SCHINDLER, CITY MANAGER MICHAEL GRISSO, DIRECTOR OF PUBLIC WORKS CITY OF TUSTIN PROPERTIES WITHIN THE PROPOSED TUSTIN LANDSCAPE AND LIGHTING REASSESSMENT DISTRICT 2025 All properties within the Tustin Landscape and Lighting District have been provided ballots to vote on the formation of a proposed reassessment district to support increased maintenance activities within the public right-of-way. Proposition 218 requires that publicly owned parcels also pay special benefit assessments levied for a landscape and lighting district. The City of Tustin has received ballots representing 21 City -owned park and fire station parcels within the proposed reassessment district. RECOMMENDATION: It is recommended that the City Council direct the City Manager to complete ballots for City - owned parcels in support of forming Tustin Landscape and Lighting Reassessment District 2025 and submit ballots to the City Clerk for tabulation on December 2, 2025. FISCAL IMPACT: If approved, the proposed reassessment district will replace the existing district and levy assessments commencing Fiscal Year 2026-2027. The proposed annual reassessment would result in a General Fund expenditure of $16,453.22 in Fiscal Year 2026-2027, followed by an annual increase reflective of the 5-year assessment schedule as shown in Attachment 1. Beginning Fiscal Year 2031-32, assessments will be increased by a defined formula equal to Consumer Price Index +3%. CORRELATION TO THE STRATEGIC PLAN: The recommended action contributes to the fulfillment of the City's Strategic Plan Goal B: Public Safety and Protection of Assets by ensuring Tustin is an attractive and well -maintained community in which people feel pride. Docusign Envelope ID: 57D6COCO-360E-445D-BE3A-A5077108520D City Council Agenda Report City Ballots for Tustin Landscape Lighting Reassessment District 2025 November 4, 2025 Page 2 BACKGROUND AND DISCUSSION: On October 7, 2025, the City Council adopted Resolution No. 2025-59, initiating formation of the Tustin Landscape and Lighting Reassessment District 2025, approving the Engineer's Report, ordering a property owner official assessment ballot proceeding and setting a Public Hearing for December 2, 2025, to consider establishing the proposed reassessment district. Proposition 218 requires that all non-exempt properties owned by public agencies be assessed on an equivalent basis as private properties. Exempt properties (i.e., those for which an assessment is not levied) include public streets, public medians, and drainage facilities. A total of 21 City -owned parcels, including all park sites and Fire Station 47, will be assessed. Attachment 1 provides a summary of these parcels, showing both current and proposed assessments for the five-year assessment schedule ending Fiscal Year 2030-31. Beginning Fiscal Year 2031-32, assessments will be increased by a defined formula of CPI +3%. On October 17, 2025, 5,407 ballots were mailed to all property owners within the boundaries of the Tustin Landscape and Lighting Reassessment District 2025 to vote on whether to support or oppose forming a new assessment district, which, if approved, would replace the existing assessment district. As a property owner within the District, the City received 21 ballots representing total proposed assessments of $16,453.22 beginning in Fiscal Year 2026-27. The City's share represents approximately 1.69% of the total proposed district assessments of $975,811 for Fiscal Year 2026-27. Staff recommends the City Council authorize the City Manager to cast ballots in favor of the proposed reassessment district. Following the Public Hearing on December 2, 2025, ballots will be tabulated to determine whether property owners within the proposed district support its formation.
