The City follows' of the City of Tustin does hereby resolve as follows' . Council of the City of Tustin does hereby determine as A That a proper application, (Use Permit No. 85-1) was filed on behalf of Leonard Construction, requesting authorization to install a 50 square foot tenant identification pole type sign at 14460 NewPort Avenue. That a public hearing before the Planning Commission was duly cal 1 ed, noti ced and held on said appl i cati on. C · D That the submt tted, Planning Commission did deny Use Permit 85-1 approving a 50 square foot monument sign instead. That Michael Lepore, on behalf of appeal the action of the Commission to Leonard Constructi on the City Counci 1. E · That a public hearing before the City Council noticed and held on said appeal. . was duly called, F That based on new testimony presented by the project applicant and other concerned parties, as well as concern over potential visibility problems associated with a monument sign, the Council finds that a pole type sign is justified and overturns the Planning Commission action on Use Permit 85-1. G That the establishment, maintenance, and operation of the use applied for will not, under the circumstances of this case, be detrimental to the heal th, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, evidenced bythe following findings' 1. That a pole type sign as applied for is allowed subject to approval of a Conditional Use Permit. That to avoid potential traffic visibility impairment, a monument utilized at the subject location. and/or pedestrian sign should not be He That the establishment, maintenance, and operation of the use applied for will not injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. .. ... The pole cover shall the type and color be treated with a tex-coat material tomatch · used on the structure at subject location; C. The existing "Little Kings" pole sign must be removed prior to issuance of sign permits authorizing the proposed sign. D. The height of the sign shall not exceed the height of the structure being served, and shall comply with all other provisions of Tustin Sign Ordinance 684.
