It was moved by Council Member Gallagher and seconded by Mayor Pro Tem Nielsen to pull Item No. 4 and approve the balance of the consent calendar. Roll Call Vote — City Clerk Motion carried: 5-0 1. WAIVE READING IN FULL OF ALL ORDINANCES AND RESOLUTIONS ON THE AGENDA Motion: The City Council waived reading in full of all ordinances and resolutions on the agenda and declared that said titles which appear on the public agenda shall be determined to have been read by title and further reading waived. 2. APPROVAL OF MINUTES — THE REGULAR MEETINGS OF THE CITY COUNCIL HELD ON DECEMBER 3, 2024, AND DECEMBER 17, 2024. Motion: The City Council approved the Action Minutes of the City Council Meeting held on December 3, 2024, and December 17, 2024. 3. RATIFICATION OF PAYROLL AND DEMANDS The City Council has approved the use of Government Code Section 37208 to expedite the payment of City of Tustin obligations that are in accordance with the approved budget or continued operations authorizations. Motion: The City Council approved Payroll in the amount of $1,110,636.15 and $1,053,856.78 and Demands in the amount of $6,906,736.19. 4. SECOND READING AND ADOPTION OF ORDINANCE NOS. 1547, 1549, 1550, AND 1551 — HOUSING ELEMENT REZONE IMPLEMENTING PROGRAMS 1.1A, 11.113, 1.1 F, AND 1.1 G OF THE 6TH CYCLE 2021-2029 HOUSING ELEMENT OF THE GENERAL PLAN Mayor Lumbard recused himself due to owning real property within 500 feet of areas involved in the proposed Legacy Specific Plan amendment. Mayor Lumbard left the dais. Adoption of Ordinance No. 1547 (Specific Plan Amendment 2024-0002) allows for additional high density residential development on three sites in the Tustin Legacy Specific Plan, Housing Element Sites 1 a, 1 b, and 2, with a minimum density of 20 units per acre (du/acre) on the selected sites. City Council January 7, 2025 Meeting Minutes Page 2 of 8 Docusign Envelope ID: 12D90EE8-89E9-4FBC-BC1E-OC15ACE15502 Adoption of Ordinance No. 1549 (Code Amendment 2024-0003) establishes a Housing Overlay district (overlay zone) in conjunction with the planned community commercial district (base zone) to implement the housing implementation program of the 6th Cycle 2021-2029 housing element of the general plan. Adoption of Ordinance No. 1550 (Zoning Code 2024-0001) amends the City's zoning map to apply the Housing Overlay district to the Enderle Center Rezone Project area. Adoption of Ordinance No. 1551 (Specific Plan Amendment 2024-0001) accommodates residential development on 18 acres of The Market Place Rezone Project site and creates a new high density residential land use category to implement the Housing Implementation Program of the 6th Cycle Housing Element of the General Plan. It was moved by Council Member Schnell and seconded by Council Member Gallagher to have second reading by title only and adoption of Ordinance Nos. 1547, 1549, 1550 and 1551. Council Member Fink requested that the Council consider Ordinance No. 1550 separately. It was moved by Council Member Fink and seconded by Council Member Gallagher to have second reading by title only and adoption of Ordinance Nos. 1547, 1549 and 1551. Roll Call Vote — City Clerk Motion carried: 4-0 It was moved by Council Member Gallagher and seconded by Council Member Schnell to have second reading by title only and adoption of Ordinance No. 1550. Council Member Fink proposed a substitute motion and submitted an amended Resolution for Council's consideration. City Attorney David E. Kendig advised that the motion be amended to propose that Council agendize the amended resolution for Council's consideration at the next regular meeting. The City Council has appropriated funds to carry out the Housing Element Rezone Project. 5. REJECTION OF ALL BIDS FOR THE OLD TOWN IMPROVEMENTS PROJECT Staff is recommending that the City Council reject both bids received on November 5, 2024, for the Old Town Improvements Project. The City received only two bids for this project, both higher than the engineer's estimate, with the lowest being approximately 24% over the engineer's estimate. Motion: The City Council rejected the two bids received for the Old Town Improvements Project, Capital Improvement Program Number 70254 and directed the City Clerk to return all bid bonds. The project is funded through a combination of Community Development Block Grant Fund (Fund 120) and Land Sale Proceeds funds (Fund 189). 6. REAFFIRM THE CITY MANAGER AND/OR HOUSING AUTHORITY EXECUTIVE DIRECTOR'S AUTHORITY TO EXECUTE AFFORDABLE HOUSING DOCUMENTS The Tustin Housing Authority is seeking to reaffirm the authority of the City Manager and/or Housing Authority Executive Director to execute affordable housing documents required for the refinancing or the sale of new or existing affordable housing units. Motion: The Tustin Housina Authoritv Commissioners: Adopted Tustin Housing Authority Resolution No. 25-01 authorizing the Executive Director of the Tustin Housing Authority and/or City Manager, or their designee, to execute affordable housing documents required for the refinancing or the sale of affordable housing units. Schindler Announced the United States Congress resumed its session last week, while the California legislature reconvened yesterday; stated city staff will continue to monitor legislative activity for the 2025-2026 sessions; mentioned staff will put together a draft project list for state and federal earmarks and the legislative platform for discussion with the City Council in the coming weeks. Announced Mariam Madjlessi, Community Development Building Official, was elected as the 2025 International Code Council Orange County and Inland Empire Chapter President; stated the election is a significant achievement for Tustin, showcasing Tustin's leadership in building activities and expanding Tustin's network. Welcomed the new Deputy City Manager of Real Property, specifically Tustin Legacy, Brian Moncrief; mentioned looks forward to Brian's integration into the team. City Attorney David E. Kendig Reported the Closed Session Meeting of the City Council had been cancelled. MAYOR, MAYOR PRO TEM AND COUNCIL MEMBER COMMENTS AND REPORTS Council Member Fink December 29 Attended the Menorah Lighting and Hanukkah Celebration. Announced Sam Robertson of Arvida Book Company was listed as one of Orange County Register's 125 Most Influential People in Orange County for 2024; congratulated Sam Robertson and Arvida Book Company. Reported Orange County Rustic Furniture is having a closing sale and may be moving; mentioned spoke with the owner and he is hoping a new lease is worked out with the landlord. Announced will be attending the upcoming events: • The Rotary Club of Tustin - Santa Ana Recognition event honoring Carl Greenwood and David Smith on January 11, 2025, at 6:00 PM at the Elks Lodge in Santa Ana; encouraged everyone to attend; mentioned served with Carl Greenwood on the Family Promise of Orange County Board. • Tustin Community Foundation and Aldersgate Church, A Day of Service and Hope in Honor of Dr. Martin Luther King Jr. on January 20, 2025, at Aldersgate Church. Announced the Community Wellness Gathering and Mental Health Fair on January 25, 2025, from 1:00 PM to 4:00 PM at the Clifton C. Miller Community Center organized by Jen Kohlenberger, Executive Director of the Miss Tustin Foundation: stated the event is aimed to promote resilience and mental health awareness; reported the event will feature resources from groups including Turning Point Center for Families and Wound Walk Orange County; is hoping for participation from CalOptima Orange County and the Orange County Health Care Agency; encouraged community support for this grassroots effort to foster wellness and connection in Tustin; hoping this event provides resources for families in need, and to take the stigma out of mental health.
