HomeMy WebLinkAboutAction Agenda 10-25-04 ACTION AGENDA ZONING ADMINISTRATOR MEETING OCTOBER 25, 2004 **** CALL TO ORDER: 10:30 a.m. Community Development Department Conference Room ROLL CALL: Elizabeth Binsack, Zoning Administrator Staff present: Karen Peterson, Senior Planner Chad Ortlieb, Associate Planner Justina Willkom, Associate Planner Eloise Harris, Recording Secretary PUBLIC CONCERNS: (Limited to 3 minutes per person for items not on the agenda) CONSENT CALENDAR: No Items on Consent Calendar REGULAR BUSINESS: Desion Review 04-014 and Minor Adjustment 04-001 - Authorization to reduce the number of required number of parking spaces from nine (9) spaces to eight (8) spaces to accommodate the conversion of an existing 1,820 square foot single family residence and a 528 square foot detached garage into a professional consultant office. The project is located at 14891 Yorba Street within the Specific Plan NO.9 zoning district. APPLICANT!: PROPERTY OWNER: JOYCE ALTMAN JOYCE ALTMAN INTERPRETING RECOMMENDATION That the Zoning Administrator adopt Zoning Administrator Action 04-011 approving Design Review 04-014 and Minor Adjustment 04-001. Brandy Bizarro introduced herself as Joyce Altman's daughter and was representing the applicant. The Zoning Administrator asked if Ms. Bizarro had read the information provided in the report. Ms. Bizarro responded in the negative, apologized, and indicated the architect had been the one dealing with the project, but he was unable to attend the hearing this morning. Zoning Administrator Agenda October 4, 2004 Page 2 Justina Willkom indicated that Juan Suarez, the architect, received a copy of the report; and, indicated he had not called with any questions. The Zoning Administrator indicated the primary concern regarded the issuance of the proper permits. The Zoning Administrator approved Zoning Administrator Action 04-011 approving Design Review 04-014 and Minor Adjustment 04-001. The Zoning Administrator indicated there is a seven-day appeal period. If there is no appeal, the applicant may proceed. The Zoning Administrator asked if the proper permits have been issued. Ms. Willkom answered the applicant must first submit; she will be working with the architect. Ms. Bizarro indicated it was her understanding that the reduction of spaces was something that the City had requested because there was not enough space for the original amount planned. Ms. Willkom stated that there are Tustin City Code requirements regarding major improvements; since the structure is listed in the Historic Survey, a Minor Adjustment would be allowed, according to the submitted building plans. PUBLIC HEARINGS: Conditional Use Permit 04-024 - Authorization to temporarily operate a soil vapor and groundwater extraction unit at an existing gas station to remove hydrocarbons from the water and soil. The project is located at 14081 Red Hill Avenue within the Retail Commercial (C1) zoning district. APPLICANT: CONOCO PHILLIPS COMPANY ATTN: CHRIS SWARTZ PROPERTY OWNER: THOMAS WILSON AND MARILYN GRANDON TRUSTEES RECOMMENDATION That the Zoning Administrator adopt Zoning Administrator Action 04-010 approving Conditional Use Permit 04-024. The Public Hearing opened at 10:39 a.m. The Zoning Administrator indicated that no staff report was necessary and asked the attendees to identify themselves. Zoning Administrator Agenda October 4, 2004 Page 3 Matt Eaton and Bryen Woo, TRC, representing the design firm that Conoco hired to prepare the design and manage the installation of the system, introduced themselves. The Zoning Administrator asked if they had read and understood the conditions of approval that were identified in the report. The representatives answered in the affirmation. The Zoning Administrator asked if there would be any problem complying with the conditions. Mr. Eaton asked about the fencing required by Condition 2.3; indicated that this is an operating gas station; stated the activities will be minor; and, asked if the fencing will be necessary. Chad Ortlieb stated the Building Official indicated that, in lieu of the fencing requirement, construction cones with caution could be used around the trenching areas; pursuant to the conditions, equipment for construction would be kept on construction vehicles on-site. Mr. Eaton indicated that Conoco would have no problem with those requirements. The Zoning Administrator indicated that Condition 2.3 be modified to include "or equivalent acceptable barrier" after chain link fence in the first sentence. The Zoning Administrator approved Zoning Administrator Action 04-010 approving Conditional Use Permit 04-024, as amended. The Zoning Administrator noted there is a seven-day appeal period on this item. If there are no appeals, the action is final. ADJOURNMENT: The meeting adjourned at 10:45 a.m. The date of the next meeting of the Zoning Administrator will be scheduled when items are set for hearing.
