CONDITIONAL USE PERMIT 06-004 - A request for authorization to construct a 249 square foot semi-enclosed addition to accommodate patrons that smoke at an existing 2,357 square foot restaurant that maintains alcohol service (ABC license type "47" for on-sale general eating place). APPLICANT: McCLURE'S BAR AND GRILL ATTN: MICHAEL MANSON PROPERTY OWNER: DAVID CHOU TRUST RECOMMENDATION: That the Zoning Administrator adopt Zoning Administrator Action No. 07-001 approving Conditional Use Permit 06-004. Presentation: Chad Ortlieb, Associate Planner The Acting Zoning Administrator explained the hearing process to Michael Manson, applicant and owner of McClure's Bar & Grill. The Public Hearing opened at 10:34 a.m. Zoning Administrator Agenda January 8, 2007 Page 2 The Acting Zoning Administrator indicated that since no major changes are taking place, this application is considered a minor conditional use permit that can be handled administratively, specified that no seats are allowed on the patio, reviewed several conditions of approval with the applicant, and asked the applicant if he had read the staff report and understood the conditions of approval. The applicant responded that he had read the report and understood the conditions. Mr. Manson thanked staff for being supportive and working with him on this outdoor patio addition which will provide an area for patrons to smoke; it is hoped that the addition will allow McClure's to recapture some of the customers who have been going to other cities that do not enforce the no-smoking law. The Acting Zoning Administrator adopted Zoning Administrator Action No. 07-001 approving Conditional Use Permit 06-004. The Acting Zoning Administrator explained that there is a seven-day appeal period for this item.
