HomeMy WebLinkAbout10 RESOLUTION ADOPTING THE CITYWIDE COMPREHENSIVE FEE SCHEDULE AND COST ALLOCATION PLAN RESOLUTION NO. 26-05 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ESTABLISHING AND ADOPTING NEWDEVELOPMENT PROCESSING FEES AND OTHER CITY RATES, CHARGES, AND USER FEES FOR VARIOUS GOVERNMENT SERVICES The City Council of the City of Tustin, California, hereby finds, determines, declares, and resolves as follows: WHEREAS, pursuant to the provisions of the California Constitution and the laws of the State of California, the City of Tustin is authorized to adopt and implement fees, rates, and charges for municipal services provided that such fees, rates, and charges do not exceed the estimated reasonable cost of providing such services; and WHEREAS, the City retained Willdan Financial Services to review and conduct an independent, detailed analysis of City Services, the cost reasonably borne by providing those services, the beneficiaries of those services, and the revenues produced by those paying fees for those services, and to prepare a cost allocation plan, an user fee study, and report setting forth the specific amount of user fees, rates, and charges; and WHEREAS, Willdan Financial Services prepared the Cost Allocation Plan and a Comprehensive User Fee Study (collectively “Studies”) dated January 2026 and on file in the City Clerk’s Office, are incorporated hereby reference. The Studies list the applicable direct and indirect costs for certain services provided by the City, describe the reasonable relationship between fees, rates, and charges and the services provided by the City, and set forth the time and method for the payment of the fees, rates, and charges; and WHEREAS, the City Council hereby establishes, adjusts, and increases the fees, rates, and charges for the items identified in the Proposed Comprehensive User Fee Schedule (“Fee Schedule”). The City Council hereby finds that, where applicable, the fees, rates and charges will not exceed the cost of providing the service to which such fees apply. The fees adopted hereunder are based upon the actual cost to the City of providing the service or facility for which the fee is charged. Calculation of the fees is based upon the Studies conducted by Willdan; and WHEREAS, pursuant to Government Code Section 66014, 66017, and 66018, the specific user fees to be charged for certain services must be adopted by Resolution, following notice and Public Hearing; and WHEREAS, a notice of Public Hearing has been given pursuant to Government Code Section 6062a, oral and written presentations have been made and received, and the required Public Hearing has been held; and WHEREAS, all legal prerequisites to the adoption of this Resolution have occurred. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. Adoption and Incorporation of Recitals. The recitals set forth above are true and correct and are incorporated by reference herein. SECTION 2. Adoption of User Fees.The City Council hereby approves and adopts the2026fees set forth in the Proposed Fee Schedule, which is attached hereto as Exhibit “A” and incorporated herein by reference; the City Council finds that the user fees and charges established therein do not exceed the estimated reasonable cost of providing the service for which the fee is levied. SECTION 3. City Manager’s Authority. The City Council hereby authorizes the City Manager or designee to interpret the provisions of this Resolution and the attached Fee Schedule for purposes of resolving ambiguities. The City Manager shall have the authority to authorize and require reasonable compensation for the temporary use of Cityproperty or receipt of City services not otherwise provided for in this Resolution or other applicable resolutions or ordinances. Such compensation shall be based upon the City’s fully burdened hourly rates or reasonable cost recovery as described in the Studies. SECTION 4. Wavier and Reduction of Fees. The City Council further authorizes the City Manager, at his/her discretion, to waive or reduce the processing fees and other user rates, charges, and fees set forth in the Comprehensive Fee Schedule on a case- by-case basis provided the City Manager commits to writing the reason(s) why any such waiver or reduction provides a public benefit including, but not limited to, the promotion of public health, safety, and welfare. SECTION 5. Effective Date. The user fees and charges established pursuant to this Resolution shall take effecton April1, 2026. SECTION 6. Annual Update. The City Council hereby authorizes and directs the City’s Finance Director to annually review and, as appropriate, recommend to the City Council approval of an increase of the fees set forth in the Comprehensive Fee Schedule in accordance with the Consumer Price Index (CPI) reported in the month of February/March for the corresponding year for the Los Angeles-Long Beach-Anaheim area for all Urban Consumers. SECTION 7. Environmental Exemption. The adoption of this Resolution is exempt from the California Environmental Quality Act (“CEQA”) pursuant to Section 15273 of CEQA Guidelines and Section 21080(b)(8) of the Public Resources Code; and in accordance with such determination, City staff is hereby directed to file a Notice of Exemption upon adoption of this Resolution. SECTION 8. Severability.If any user fee, rate, or charge adopted by this Resolution is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such fee, rate, or charge shall be deemed a separate, distinct, and independent provision of this Resolution, and such holding shall not affect /msd/ the validity of the remaining user fees, rate, and charges adopted herein. The City Council hereby declares that it would have adopted the Resolution and each section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions thereof be declared invalid or unconstitutional. MINOR CUP:New uses in combination with new construction or existing development with 5,000 square feet or less of floor area, new uses within existing structures, expanded or modified existing uses, signs, new apartment or condominium project with 3 dwelling units or less, second single family dwellings. DESIGN REVIEW MAJOR NEW: New development in excess of 5,000 square feet of floor area or building relocations. MINOR NEW: New development with less than 5,000 square feet of floor area. 1772842.1 MAJOR REMODEL:Modifications to existing structures or site which include an increase in existing floor area in excess of 50%, and/or existing façade or site modifications which constitute a change in 3 or more major design elements on a building elevation or site which result in a complete façade upgrade. Definition of an element includes windows, doors, colors, materials, parking lot changes, etc. MINOR REMODEL: Modifications to existing structures which include an increase in existing floor area of 50% or less (including expansions for outdoor dining), and/or existing façade or site modifications which constitute a change in 3 or less major design elements which do not result in a complete façade upgrade, single family homes not part of a subdivision, residential room additions, and new or modified accessory structures associated with existing development. VARIANCES MAJOR VARIANCE: New development that deviates from a specific development standard, all existing development which deviates from a standard by more than 10%. MINOR VARIANCE: Existing development that deviates from a specific development standard by 10% or less, new single-family homes not part of a subdivision, or projects where the site will contain less than 3 new apartments or new condominiums. Footnotes: (1) Any fee category not established by the fee schedule shall be determined by the Community Development Director. 1772842.1 FINANCE BUSINESS LICENSE TAX FEES (Ordinance No. 1270; 2003) Every person who engages in business within the City of Tustin and/or has an establishedplace ofbusiness within the City limits shall pay a license tax based upon the gross receipts of business done within the City, unless otherwise specified in the City Code (see enumerated business below). Gross receipts shall be based on the prior years' receipts, or in the case of a new business, calculated on current year's estimates. Payment of business license fee and/or approval of business license does not waive or preclude any other licenses or permits required by Tustin City Code. The license tax period is calendar year January 1 through December 31. Pro-rated fees for new businesses are effective April 1, July 1 and October 1. For failure to pay the license tax when due, a penalty will be added of twenty-five percent (25%) of such license tax on the last day of each month after the due date thereof, provided that the amount of such penalty shall not exceed one hundred percent (100%) of the amount of the license tax due.
