Austin; Woodward, Carrie; Gallagher, Ryan Cc: Shelly Madison Subject: Opposition to Housing Element Rezone Project (December 17, 2024 City Council Meeting) Date: Wednesday, December 11, 2024 1:36:49 PM Greetings to the City Council of the City of Tustin: I am writing to express my strong opposition to the proposed Housing Element Rezone Project, specifically concerning the rezoning of sites within the Tustin Legacy Specific Plan (TLSP) area. While I understand the need to address housing requirements, this project raises serious concerns regarding the City's historical mismanagement of high -density housing projects and the potential negative impacts on existing homeowners. Lack of Adequate Planning and Resources The City of Tustin has repeatedly demonstrated an inability to ensure adequate resources and infrastructure to support increased high -density housing. Previous projects have been approved without sufficient consideration for parking, essential services, job opportunities, and community resources. Despite years of demanding a simple sidewalk along Edinger Avenue, the City has refused to implement such a basic piece of infrastructure in clear disregard of residents, businesses, and persons whom are disabled and/or socioeconomically disadvantaged. Instead the City previously indicated it would erect a sign prohibiting pedestrian access but failed to do so. This pattern of inadequate planning has resulted in overburdened infrastructure, diminished quality of life for residents, and a strain on existing resources. Negative Impacts on Property Values and Homeowner Rights The proposed rezoning threatens to significantly decrease property values for homeowners in nearby communities. These individuals invested in their properties based on existing plans and zoning regulations. By drastically altering the TLSP, the City is effectively undermining the trust and reliance homeowners placed in the City's planning process. This constitutes a form of regulatory taking, as homeowners are being deprived of the value and expectations associated with their properties. Further, as evidenced by the City's approved of yet another car wash on Edinger Avenue, the City disregards the financial planning of businesses and residents alike thus increasing the toll on public infrastructure while frustrating the business prospects of existing businesses and residents. Specific Concerns Regarding the TLSP Rezoning The proposed increase of 2,211 dwelling units within the TLSP area is excessive and lacks proper justification. The City has not provided adequate evidence demonstrating that existing infrastructure and resources can accommodate such a substantial increase in population density. Furthermore, the rezoning poses significant risks to traffic congestion, environmental strain, and the overall character of the community. Call for Responsible Development and Community Input I urge the City Council to reconsider this rezoning project and prioritize responsible development that respects the rights of existing homeowners and ensures the long-term well- being of the entire community. It is essential that the City conduct a thorough and transparent assessment of the project's potential impacts, engage in meaningful dialogue with residents, and prioritize the needs and concerns of all stakeholders. Simply papering jargon filled notices I respectfully request that the City Council reject the proposed Housing Element Rezone Project and instead pursue alternative solutions that address housing needs while preserving the integrity of our community and protecting the rights of existing homeowners. Simply building high -density projects without regard for the impact of the same simply because flawed state laws have provided an avenue for doing so it irresponsible and detrimental to the City.
