RATIFICATION OF PAYROLL AND DEMANDS The City Council has approved the use of Government Code Section 37208 to expedite the payment of City of Tustin obligations that are in accordance with the approved budget or continued operations authorizations. Recommendation: It is recommended that the City Council approve Payroll in the amount of $1,043,731.65 and Demands in the amount of $1,510,596.02. SECOND READING AND ADOPTION OF ORDINANCE NO. 1566 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING DEVELOPMENT AGREEMENT 2024-0004 - COMPASS AT RED HILL BY MERITAGE HOMES, INC. — A 73 UNIT CONDOMINIUM PROJECT Adoption of Ordinance No. 1566 approves Development Agreement 2024-0004 for a residential development project that would include 73 condominium units, four of which will be set aside as affordable units on approximately 3.4 acres site located at 13751 and 13841 Red Hill Avenue. Recommendation: That the City Council have second reading by title only and adoption of Ordinance No. 1566. ORDINANCE NO. 1566 A ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING DEVELOPMENT AGREEMENT (DA) 2024-0004 BETWEEN THE CITY OF TUSTIN, CALIFORNIA, AND MERITAGE HOMES OF CALIFORNIA, INC. Recommendation: That the City Council have second reading by title only and adoption of Ordinance No. 1568. ORDINANCE NO. 1568 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN DESIGNATING THE STATE FIRE MARSHAL'S 2025 LOCAL RESPONSIBILITY AREA FIRE HAZARD SEVERITY ZONES AS REQUIRED BY CALIFORNIA LAW Fiscal Impact: There is no fiscal impact associated with this item. 6. BUILDING BOARD OF APPEALS APPOINTMENTS City Council June 17, 2025 Meeting Agenda Page 5 of 13 City Council approval is required for the Mayor's appointment of two Building Board of Appeals members. Recommendation: That the City Council approve the following appointments by the Mayor: Douglas Armstrong (first four-year term) and Cristian Arranaga (first four-year term). Fiscal Impact: There is no fiscal impact associated with this item. 7. ADOPT RESOLUTION NO. 25-46 APPROVING FISCAL YEAR 2025-2026 SENATE BILL 1 PROJECT LIST TO BE SUBMITTED TO THE CALIFORNIA TRANSPORTATION COMMISSION To be eligible to receive new funding under Senate Bill 1, the City is required to submit a Project List to the California Transportation Commission no later than July 1, 2025. Recommendation: 1. Adopt Resolution No. 25-46 identifying projects to be submitted to the California Transportation Commission for Senate Bill 1 funding; and 2. Direct staff to submit the Project List to the California Transportation Commission on behalf of the City. RESOLUTION NO. 25-46 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADOPTING A LIST OF PROJECTS FOR FISCAL YEAR 2025-26 FUNDED BY SB 1: THE ROAD REPAIR AND ACCOUNTABILITY ACT OF 2017 Fiscal Impact: Submittal of the Project List to the California Transportation Commission allows the City to receive funding for maintenance, rehabilitation, and safety -related roadway projects. Staff estimates revenue for Fiscal Year (FY) 2025- 26 is approximately $2,108,000. 8. SET PUBLIC HEARING FOR WATER QUALITY REPORT ON PUBLIC HEALTH GOALS 2022-2024 The California Health and Safety Code requires that water systems with more than 10,000 service connections prepare a report every three years and conduct a public hearing to provide information to consumers on levels of contaminants in the City's drinking water. Recommendation: It is recommended that the City Council set a public hearing for August 5, 2025, at 6:00 p.m. to receive and respond to public comments on the 2025 Public Health Goals Report. City Council June 17, 2025 Meeting Agenda Page 6 of 13 Fiscal Impact: Sufficient funding was appropriated in the Water Division Operating Budget to complete this report. 9. ACCEPT IMPROVEMENTS AND FILE A NOTICE OF COMPLETION FOR THE BENETA WELL NO. 2 — PHASE II EQUIPPING PROJECT Construction of the Beneta Well No. 2 — Phase II Equipping Project has been completed to the satisfaction of the City Engineer and is now ready for City Council acceptance. Recommendation: It is recommended that the City Council: 1. Adopt Resolution No. 25-49 accepting the improvement of the Beneta Well No. 2 — Phase II Equipping Project; and 2. Authorize the City Engineer to execute and file the Notice of Completion with the Orange County Recorder's Office. RESOLUTION NO. 25-49 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING THE PUBLIC WORKS AND IMPROVEMENT AND AUTHORIZING THE RECORDATION OF THE NOTICE OF COMPLETION FOR THE BENETA WELL NO. 2 — PHASE II EQUIPPING PROJECT, (CIP NO. 60151) Fiscal Impact: The final construction cost for the Beneta Well No. 2 — Phase II Equipping Project is $3,091,274.21, approximately 0.2% lower than the original contract amount of $3,096,800.00 and there were no contract change orders. This project was funded using 2024 Water Revenue Bond proceeds. 10. AWARD CONSTRUCTION CONTRACT FOR THE EL CAMINO REAL WATER MAIN RELOCATION PROJECT Staff is requesting the City Council award a construction contract to the lowest responsive/responsible bidder for the El Camino Real Water Main Relocation Project. Recommendation: It is recommended that the City Council: 1. Award a construction contract to the lowest responsive/responsible bidder, G&A Nelos Construction, Inc. in the amount of $393,399.10 for the El Camino Real Water Main Relocation Project and authorize the Mayor and the City Clerk to execute the contract documents on behalf of the City; and 2. Authorize the remaining project budgeted appropriation in excess of ten percent (10%) above the contract amount as additional contingency. Fiscal Impact: Utility Agreement COT-56 between the City of Tustin and the Orange County Transportation Authority authorizes the full reimbursement for final design and construction costs, minus an accrued depreciation credit of $2,650. City Council June 17, 2025 Meeting Agenda Page 7 of 13 The FY 2024-25 Capital Improvement Program budget has $500,000 allocated from Water Capital Fund for the construction phase of the El Camino Real Water Main Relocation Project. 11. APPROVE AMENDMENT TO ATTACHMENT AGREEMENT WITH THE SOUTHERN CALIFORNIA GAS COMPANY The Southern California Gas Company has been deploying advanced metering technology throughout their service area. On February 7, 2023, the City Council approved an Attachment Agreement which allowed installation of one metering device on a City -owned street light pole. The Southern California Gas Company is requesting four additional locations be included in the agreement. Recommendation: It is recommended that the City Council approve the amendment to the Attachment Agreement with the Southern California Gas Company. Fiscal Impact: The agreement provides the City with two one-time forms of compensation per installation site. A payment of $780.00 for use of the pole and $233.60 for compensation of electrical uses needed to operate the device. 12. APPROVE THE ANNUAL OC GO (MEASURE M2) ELIGIBILITY SUBMITTAL PACKAGE, FISCAL YEAR 2025-2026 To maintain eligibility to receive OC Go (also known as Orange County Measure M2 Program) funding, the City is required to annually submit a compliance package to the Orange County Transportation Authority. Recommendation: It is recommended that the City Council take the following actions: 1. Adopt the attached Measure M2 Seven -Year Capital Improvement Program (Fiscal Year 2025-2026 through Fiscal Year 2031-2032, Attachment "B" of the M2 Eligibility Package); and 2. Approve Resolution No. 25-47 informing the Orange County Transportation Authority that the City updated a Pavement Management Plan that is in conformance with their format; and 3. Approve Resolution No. 25-48 informing the Orange County Transportation Authority that there have been no changes to the City's Circulation Element of the General Plan and that it is consistent with the Master Plan of Arterial Highways and that the City concurs with the Mitigation Fee Program for new development; and 4. Authorize the Director of Public Works to submit the City of Tustin's Measure M2 eligibility package to the Orange County Transportation Authority. City Council June 17, 2025 Meeting Agenda Page 8 of 13 RESOLUTION NO. 25-47 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, CONCERNING THE STATUS AND UPDATE OF THE PAVEMENT MANAGEMENT PLAN FOR THE MEASURE M2 (M2) PROGRAM RESOLUTION NO. 25-48 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, CONCERNING THE STATUS AND UPDATE OF THE CIRCULATION ELEMENT, AND MITIGATION FEE PROGRAM FOR THE MEASURE M (M2) PROGRAM Fiscal Impact: The City has successfully secured Comprehensive Transportation Funding Program competitive funds under the current Measure M2 Program and met required match funding contributions towards various projects over the years. The City's annual local jurisdiction apportionment, known as "Local Fair Share," under Measure M2, is estimated at $2.25M for Fiscal Year 2025-2026. Since 2011, the City has received approximately $46M from the Measure M2, including $22.3M in Local Fair Share funds. These funds have supported numerous City projects including the Tustin Ranch Road Extension, Warner Avenue Extension, Tier 1/11 Environmental Water Quality, Senior Mobility Program, Red Hill Avenue Widening and Raised Median Improvements, and traffic signal synchronization projects along Tustin Ranch Road, Red Hill Avenue, Seventeenth Street, First Street, Tustin Avenue and Edinger Avenue corridors as well as the City's annual roadway and public infrastructure maintenance program. 13. RESOLUTION DETERMINING THE NEED TO CONTINUE THE PROCLAIMED LOCAL EMERGENCY RELATED TO THE NAVY NORTH HANGAR At its meeting on November 10, 2023, the City Council ratified the Acting City Manager's Proclamation of Local Emergency related to the fire at the Navy's North Hangar and release of chemicals of public health concern, including asbestos. At a special meeting of the City Council on January 9, 2024, and at its regular meetings on March 5, 2024, April 16. 2024, June 4, 2024, June 18, 2024, July 16, 2024, August 20, 2024, October 15, 2024, December 3, 2024, January 21, 2025, March 18, 2025, and May 6, 2025, the City Council reviewed and determined the need to continue the local emergency. This item recommends that the City Council once again review and determine that the need exists to continue the local emergency, as required by State law. Recommendation: It is recommended that the City Council adopt Resolution 25-52 determining the need exists to continue the local emergency related to the fire and release of chemicals of public health concern from the Navy's North Hangar, in the form attached hereto as Attachment 2. RESOLUTION 25-52 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DETERMINING THE NEED TO CONTINUE LOCAL EMERGENCY RELATED TO FIRE AND RELEASE OF HAZARDOUS MATERIALS FROM NAVY NORTH HANGAR City Council June 17, 2025 Meeting Agenda Page 9 of 13 Fiscal Impact: There is no direct impact from a determination that a local emergency continues to exist. 14. COMMUNITY FACILITIES DISTRICT 2018-01 ZONE 3 Request for approval of the implementing documents and resolution related to the annexation of property subject to a Disposition and Development Agreement between the City and Tustin Legacy Acquisition LLC (Irvine Company) into Community Facilities District 2018-01 and designating the property as Zone 3. Recommendation: It is recommended that the City Council take the following actions: 1. Receive and file the unanimous approval of annexation into Community Facilities District 2018-01 Zone 3 and related matters signed by the City Manager on behalf of the City of Tustin as the property owner; and 2. Adopt Resolution 25-40: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DECLARING INTENTION TO ANNEX TERRITORY TO THE CITY OF TUSTIN COMMUNITY FACILITIES DISTRICT NO. 2018-01 (PUBLIC SERVICES), APPROVING A BOUNDARY MAP OF THE ANNEXATION PROPERTY AND DIRECTING THE CITY CLERK TO RECORD THE BOUNDARY MAP, THE NOTICE OF THE SPECIAL TAX LIEN FOR COMMUNITY FACILITIES DISTRICT NO. 2018-01 ZONE 3, AND THE NOTICE OF CESSATION OF SPECIAL TAX LIEN FOR COMMUNITY FACILITIES DISTRICT NO. 2013-01 Fiscal Impact: The Rate and Method of Apportionment for each Zone of Community Facilities District 2018-01 establishes the cost for services required for each proposed land use. The special tax is for services (not facilities) such as police and fire; recreation program services; maintenance of parks, streets, sidewalks and drainage facilities; and other general City services associated with the development and maintenance of Tustin Legacy. The Rate and Method of Apportionment for proposed Community Facilities District 2018- 01 Zone 3 has been previously negotiated through the Disposition and Development Agreement between the City and Irvine Company which was approved by the City Council on March 18, 2025. The initial negotiated rate attributable to market rate apartments beginning in Fiscal Year 2024-2025 will be $1,364.28 per dwelling unit with affordable dwelling units exempted from the special tax. The rate will escalate annually based on a specific Consumer Price Index with a minimum annual escalation of 2% and a maximum of 3%. 15. PROJECT FUNDING FOR ASSEMBLY BILL 2766 (MOTOR VEHICLE REGISTRATION SUBVENTION) FUNDING PROGRAM City Council June 17, 2025 Meeting Agenda Page 10 of 13 The City Council authorizes the use of the City's disbursement of Assembly Bill 2766 funds to offset costs for vehicle emission reduction programs implemented by the City of Tustin. This year, the City Council is requested to allocate the projected Assembly Bill 2766 disbursements for Fiscal Years 2024-2025 and 2025-2026 to fund the Main Street Capital Improvement Project. Recommendation: That the City Council authorize the use of the City's projected Assembly Bill 2766 disbursements for Fiscal Years 2024-25 and 2025-26 to fund the Main Street Capital Improvement Project by minute order. Fiscal Impact: Since 1991, Assembly Bill 2766 funds have been made available to local governments for use in offsetting State mandated vehicle emissions reduction programs. The use of these funds reduces General Fund responsibility to fund State mandated emission reduction programs. Funds are disbursed to cities on a quarterly basis. In addition to $121,895.86 in available funds from prior funding periods, a total of $78,541.15 has been disbursed in the 2024-25 Fiscal Year, with an estimated final disbursement of $25,000 by June 30, 2025. Approximately $100,000 is expected to be disbursed for the 2025-26 Fiscal Year, for a total of approximately $325,437.01 being available by the end of 2026. 16. ANNUAL REPORT ON THE TUSTIN POLICE DEPARTMENT'S USE OF MILITARY EQUIPMENT PER CALIFORNIA ASSEMBLY BILL 481 Assembly Bill (AB) 481 requires the Tustin Police Department ("Department") to seek City Council approval by ordinance for the funding, acquisition, and use of equipment defined by the law as "military equipment." This legislation also requires law enforcement agencies to submit to the City Council an annual report outlining a summary of the use of the equipment and the purpose for its use, any complaints or concerns received concerning the military equipment, results of any internal audits or violations and any actions taken in response, the total annual costs for the equipment, the quantity possessed by the agency, and the intention to purchase additional equipment in the following year. In addition, within 30 days of submitting and publicly releasing the annual report, a well -publicized and community engagement meeting must be held to allow for public comments. This report outlines staff's work in complying with the law and request for continued utilization of the Department's military equipment and approval of the Department's military equipment policy under Tustin Police Department Policy 706 — Military Equipment Policy (formerly identified as Tustin Police Department General Order No. 708). Recommendation: To receive and file the annual report on the Department's use of military equipment for calendar year 2024 (Attachment 1); City Council June 17, 2025 Meeting Agenda Page 11 of 13 2. To receive and file the proposed version of Tustin Police Department Policy 706 —Military Equipment Policy (Attachment 2); 3. To direct the Tustin Police Department to post Tustin Police Department Policy 706 (Attachment 2) on the Department's website; 4. To direct the Tustin Police Department to hold a well -publicized and conveniently located meeting to give the public an opportunity to discuss the annual military equipment report; and 5. To direct staff to set the matter for a public hearing regarding an ordinance to approve Tustin Police Department Policy 706 which is at least 30 days from today's date Fiscal Impact: The estimated annual cost for the use and maintenance of the military equipment is detailed under each specific category item outlined in Tustin Police Department Policy 706 — Military Equipment Policy. PUBLIC HEARING ITEMS 17-18 17. ADOPTION OF A RESOLUTION UPDATING THE COMPREHENSIVE FEE SCHEDULE A Comprehensive User Fee Study determines the cost of providing governmental services and ensures that user fees and charges do not exceed the costs of providing these services. Per City Council Resolution No. 21-54, the City's Finance Director is to annually review and recommend to the City Council adjustments to fees set forth in the Comprehensive Fee Schedule in accordance with the Consumer Price Index (CPI). If approved by the City Council, fee adjustments will take effect on September 1, 2025. Recommendation: 1. Conduct a public hearing on the proposed adoption of an update to the City's Comprehensive Fee Schedule; and, 2. Adopt Resolution No. 25-50, Establishing and Adopting Updated Development Processing Fees and Other City Rates, Charges, and User Fees for Various Government Services. RESOLUTION NO. 25-50 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ESTABLISHING AND ADOPTING UPDATED DEVELOPMENT PROCESSING FEES AND OTHER CITY RATES, CHARGES, AND USER FEES FOR VARIOUS GOVERNMENT SERVICES City Council June 17, 2025 Meeting Agenda Page 12 of 13 Fiscal Impact: The annual CPI change from February 2024 to February 2025 was 3.11 %. Staff projects a $55,000 increase in General Fund revenues associated with this CPI change to the Comprehensive Schedule of Fees. 18. AUTHORIZATION TO PARTICIPATE IN THE CALIFORNIA MUNICIPAL FINANCE AUTHORITY'S BOND OPPORTUNITIES FOR LAND DEVELOPMENT PROGRAM FOR COMMUNITY FACILITIES DISTRICT FORMATION A request that the City Council authorize participation in the California Municipal Finance Authority's Community Facility District Bond Opportunities for Land Development program, which enables land developers to finance public improvements and/or pay development impact fees from the issuance of tax-exempt bonds. Recommendation: Staff recommends that the City Council: 1. Adopt Resolution 25-44, authorizing participation in the California Municipal Finance Authority's (CMFA) Bond Opportunities for Land Development (BOLD) program, which allows the California Municipal Finance Authority to accept applications, conduct proceedings, and levy special taxes within the City of Tustin, pursuant to the Mello -Roos Community Facilities Act of 1982. 2. Authorize the City Manager and/or Finance Director, or their designee(s), to negotiate, execute, and deliver acquisition, reimbursement, orjoint community facilities agreements required in connection with any BOLD Community Facilities District formed pursuant to Resolution 25-44. RESOLUTION NO. 25-44 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING USE OF THE BOND OPPORTUNITIES FOR LAND DEVELOPMENT PROGRAM AND AUTHORIZING THE CALIFORNIA MUNICIPAL FINANCE AUTHORITY TO ACCEPT APPLICATIONS FROM PROPERTY OWNERS, CONDUCT PROCEEDINGS AND LEVY SPECIAL TAXES WITHIN THE CITY OF TUSTIN PURSUANT TO THE MELLO-ROOS COMMUNITY FACILITIES ACT OF 1982, AS AMENDED; AND AUTHORIZING RELATED ACTIONS Fiscal Impact: There is no cost to the City to participate in the BOLD program. Projects financed through the BOLD program will facilitate future development of public infrastructure within Tustin.
