Brief Summary of Narrative of BACKGROUND
the Item's Intent:
Under the Tustin City Code, registration of bicycles is required
pursuant to Section 5400, et seq., adopted February 5, 1979. (TCC, §
5401.) Pursuant to the Tustin City Code, the Tustin Police Department
is the bicycle registration agency (TCC, § 5400) is required to issue
an ownership card and a bicycle registration plate (TCC, § 5402,
subd. (a)) and maintain a database of registered bicycles (id., §
5402, subd. (b)). Violation of the bicycle registration requirements is
a misdemeanor. (TCC, § 5410.)
Maintaining the bicycle registration service and associated
databases creates an unnecessary burden on the TPD. As a result,
TPD not typically refers potential registrants to a publicly -domain
bicycle registration service maintained by a not -for -profit
organization. (Currently, 529 Garage.)
Additionally, while bicycle registration is intended to be a service for
bicycle owners who have lost or stolen bicycles, enforcement of the
registration requirement through a misdemeanor is unusual and
unnecessarily punitive.
PROPOSAL
The City Council Amend the Tustin City Code to:
1. Bicycle Registration
a. Repeal the requirement of bicycle registration for bicycles garaged
in the City of Tustin; or
b. Amend the requirement for bicycle registration for bicycles
narant-d in the City of Tustin to registration through a not -for -profit

organization.
2. Encourage the registration of bicycles through a public -domain,
not -for -profit organization.

3. Repeal the fees associated with bicycle registration.
4. Repeal the requirements that bicycles bear bicycle registration
plates (TCC, § 5401), that owners endorse any change of ownership
on a registration card upon sale or transfer (id., § 5403
5. Reduce the punishment to any such violation to an infraction (TCC,
§ 5410).
6. Amend any additional provisions of the Chapter consistent with
the best practices for law enforcement and public safety.
7. Renumber the Chapter appropriately.
CONCLUSION
Please place the aforementioned request on the next City Council
Agenda under "Matters which Council Members have asked to be
placed on a Future Agenda."
