RESOLUTION NO. 4047
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN, APPROVING USE DETERMINATION 06-002
TO ALLOW A PET HOTEL AS A CONDITIONALLY
PERMITTED USE IN THE PLANNED COMMUNITY MIXED
USE (PC-MU) ZONING DISTRICT.
The Planning Commission does hereby resolve as follows:
I. The Planning Commission finds and determines as follows:
A. A proper application for Use Determination 06-002 was filed by
Andrew Whiteaker of PetSmart Inc., to request authorization to
establish a pet hotel as a conditionally permitted use within the
Planned Community Mixed Use (PC-MU) zoning district located at
2741 EI Camino Real.
B. Section 9233a of the Tustin City Code allows the Planning
Commission to determine if unlisted uses are similar to those
allowed in the district. A Use Determination is necessary to decide if
the proposed use would be permitted, conditionally permitted, or
prohibited in the zoning district.
C. That a public hearing was duly called, noticed, and held for Use
Determination 06-002 in conjunction with Conditional Use Permit
06-022 on January 8, 2007, by the Planning Commission.
D. That approval of Use Determination 06-002 to allow for a pet hotel as
a conditionally permitted use within the Planned Community Mixed
Use (PC-MU) zoning district can be supported by the following
findings:
1) The proposed Pets Hotel would be an ancillary use to a retail pet
store, which is an outright permitted use in the PC-MU district.
2) All operations of the PetsHotel would be confined within the
existing building.
3) The proposed use would not have a detrimental effect on the
public health, safety, and general welfare of the community in
that the proposed business would care for pets while owners
are out of town and promote the health and hygiene of animals
within the community.
4) The Traffic Division of the City's Public Works Department has
reviewed the proposed PetsHotel and concluded that there are
no anticipated impacts upon the adjacent traffic system.

5) The proposed use would be considered on a case-by-case
basis and subject to the conditional use permit process and
public noticing requirements. Projects would be conditioned to
ensure that there would be no adverse impacts on the existing
neighborhoods.
E. This project is Categorically Exempt pursuant to Section 15301
(Class 1) of Title 14, Chapter 3 of the California Code of
Regulations (Guidelines for the California Environmental Quality
Act).
II. The Planning Commission hereby approves Use Determination 06-002 to
allow for a pet hotel as a conditionally permitted use within the Planned
Community Mixed Use (PC-MU) zoning district
