CITY COUNCIL A. Regular meetings of the City Council shall be held on the first and third Tuesdays of each calendar month at 6:00 p.m. in the Council Chambers, Tustin City Hall, 300 Centennial Way, Tustin, California. Closed sessions of the regular meetings shall convene at 4:30 on the same days and at the same location. An alternative time or location for one or more regular meetings, and/or for one or more closed sessions, may be approved by City Council Resolution approved at least seven (7) calendar days prior to the meeting date. When the regular meeting date falls on a legal holiday, the meeting shall be held on the following day that is not a legal holiday. B. If necessary, closed sessions not completed prior to the open session portion of a regular meeting will be considered at the conclusion of the open session portion of the meeting, or as otherwise determined by the City Council. C. Nothing in this section limits the authority of the City or the Council to schedule a special meeting, an adjourned regular meeting, a continued regular meeting, or an emergency meeting in accordance with the Ralph M. Brown Act. SECTION II: Section 1515 of Chapter 5 of Article 1 of the Tustin City Code is replaced and superseded in its entirety to read as follows: 1515 - REGULAR MEETINGS OF THE PLANNING COMMISSION A. The Planning Commission shall hold its regular meetings on the second and fourth Tuesdays of each month at 6:00 p.m. in the Council Chambers, Tustin City Hall, 300 Centennial Way, Tustin, California. An alternative time or location for one or more regular meetings may be approved by Planning Commission Resolution approved at least seven (7) calendar days prior to the meeting date. Nothing in this section limits the authority of the City or the Planning Commission to schedule a special meeting, an adjourned regular meeting, a continued regular meeting, or an emergency meeting in accordance with the Ralph M. Brown Act. SECTION III: If any section, subsection, subdivision, sentence, clause, phrase, word, or portion of this Ordinance is, for any reason, held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have adopted this Ordinance and each section, subsection, subdivision, sentence, clause, phrase, word, or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, words or portions thereof be declared invalid or unconstitutional. SECTION IV: The Mayor shall sign and the City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same, or the summary thereof, to be published and posted pursuant to the provisions of law and this Ordinance shall take effect thirty (30) days after adoption.
