2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, FINDING THAT THE USE OF
3 TAXES ALLOCATED FROM THE TOWN CENTER PROJECT
AREA FOR THE PURPOSE OF REHABILITATING THE
4 PROPERTY AT 1361 EL CAMINO REAL AND CONVERTING
THE APARTMENTS INTO OWNERSHIP UNITS WILL BE OF
5 BENEFIT TO THE PROJECT.
6 The City Council of the City of Tustin, California, does
hereby resolve as follows:

WHEREAS, the Tustin 'Community Redevelopment Agency
8 (the "Agency") has adopted a Redevelopment Plan (the
"Redevelopment Plan") for the Town Center Project Area
9 (the "Project"); and
10 WHEREAS, the Redevelopment Plan provides for the
allocation of taxes from the Project Area; and

WHEREAS, Section 33445 of the Health and Safety Code
12 provides that Redevelopment tax increment funds may be
used outside of a project area if a finding is made by
13 action of the Agency and the City Council that such use
will be of benefit to the adjacent Project Area and there
14 are no other reasonable means of financing the
acquisition and cost of improvements; and

WHEREAS, the City of Tustin has determined that
16 rehabilitation of the property at 1361 E1 Camino Real and
its conversioninto ownership units would benefit the
17 Town Center Project Area but is outside the Town Center
Redevelopment Project Area; and
WHEREAS, the Agency's Town Center Redevelopment
19 Project Area, Five Year Town Center Project
Implementation Plan' and The Agency's Comprehensive
20 Housing Affordability Strategy authorizes the
rehabilitation of older housing units and encourages the
21 creation of home ownership opportunities in the Town
Center Project Area.

23 NOW, THEREFORE, the City Council of the City of Tustin,
California, does hereby find and resolve as.follows:

Section 1: ~The City Council hereby finds that the
25 use of taxes allocated from the Town Center Project Area
to be used outside the boundaries of the Project Area for
26 the purpose of the rehabilitation of housing units at
1361 E1 Camino Real and its conversion to home ownership
27 will be of direct benefit to the Town Center Project Area
and that no other reasonable means of financing for said
28 project are available in the Community.
