SUBJECT: RESOLUTION ESTABLISHING A POLICY REQUIRING CITY
COUNCIL CONSIDERATION AND APPROVAL OF FUTURE
COMPETITIVE OFFERINGS FOR THE DISPOSITION OF CITY -
OWNED REAL PROPERTY
SUMMARY:
Resolution 25-10 will establish a policy requiring City Council consideration and approval
of future competitive offerings for the disposition of City -owned real property.
RECOMMENDATION:
It is recommended that the City Council take the following action:
1. Adopt Resolution 25-10: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, ESTABLISHING A POLICY REQUIRING CITY COUNCIL
CONSIDERATION AND APPROVAL OF FUTURE COMPETITIVE OFFERINGS FOR
THE DISPOSITION OF CITY -OWNED REAL PROPERTY.
FISCAL IMPACT:
There is no fiscal impact associated with this item.
CORRELATION TO THE STRATEGIC PLAN:
Adoption of Resolution 25-10 enhances City Council and public participation in fulfillment
of the City's Strategic Plan Goal A: Economic and Neighborhood Development.
BACKGROUND AND DISCUSSION:
The City of Tustin (City) owns certain real property throughout the City that may be
considered for disposition through a competitive offering process to support various
economic development, housing, infrastructure and fiscal sustainability related goals and
objectives. To that end, the City Council desires to provide advance input on key elements
of competitive City -owned real property offerings including but not limited to location, size,

land use, product types, density and compliance with the State of California Surplus Land
Act and/or other applicable legal requirements.
Resolution 25-10 would establish a policy requiring City Council consideration and approval
prior to the release of any future competitive offerings for the disposition of City -owned real
property ("Policy"). The objective of this Policy is to provide the City Council with the
opportunity to review and provide advance input, confirm alignment with City goals, policies,
and community priorities, and promote transparency, public participation, and accountability.
The proposed Policy would become effective on the date of approval of this Resolution and
would not apply to negotiations that are currently underway, nor does it preclude the City
from considering unsolicited offers, from approving licenses for the use of City -owned real
property, from renewing existing leases or licenses in accordance with those agreements.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, ESTABLISHING A POLICY REQUIRING
CITY COUNCIL CONSIDERATION AND APPROVAL OF FUTURE
COMPETITIVE OFFERINGS FOR THE DISPOSITION OF CITY -
OWNED REAL PROPERTY.
WHEREAS, the City of Tustin (City) owns certain real property that may be considered for
disposition through a competitive offering process to support various economic development,
housing, infrastructure and fiscal sustainability related goals and objectives; and
WHEREAS, the City Council desires to provide advance input on key elements of
competitive City -owned real property offerings including but not limited to location, size, land use,
product types, density and compliance with the State of California Surplus Land Act and/or other
applicable legal requirements; and
WHEREAS, the City Council seeks to formalize a policy to ensure that City Council
approval is secured prior to the release of any competitive offering for the disposition of City -
owned real property; and
WHEREAS, the objective of this policy is to also provide the City Council with the
opportunity to review and provide advance input, confirm alignment with City goals, policies, and
community priorities, and promote transparency, public participation, and accountability.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
TUSTIN, THAT:
1. The foregoing recitals are hereby incorporated and adopted as the findings of the City
Council; and
2. Effective on the date of approval of this Resolution, the City Council shall consider and
approve the release of any future competitive offerings for the disposition of City -owned
real property; and
3. This policy would not apply to negotiations that are currently underway, nor does it
preclude the City from considering unsolicited offers, from approving licenses for the use
of City -owned real property, or from renewing existing leases or licenses in accordance
with those agreements; and
4. The consideration of and on what terms to release a competitive offering does not
commit the City to authorize or advance the disposition of a City -owned real property,
will not result in a direct or indirect physical change to the environment, and does not
constitute an "approval" of a "project' pursuant to CEQA Guidelines Sections 15004 and
15352.
PASSED and ADOPTED by the City Council of the City of Tustin at a regular meeting on
the 411 day of February, 2025.
