SCHINDLER, CITY MANAGER FROM:MICHAELGRISSO, DIRECTOR OF PUBLIC WORKS SUBJECT:APPROVEADMINISTERING AGENCY-STATE MASTER AGREEMENT FOR FEDERALLY FUNDED TRANSPORTATION PROJECTS SUMMARY: Adoption of Resolution No. 26-03will approve Master Agreement No. 12-5271F15 between the City of Tustin and the State of California as a requirement for obtaining federal funding for eligibleCity transportation projects. In conjunction with the Master Agreement, adoption of Resolution No. 26-04will authorize the Director of Public Works or City Engineer to executevarious documents required by the California Department of Transportation to process and obtain federal and/or state fundsfor eligible projects. RECOMMENDATION: It is recommended that the City Council: 1.Adopt Resolution No. 26-03approving Administering Agency-State Master Agreement No. 12-5271F15 for Federal-Aid Projects; and 2.Adopt Resolution No. 26-04authorizing the Director of Public Works or City Engineer to sign various documents required bythe California Department of Transportation for federal and/or state-fundedtransportation improvement projects. FISCAL IMPACT: There is nodirectfiscal impact associated with the recommended actions. Adoption of Resolution No. 26-03 and Resolution No. 26-04 arerequired administrative actions thatwill enable the City to receive reimbursement and future allocations of federal transportation funds for eligible projects. CORRELATION TO THE STRATEGIC PLAN: Approval of the Master Agreementcontributes to the fulfillment of the City’s Strategic Plan Goal B: Public Safety and Protection of Assets. Specifically, transportation projects utilizing City Council AgendaReport Administering Agency-State MasterAgreement for Federal-Aid Projects January20, 2026 Page2 federal fundssupportStrategy#5 which among other items, is to ensure continuousmaintenance and improvement of transportation facilities. BACKGROUND AND DISCUSSION: The California Department of Transportation (Caltrans) requires agencies to enter into a Master Agreement to receive federal funding foreligibleCity transportation projects.The agreement outlines the rules and regulations governingfederalgrants.The previous Master Agreementbetween the City and Caltranswas approved on November 3, 2006. Due to changes in regulations and policies,Caltransisrequiring the City update andexecute a new master agreement. Caltrans also requires agencies to designate and authorize an individual via resolutionto execute project documents on behalf of the agency before receiving federal or state funds. Adoption of Resolution No. 26-04authorizesthe Director of Public Works or City Engineer toexecute program documentsandprevent delays in processing time-sensitive federal documents.Projectdocuments include a Program Supplement Agreement for theMain Street Improvements Project andwillincludefuturedocuments and agreements forprojects recently awardedfederal grants, such as the Tustin Ranch Road Pedestrian Bridge Project, the Jamboree Road Improvements from Interstate 5 to Portola ParkwayProject, and the Red Hill Avenue Improvements from Sycamore Avenue to Bryan Avenue Project, among others. It is recommended that the City Council adopt Resolution No. 26-03approving Administering Agency-StateMasterAgreementNo. 12-5271F15for Federal-Aid Projects and Resolution No. 26-04authorizing the Director of Public Works or City Engineer to sign, on behalf of the City of Tustin, various documents required by Caltransto process and obtain federalor state funds for eligible City projects. _________________________ Michael Grisso Director of Public Works Attachments: 1.Administering Agency-State Master Agreement No. 12-5271F15 2.Resolution No. 26-03 3.Resolution No. 26-04 ATTACHMENT 1 Administering Agency-State Master Agreement No. 12-5271F15 ATTACHMENT 2 Resolution No. 26-03 RESOLUTION NO. 26-03 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING ADMINISTERING AGENCY-STATE MASTER AGREEMENT NO. 12-5271F15 FOR FEDERAL-AID PROJECTS WHEREAS,the Legislature of the State of California has enacted legislation by which certain federal-aid funds may be made available for use on local transportation related projects of public entities qualified to act as recipients of these federal-aid funds in accordance with the intent of federal law; and WHEREAS, the City of Tustin is eligible to receive federal funding for certain transportation projects through the California Department of Transportation; and WHEREAS, it is the intention of the City of Tustin to use federal funds for the construction of certain City transportation projects; and WHEREAS, before federal funds will be made available for a specific program project, the City, as an administering agency, and the State of California are required to enter into an agreement to establish terms and conditions applicable to the administering agency when receiving federal funds for a designated project facility and to the subsequent operation and maintenance of that completed facility. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tustin hereby approves Administering Agency-State Master Agreement No. 12- 5271F15. YASUDA, City Clerk ______________________ Resolution 26-03 Page 2 of 2 Attachment No. 3 Resolution No. 26-04 RESOLUTION NO. 26-04 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING THE DIRECTOR OF PUBLIC WORKS AND CITY ENGINEER TO SIGN VARIOUS DOCUMENTS REQUIRED BY THE CALIFORNIA DEPARTMENT OF TRANSPORTATION FOR FEDERAL AND/OR STATE FUNDED TRANSPORTATION IMPROVEMENT PROJECTS WHEREAS,it is the intentionof the City of Tustin to use federal and/or state funds for certain City transportation improvement projects; and WHEREAS, the City is eligible to receive federal and/or state funding for certain transportation projects, through the California Department of Transportation; and WHEREAS, Master Agreements, Program Supplemental Agreements, Fund Exchange Agreements and/or Fund Transfer Agreements need to be executed with the California Department of Transportation before such funds could be claimed; and WHEREAS, the City wishes to delegate authorization to execute these agreements and any amendments thereto. NOW, THEREFORE, BE IT RESOLVED that the Director of Public Works and the City Engineer are each hereby authorized to execute on behalf of the City of Tustin all Master Agreements, Program Supplemental Agreements, Fund Exchange Agreements, Fund Transfer Agreements and/or any amendments thereto with the California Department of Transportation.
