SCHINDLER, CITY MANAGER MICHAEL GRISSO, DIRECTOR OF PUBLIC WORKS AWARD CONSTRUCTION CONTRACT FOR THE MAIN STREET AND OLD TOWN IMPROVEMENTS PROJECTS Staff is requesting the City Council award a construction contract to the lowest responsive/responsible bidder for the Main Street and Old Town Improvements Projects. RECOMMENDATION: It is recommended that the City Council: 1. Award a construction contract to the lowest responsive/responsible bidder, Los Angeles Engineering, Inc. in the amount of $10,390,406.15 for the Main Street and Old Town Improvements Projects and authorize the Mayor and the City Clerk to execute the contract documents on behalf of the City; and 2. Appropriate $510,000 from Measure M2 Fair Share for the Old Town Improvements Project. FISCAL IMPACT: The Fiscal Year 2025-2026 Capital Improvement Program budget includes funding in the amount of $7,000,000 for the Main Street Improvements Project and $3,993,741 for the Old Town Improvements Project. In addition, $17,530 of Community Development Block Grant Program Year 2023-2024 funds were reallocated administratively to this project. The requested appropriation of $510,000 brings the total budget to $11,521,271 and is needed to fully fund the Old Town Improvements Project. Expenses include: • Construction Contract — Schedule "A" (General Items)...................$1,092,500 • Construction Contract — Schedule "B" (Old Town Improvements) ..$3,707,105 • Construction Contract — Schedule "C" (Main St. Improvements) ....$5,590,802 • Contingency (10%).........................................................................$1,039,040 0 Docusign Envelope ID: CA99B341-9507-4190-B603-343EE6FCBE23 City Council Agenda Report Main Street and Old Town Improvements Projects October 7, 2025 Page 2 • Construction Support and Geotechnical Services................................$91,824 • Total Budget.................................................................................$11,521,271 CORRELATION TO THE STRATEGIC PLAN: Construction of the Main Street and Old Town Improvements Projects contributes to the fulfillment of the City's Strategic Plan Goal A: Economic and Neighborhood Development. Specifically, the projects implement Strategy #2, which, among other items, is to improve Old Town, and Strategy #8, to create linkages between parts of the community through a variety of means, such as bike lanes. The projects also contribute to fulfilling Goal B: Public Safety and Protection of Assets. Specifically, the projects implement Strategy #5a, which is to ensure continuous maintenance and improvement of public facilities. BACKGROUND AND DISCUSSION: On July 3, 2018, the City Council adopted the Downtown Commercial Core Specific Plan (DCCSP), a master plan to revitalize the City's commercial core. The Main Street and Old Town Improvements Projects will contribute towards the fulfillment of the DCCSP's goals and objectives in creating a strong gateway into the Central Commercial Core Area with enhanced streetscape, creating a pedestrian and bicycle -friendly environment along Main Street between Newport Avenue and Prospect Avenue and along El Camino Real between Newport Avenue and First Street. Proposed improvements on Main Street include reducing the curb -to -curb width to approximately 56 feet to match the roadway west of Prospect Avenue; widening the sidewalks on both sides of the street; relocating the library parking lot driveway to align with the Tustin Plaza driveway on the south side of the street, including an in -pavement lighted crosswalk; constructing a 12-foot wide landscaped median; reconfiguring on -street parking to angled parking; installing a gateway sign spanning the street; installing electrical receptacles at tree well locations and the necessary electrical circuits to power "mini -string lights" in the trees; and adding Class II bike lanes, street trees, street furniture, and lighting. The Old Town Improvements Project includes construction of seven (7) parklets, closure of two (2) driveways to vacant lots on El Camino Real to create eight (8) new parking spaces, crosswalk improvements on Main Street at the intersections of C Street and Prospect Avenue including an actuated crosswalk warning system, electrical undergrounding improvements on Main Street between C Street and Prospect Avenue to provide street tree lighting, installation of manually retractable bollards at key intersection locations in Old Town, implementation of bike "sharrow" striping improvements on El Camino Real and Main Street, enhanced public parking directional signs in the Old Town Area, decorative pavement enhancement at the El Camino Real and Main Street intersection, and a digital information kiosk at the intersection of Main Street and El Camino Real. Docusign Envelope ID: CA99B341-9507-4190-B603-343EE6FCBE23 City Council Agenda Report Main Street and Old Town Improvements Projects October 7, 2025 Page 3 The Main Street Improvements Project was awarded a $3,172,000 grant by the Southern California Association of Governments Regional Council through the Orange County Complete Streets Program (OCCSP) using federal Surface Transportation Block Grant and Congestion Mitigation and Air Quality Improvement funds. The OCCSP is intended to support local agency projects in Orange County that further a complete streets goal and have a transportation nexus. Formal bids were submitted electronically and publicly opened on August 26, 2025. Four (4) bids were received and are summarized as follows: • Los Angeles Engineering, Inc ................................................. $ 10,390,406.15 • TORO Enterprises, Inc........................................................... $ 13,093,087.90 • Sequel Contractors, Inc .......................................................... $ 13,995,234.25 • Sully Miller Contracting Company ........................................... $ 14,661,477.34 Following the August 26, 2025 bid opening, staff allowed additional time before bringing the award recommendation to City Council to address potential bid protests and to review federally required documentation. While bid protests must generally be filed within five calendar days of the bid opening, mailed protests may take additional time to arrive, requiring staff to hold the bids under advisement to ensure compliance with the protest procedures. In addition, because this project is federally funded, the apparent low bidder was required to submit Disadvantaged Business Enterprise (DBE) commitments and Good Faith Effort documentation within the specified timeframe, which staff carefully reviewed and verified along with contractor licenses, references, and labor compliance. This due diligence extended the award timeline and ensured the City's recommendation was fully responsive to both state and federal requirements. Staff has reviewed the references, the State Contractor's License and registration with the Department of Industrial Relations and has determined Los Angeles Engineering, Inc. meets the City's requirements and are appropriate for the subject project. Staff recommends that the City Council award the construction contract to the lowest responsive/responsible bidder, Los Angeles Town Improvements Projects. Public Outreach Engineering, Inc. for the Main Street and Old Due to the high visibility of this project and the potential impacts to the businesses in Old Town, staff has developed a communication strategy to ensure businesses have access to project information and schedules. All print outreach material will drive people to a dedicated project webpage that will be updated regularly with project milestones and schedules. Broad Outreach to the Old Town Neighborhood: A postcard will be sent to approximately 3,500 businesses and residents in Old Town in late October with similar information and renderings of the improvements. On -site Resources: A Public Works Inspector will be on -site daily and will be proactively engaging with businesses to ensure they understand timing of construction activities adjacent to their property. To engage pedestrians, signage will be provided at each of the parklet locations with a QR code linked to the dedicated project webpage.
