RESOLUTION NO. 4531
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF TUSTIN, CALIFORNIA,
DETERMINING THAT TEMPORARY EASEMENTS
AND THE CONVEYANCE OF PORTIONS OF THE EL
MODENA-IRVINE CHANNEL FROM THE COUNTY
OF ORANGE FLOOD CONTROL DISTRICT TO THE
ORANGE COUNTY TRANSPORTATION
AUTHORITY, ON BEHALF OF CALTRANS, IS IN
CONFORMANCE WITH THE CITY OF TUSTIN
GENERAL PLAN (APN: 500-291-15 AND 432-391-28)
The Planning Commission of the City of Tustin does hereby resolve as follows:
I. The Planning Commission of the City of Tustin finds and determines as follows:
A. That the County of Orange on behalf of the Orange County Flood Control
District (OCFCD) requested that the City of Tustin Planning Commission
make a General Plan Conformance determination regarding the acquisition
of easements and conveyance of parcels of land in fee to the Orange
County Transportation Authority (OCTA) acting on behalf of the California
Department of Transportation (Caltrans).
B. That the subject properties, identified as portions of APNs 500-291-15 and
432-391-28, are located within the El Modena - Irvine Channel and within
the City of Tustin.
C. That the subject properties have a General Plan Land Use designation of
Planned Community Commercial Business (PCCB) and are zoned Planned
Community Commercial (PC-COM).
D. That the conveyance of property between the subject agencies are
necessary for the Interstate 5 Freeway widening project by Caltrans.
E. That the portions of property to be conveyed will continue to be utilized for
flood control purposes.
F. That the Public Works department reviewed the request and had no
concerns relative to the conveyance of property between the subject
agencies.
G. That Section 65402(a) of the Government Code authorizes the Planning
Commission to determine whether the location, purpose, and extent of the
proposed disposition of real property are consistent with the General Plan.
H. That the proposed easements and conveyance of the subject properties
supports several General Plan goals, including the following:

1. Land Use Element Goal 7: Encourage transportation investments
and improvements that enhance regional access, circulation, and
economic development.
2. Circulation Element Goal 3: Support development of a network of
regional transportation facilities which ensure the safe and efficient
movement of people and goods from within the City to areas outside
its boundaries, and which accommodate the regional travel demands
of developing areas outside the City.
That the General Plan Conformity determinations required by Government
Code Section 65402 (a) are not "projects" requiring environmental review
pursuant to the California Environmental Quality Act.
The Planning Commission hereby determines that the location, purpose, and
extent of the proposed conveyance of temporary construction easements and
portions of land in fee to accommodate the proposed widening of the Interstate
5 Freeway is in conformance with the General Plan.
PASSED AND ADOPTED by the Planning Commission of the City of Tustin at a regular
meeting held on the 8th day of July, 2025.
