CONSENT CALENDAR ITEMS 1-10 Public Input for the Consent Calendar — 1. Marie Luebbers (Item 5 - Zoom) Mayor Lumbard noted for the record that the City Council received two written comments for Item No. 5 which have been distributed to the Council and made available to the public on the City's website. Mayor Lumbard pulled Item 9, Member Schnell requested to pull Item No. 8, and Council Member Fink requested to pull Item No. 5. It was moved by Council Member Schnell and seconded by Mayor Pro Tern Nielsen to pull Item Nos. 5, 8, and 9 and approve the balance as recommended by staff. WAIVE READING IN FULL OF ALL ORDINANCES AND RESOLUTIONS ON THE AGENDA Motion: The City Council waived reading in full of all ordinances and resolutions on the agenda and declared that said titles which appear on the public agenda shall be determined to have been read by title and further reading waived. 2. APPROVAL OF MINUTES — THE REGULAR MEETING OF THE CITY COUNCIL HELD ON APRIL 1, 2025. Motion: The City Council approved the Action Minutes of the City Council Meeting held on April 1, 2025. 3. RATIFICATION OF PAYROLL AND DEMANDS City Council April 15, 2025 Meeting Minutes Page 3 of 12 Docusign Envelope ID: 0F687690-B0ED-490D-87F2-E425D11860FF The City Council has approved the use of Government Code Section 37208 to expedite the payment of City of Tustin obligations that are in accordance with the approved budget or continued operations authorizations. Motion: The City Council approved Payroll in the amount of $1,015,171.46 and Demands in the amount of $7,653,265.73. 4. SECOND READING AND ADOPTION OF ORDINANCE NO. 1562 — CODE AMENDMENT 2024-0007: RESIDENTIAL OBJECTIVE DESIGN STANDARDS Adoption of Ordinance No. 1562 amends sections of Article 9 (Land Use) Chapter 2 (Zoning) of the Tustin City Code establishing Residential Objective Design Standards. The creation and adoption of Objective Design Standards implements Program 1.2a of the Housing Element Implementation Program and aligns with recent State laws that require cities to approve certain affordable housing projects without discretionary review. Objective Design Standards also provide housing projects an opportunity for a streamlined review process. Motion: The City Council had second reading by title only and adoption of Ordinance No. 1562. ORDINANCE NO. 1562 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING VARIOUS SECTIONS OF TUSTIN CITY CODE ARTICLE NINE (LAND USE) CHAPTER 2 (ZONING) TO ESTABLISH THE OBJECTIVE DESIGN STANDARDS FOR MULTIFAMILY AND MIXED -USE RESIDENTIAL PROJECTS (CODE AMENDMENT (CA) 2024-0007) Fiscal Impact: There was no fiscal impact associated with this item. 5. SECOND READING AND ADOPTION OF ORDINANCE NO. 1564 — FIRST AMENDMENT TO DEVELOPMENT AGREEMENT 2022-0002 (THE JESSUP AT 17802 — 17842 IRVINE BOULEVARD) Adoption of Ordinance No. 1564 approves the first amendment to Development Agreement 2022-0002, an agreement between the City of Tustin and Tustin 40 Development LLC for "The Jessup" residential project. The amendment eliminates the owner's requirement to pay the Voluntary Workforce Housing Incentive Program In -Lieu Fee. It was moved by Mayor Lumbard and seconded by Council Member Gallagher to have second reading by title only and adoption of Ordinance No. 1564. Roll Call Vote — City Clerk Motion carried: 4-1 (Council Member Fink dissented) ORDINANCE NO. 1564 City Council April 15, 2025 Meeting Minutes Page 4 of 12 Docusign Envelope ID: 0F687690-B0ED-490D-87F2-E425D11860FF AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, APPROVING FIRST AMENDMENT TO DEVELOPMENT AGREEMENT (DA) 2022-0002, TO ELIMINATE OWNER'S REQUIREMENT TO PAY FOR THE VOLUNTARY WORKFORCE HOUSING INCENTIVE PROGRAM IN -LIEU FEE FOR THE "THE JESSUP" RESIDENTIAL PROJECT LOCATED AT 17802 AND 17842 IRVINE BOULEVARD. Fiscal Impact: There is no fiscal impact to the General Fund associated with this item. The removal of the In -Lieu Fee will reduce anticipated contributions to the City's Housing Fund by approximately $289,560; however, the reduction is consistent with the Council's action to temporarily waive the In -Lieu fee where it applies elsewhere, pursuant to the Municipal Code, which includes properties within the Downtown Commercial Core Specific Plan and Red Hill Avenue Specific Plan. 6. AWARD CONSTRUCTION CONTRACT FOR THE ANNUAL ROADWAY REHABILITATION AND SIDEWALK REPAIR PROJECT Staff is requesting the City Council award a construction contract to the lowest responsive/responsible bidder for the Annual Roadway Rehabilitation and Sidewalk Repair Project— Zone 6 and approve a Cooperative Agreement with the City of Irvine. Motion: The City Council: 1. Awarded a construction contract to the lowest responsive/responsible bidder, All American Asphalt in the amount of $2,464,122 for the Annual Roadway Rehabilitation and Sidewalk Repair Project — Zone 6 and authorized the Mayor and the City Clerk to execute the contract documents on behalf of the City; 2. Approved Cooperative Agreement with the City of Irvine for work on Myford Road within the City of Irvine's jurisdiction and authorized the Director of Public Works, and City Clerk to execute the agreement on behalf of the City; and 3. Appropriated $554,009 from the Gas Tax Fund (Fund 130), $1,800,000 from Measure M2 Fair Share (Fund 139) and $406,513 from General Fund CIP (Fund 200). Fiscal Impact: The Fiscal Year 2024-25 budget has $385,000 allocated from Measure M2 Fair Share (Fund 139), which funds the annual design, traffic striping, and the biennial update to the Pavement Management Plan, including the pavement condition survey. Construction funding was earmarked within the Fiscal Year 2025- 26 budget and staff is requesting an appropriation of $2,354,009 be moved into the Fiscal Year 2024-25 budget with an additional $406,513 of General Fund CIP (Fund 200) which will be reimbursed per the Cooperative Agreement at the completion of construction by the City of Irvine. APPROVE PLANS AND SPECIFICATIONS AND AUTHORIZE ADVERTISEMENT FOR BIDS FOR THE EL CAMINO REAL WATER MAIN RELOCATION PROJECT The plans and specifications for the El Camino Real Water Main Relocation Project have been prepared and the project is now ready for bid. Motion: The City Council adopted Resolution No. 25-27 approving plans and specifications for the El Camino Real Water Main Relocation Project and authorized the City Clerk to advertise to receive bids. RESOLUTION NO. 25-27 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA APPROVING PLANS AND SPECIFICATIONS FOR THE EL CAMINO REAL WATER MAIN RELOCATION PROJECT, CIP NO. 60178 AND AUTHORIZING ADVERTISEMENT FOR BIDS Fiscal Impact: Utility Agreement COT-56 between the City of Tustin and the Orange County Transportation Authority authorizes the full reimbursement for final design and construction costs, minus an accrued depreciation credit of $2,650. A total of $540,000 was budgeted for the design and construction of this project. The estimated total costs for this project are $665,326. If necessary, additional funds will be requested after bids are received and during consideration of the contract award. 8. APPROVE PLANS AND SPECIFICATIONS AND AUTHORIZE ADVERTISEMENT FOR BIDS FOR TUSTIN SPORTS PARK TURF RENOVATION FIELD #3 (CIP No. 20093) The plans and specifications for the Tustin Sports Park Turf Renovation Field #3, Capital Improvement Project No. 20093, have been prepared and the project is now ready to bid. It was moved by Council Member Schnell and seconded by Mayor Lumbard that the City Council adopt Resolution No. 25-18, approving the plans and specifications for the Tustin Sports Park Turf Renovation Field #3 (CIP No. 20093) and authorize the City Clerk to advertise to receive bids. Roll Call Vote — City Clerk Motion carried: 5-0 RESOLUTION NO. 25-18 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, City Council April 15, 2025 Meeting Minutes Page 6 of 12 Docusign Envelope ID: 0F687690-B0ED-490D-87F2-E425D11860FF APPROVING PLANS AND SPECIFICATIONS FOR THE TUSTIN SPORTS PARK TURF RENOVATION FIELD #3 PROJECT, CIP NO. 20093 AND AUTHORIZING ADVERTISEMENT FOR BIDS Fiscal Impact: The engineer's estimate for Capital Improvement Plan No. 20093 is $650,000. The project is funded with Park Development dollars as part of the 2024- 2025 Capital Improvement Program. 9. CITY COUNCIL CONSIDERATION AND APPROVAL TO RELEASE A COMPETITIVE OFFERING FOR APPROXIMATELY 61 ACRES OF CITY -OWNED REAL PROPERTY WITHIN NEIGHBORHOOD G (PLANNING AREAS 15-A AND 15-C) OF THE TUSTIN LEGACY SPECIFIC PLAN Mayor Lumbard and Council Member Gallagher recused themselves due to a conflict in real property interest and left the dais. Staff is requesting City Council consideration and approval to release a competitive offering for approximately 61 acres of City -owned real property within Neighborhood G (Planning Areas 15-A and 15-C) of the Tustin Legacy Specific Plan pursuant to the procedures recently approved by the City Council in Resolution 25-10. It was moved by Council Member Schnell and seconded by Mayor Pro Tern Nielsen that the City Council take the following actions: 1. Authorize staff to release a competitive offering for approximately 61 acres of City owned real property within Neighborhood G (Planning Areas 15-A and 15-C) of the Tustin Legacy Specific Plan pursuant to the procedures recently approved by the City Council in Resolution 25-10; and 2. Authorize the City Manager to continue and/or enter into temporary leases and licenses prior to final disposition. Roll Call Vote — City Clerk Motion carried: 3-0-2 (Mayor Lumbard and Council Member Gallagher recused) Mayor Lumbard and Council Member Gallagher returned to the dais. Fiscal Impact: There was no fiscal impact associated with this item. 10. MEMORANDA OF UNDERSTANDING WITH THE TUSTIN POLICE OFFICERS ASSOCIATION — POLICE OFFICER REPRESENTATION UNIT AND THE TUSTIN POLICE OFFICERS ASSOCIATION — POLICE MANAGEMENT REPRESENTATION UNIT Adoption of the attached Resolutions and Memoranda of Understanding will authorize terms and conditions of employment for employees in classifications represented by the Tustin Police Officers Association — Police Officer Representation City Council April 15, 2025 Meeting Minutes Page 7 of 12 Docusign Envelope ID: 0F687690-B0ED-490D-87F2-E425D11860FF Unit (TPOA) and the Tustin Police Officers Association — Police Management Representation Unit (TPMA) in accordance with City Council direction. Motion: Adopted Resolutions No. 25-29 and No. 25-30 to amend the City's Classification and Compensation Plans, approved a Memorandum of Understanding with TPOA for the period July 1, 2025 through June 30, 2028, and approved a Memorandum of Understanding with TPMA for the period July 1, 2025 through June 30, 2028. RESOLUTION NO. 25-29 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING THE CLASSIFICATION AND COMPENSATION PLANS FOR THE CITY OF TUSTIN AND APPROVING THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF TUSTIN AND THE TUSTIN POLICE OFFICERS ASSOCIATION — POLICE OFFICER REPRESENTATION UNIT, CONCERNING WAGES, HOURS, AND TERMS AND CONDITIONS OF EMPLOYMENT RESOLUTION NO. 25-30 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING THE CLASSIFICATION AND COMPENSATION PLANS FOR THE CITY OF TUSTIN AND APPROVING THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF TUSTIN AND THE TUSTIN POLICE OFFICERS ASSOCIATION — POLICE MANAGEMENT REPRESENTATION UNIT, CONCERNING WAGES, HOURS, AND TERMS AND CONDITIONS OF EMPLOYMENT Fiscal Impact: The provisions of these agreements are estimated to result in an additional cost of approximately $2,580,504 in Fiscal Year 2025-26, $3,875,052 in Fiscal Year 2026-27, and $5,125,383 in Fiscal Year 2027-28 and beyond. These additional expenditures will be included in the upcoming Fiscal Year 2025-2027 biennial budget that will be presented to the City Council in May 2025 for a budget workshop and in June 2025 for budget adoption. PUBLIC HEARING ITEM 11 11. COMMUNITY DEVELOPMENT BLOCK GRANT CONSOLIDATED PLAN FOR PROGRAM YEARS 2025-2029 AND ONE YEAR ACTION PLAN FOR PROGRAM YEAR 2025-2026 The Housing and Community Development Act of 1974, as amended, established the Community Development Block Grant program to return federal funds to local communities for the purpose of developing viable urban communities by providing decent housing, suitable living environments, and by expanding economic opportunities, specifically for low- and moderate -income persons. To participate in the grant program, the City is required to prepare a five-year Consolidated Plan that identifies needs for affordable and supportive housing, community development, public services, and economic opportunities. Annually, the City is also required to prepare a one-year Action Plan that implements the goals and objectives contained City Council April 15, 2025 Meeting Minutes Page 8 of 12 Docusign Envelope ID: 0F687690-B0ED-490D-87F2-E425D11860FF in the Consolidated Plan. The documents set forth in Resolution No. 25-23 (Attachment A) fulfill these requirements. On February 26, 2025, the Citizen Participation Committee held the first of two required public hearings in the Consolidated Plan/Action Plan approval process. At this hearing, the Committee received an overview of the grant program, heard public input and testimony, and considered and provided a recommendation on the 2025- 2029 Consolidated Plan's identified community needs, including associated priorities and goals, to be transmitted to the City Council for approval. Public Hearing opened at 6:42 p.m. Senior Management Analyst Adrianne DiLeva provided a PowerPoint presentation. Public Input — None Mayor Lumbard noted for the record that the City Council received five written comments that have been distributed to the Council and made available to the public on the City's website. Public Hearing closed at 6:50 p.m. It was moved by Council Member Schnell and seconded by Mayor Lumbard that the City Council adopt Resolution No. 25-23: Approving the 2025-2029 Consolidated Plan including the proposed use of Program Year 2025-26 Community Development Block Grant funds for inclusion in the one-year Action Plan; 2. Authorizing the Community and Economic Development Director to submit the Consolidated Plan to the federal Department of Housing and Urban Development (HUD) and make minor modifications to the Consolidated Plan and execute documents, certifications, contracts, or other instruments as may be required to carry out the CDBG program. Roll Call Vote — City Clerk Motion carried: 5-0 RESOLUTION NO. 25-23 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING THE PROGRAM YEAR 2025-2029 CONSOLIDATED PLAN INCLUDING THE PROPOSED USE OF PROGRAM YEAR 2025-26 COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDS Fiscal Impact: The proposed 2025-2029 Consolidated Plan and 2025-26 Action Plan programs and expenditures will be implemented with CDBG funds. No impacts to the General Fund are anticipated. OTHER BUSINESS/CITY MANAGER AND CITY ATTORNEY City Manager Aldo E. Schindler Announced the Public Art Mural at Veterans Sports Park, which was approved at the April 1, 2025, City Council meeting was completed; it is a nice enhancement to the park; great job by the Parks and Recreation Department as well as the Public Art Commission. MAYOR, MAYOR PRO TEM AND COUNCIL MEMBER COMMENTS AND REPORTS Councilmember Fink April 8 Attended the Tustin Area Council of Fine Arts Annual Student Art Invitational at the Tustin Library Community Room; the exhibit showcased art from Tustin Unified School District middle and high school students; great artwork was on display. April 12 Attended the Parks and Recreation Department Community Yard Sale; there was a huge turnout at the event; thanked the Parks and Recreation Department for a great event. April 14 Attended the Orange County Public Libraries Slice of Literary Orange at the Clifton C. Miller Community Center; the featured author was Jennifer Weiner. Met with Tustin Police Chief, Sean Thuilliez; discussed the homeless issue at Peppertree Park; also discussed keeping the parks safe in Tustin; looking forward to working with him. Announced the Tustin Easter Celebration and Egg Hunt Event is scheduled for Saturday, April 19t" from 9:OOAM to 12:OOPM at the Tustin Sports Park; is looking forward to attending the event. Announced Blue Buoy Family Swim School is hosting a Water Safety Challenge on Saturday, April 26t" from 2:OOPM to 4:OOPM. Announced a new art gallery, Various Small Fires, will be opening in a couple of weeks in Tustin. Announced a new Memorandum of Understanding with the Tustin Police Officers Association and the Tustin Police Support Services Association had been reached and finalized. Toured The Real Time Operations Center (RTOC) with City Manager Aldo E. Schindler; the RTOC is a centralized location that uses technology to help law enforcement respond to emergencies and investigation; this is an Orange County Sheriff's Department facility but is located in the City of Tustin. Had lunch with Tustin Police Chief, Sean Thuilliez; discussed The Real Time Operations Center and how the City of Tustin can tap into their resources to help keep the community safe; also discussed school safety which was the topic of conversation. April 9 Toured the Families Forward corporate office; announced the amazing work the organization does; over the 23/24 Fiscal Year they served 180 households and 678 individuals. April 10 • Attended the Transportation Corridor Agencies Joint Board of Directors meeting; the Board approved the Capital Improvement Projects which includes the 241 Toll Road and the 91 Freeway connector project as well as a few other projects along the 91 Freeway and the 241 Toll Road. • Attended the Tustin Police Department Coffee With A Cop. April 11 Attended the Newport Beach Police Department Appreciation Luncheon; was a great event. Council Member Gallagher April 5 Attended the Parks and Recreation Youth Track Meet; was a wonderful event; announced two of his kids participated in the event and had a great time. April 8 Attended the Advocacy Day in Sacramento as a Board Member Chair for the Orange County Sanitation District; attended the day with Townsend Public Affairs; was a very effective day. Mayor Pro Tem Nielsen April 2 Attended the Tustin Citizen Academy Meet and Greet event; was a very well ran event; great to see so many participants in the class. April 15 Hosted the annual Tustin Tri Club Luncheon; the three clubs included Rotary Club of Tustin - Santa Ana, Tustin Kiwanis, and Tustin Host Lions Club; great to discuss projects the groups can work together on; Dr. Stefan Bean, Orange County Superintendent of Schools was the keynote speaker. Announced he will be attending the Tustin Easter Celebration and Egg Hunt Event, which is scheduled for Saturday, April 19th from 9:OOAM to 12:OOPM at the Tustin Sports Park. Mayor Lumbard April 2 Attended the Tustin Citizen Academy Meet and Greet event; thanked City Clerk Erica N. Yasuda and her team for their hard work on a great event. April 9 Chaired the Orange County Fire Authority (OCFA) Budget and Finance Committee meeting; discussed the positive outlook of OCFA finances; announced it's been a pleasure sitting on the OCFA Board as well as the Committee; OCFA is a model for the pension liability paydown policies. Wished everyone a very Happy Easter; announced he will see everyone at the Tustin Easter Celebration and Egg Hunt Event.
