PUBLIC HEARINGS:
1. Conditional Use Permit 03-022 - A request to establish a piano/furniture sales
warehouse within an existing 1,874 square foot suite in the Irvine Industrial Complex
Planned Community located at 2620 Walnut Avenue, Unit B.

RECOMMENDATION
That the Zoning Administrator adopt Zoning Administrator Action 04-004
approving Conditional Use Permit 03-022.

The Public Hearing opened at 10:31 a.m.
Chad Ortlieb presented the staff report.
The Zoning Administrator asked the applicant if she had read and understood the report
and/or had any concerns.

Maria Djohari, applicant, responded that she understood the report and had no concerns.
The Zoning Administrator asked if the applicant could comply with the conditions.
The applicant responded in the affirmative.
Pamela Feld, 2620 Walnut Avenue, Units A and S, Tustin, stated her business is in the
suites adjacent to the applicant; indicated that the applicant's unit should be changed to
Unit C; stated that her offices share the common wall with the applicant; indicated her
concerns regarding potential noise that may be created by the applicant's customers
testing the various pianos; stated she had the leasing company install a sound wall; and,
added she felt it was important to attend the public hearing to voice her concerns.
The Zoning Administrator stated that music instruction is prohibited on-site; asked the
applicant to explain the operations anticipated at the site to provide clarification for Ms.
Feld; and, added that the conditions could be modified to address the concerns stated by
Ms. Feld.
The applicant verified that her space is Unit C; and, stated that customers would only be
testing the pianos for short periods of time.
The Zoning Administrator indicated that she was sensitive to Ms. Feld's concerns.
Karen Peterson stated that Chad Ortlieb had prepared new language for the
Administrator's consideration.
Chad Ortlieb noted the conditions can be amended to: 1) include the applicant's
compliance with the City's noise ordinance; and, 2) if noise becomes a problem, require
the applicant have a noise study conducted identifying the type and pitch of noise and, if
necessary, provide mitigation recommendations. Staff could then request that the
applicant implement mitigation of the noise problem.
The Zoning Administrator asked how often staff could review the situation; and, noted
there is standard language that has been included in conditional use permits allowing for
a six-month or annual review.
Mr. Ortlieb indicated this could be a complaint-based request or left as a function of a
review period.
The Zoning Administrator asked that the conditions be amended to include the review
period; and, requested a condition be included that requires the applicant's doors to
remain closed during business hours. The resolution and staff report should also be
amended to correct the unit to "C."
The Public Hearing closed.
The Zoning Administrator adopted Zoning Administrator Action 04-004 approving
Conditional Use Permit 03-022, as amended.

The Zoning Administrator pointed out the seven-day appeal period to the applicant and
Ms. Feld.

The date of the next meeting of the Zoning Administrator will be scheduled when items
are set for hearing.
