3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, RATIFYING ITS DECISION OF JULY 1, 1996 TO
4 APPROVE AMENDMENT TO VESTING TENTATIVE TRACT MAP
13908.

The City Council of the City of Tustin does. hereby resolve as
6 follows:
7 I. The City Council finds and determines as follows:
8 A. That Amendment to Vesting Tentative Tract Map 13908
was. submitted to the Planning Commission and City
9 Council by Bramalea California for consideration;
10 B. That a public hearing was duly called, noticed and
held for said Amendment by the Planning.Commission
11 on April 8, 1996 and continued to April 22, 1996,
May 13 and 28i 1996, and June 10, 1996; and by the
12 City Council on July 1, 1996.
13 C. That neighborhood meetings were conducted on April
15 and 24, 1996 and May 20 and 28, 1996 with the
14 applicant, interested residents and City staff in
an effort to resolve outstanding concerns related
15 to the project;
16 D. That on July 1, 1996, the City Council took action
to approve Amendment to Vesting Tentative Tract
17 13908;,
18 E. That an Environmental Impact Report EIR 85-2, as
amended,- for the East Tustin Specific Plan has been
19 certified in conformance with the requirements of
the California'Environmental Quality Act for the
20 subject project;
21 F. That the proposed subdivision is in conformance
with the Tustin General Plan, adopted East Tustin
22 Specific Plan, Development Agreement and
Subdivision Map Act;

G. The .9894 acres of parkland required for this
24 development was previously dedicated with
recordation of Tract 12870;

3 H. That the City has reviewed the status of the School
Facilities Agreements between the Irvine Company
4 and the Tustin Unified School District for the
impact of Amendment to Vesting Tentative Tract
5 13908 on'School District facilities, and changes in
State law. Impacts associated with this approval
6 on School District facilities are adequately
addressed;

I. That the site is physically suitable for the type
8 of development proposed;
9 J. That the site is physically suitable for the
proposed density of development;

K. That the design of the subdivision or the proposed
11 improvements are not likely to cause substantial
environmental damage or substantially and avoidably
12 injure fish or wildlife in their habitat;
13 L. That the design of the subdivision or the type of
improvements proposed will non conflict with
14 easement acquired by the public at large, for
access through or use of the property within the
15 proposed subdivision; and
16 M. That the design of the subdivision or the types of
improvements proposed are not likely to cause
17 serious public health problems.
18 II. The City Council hereby ratifies its decision of July 1,
1996 to approve Amendment to Vesting Tentative Tract Map
19 13908 to update three Original product types and add two
new product types to the buildout of the previously
20 approved development on Tract 13908, subject to the
Conditions contained in Exhibit A, attached hereto.

EXHIBIT A
AMENDMENT TO VESTING TENTATIVE TRACT 13908
RESOLUTION NO. 96-80
CONDITIONS OF APPROVAL
GENERAL
*** 1.1 Condition 10.6 of Planning Commission Resolution No. 2739
is hereby revised to read as follows:
"Prior to the release of building permits, all
conditions of approval of Design Review 89-46 and
Design Review 95-042 for the subject project Shall
be complied with as shown in Exhibit A attached to
Planning Commission Resolution No. 2738 and City
Council Resolution No. 96-79"
All other conditions of Planning Commission Resolution
No. 2739 remain in full force and effect.
(1) 1o2 Unless otherwise specified, the conditions contained in
this Exhibit shall be complied with prior to the issuance
of any building permits for the project, subject to
review and approval by the Community Development
Department.
(1) 1~3 The subject project approval shall become null and void
unless permits for the proposed project are issued within
twenty four (24) months of the date of this Exhibit and
substantial construction is underway. Time extensions
may be granted if a written request is received by the
Community Development Department within thirty (30) days
prior to expiration.
(1) 1o4 Approval of Amendment to Vesting Tentative Tract 13908 is
contingent upon the applicant and property owner signing
and returning an "Agreement to Conditions Imposed" form
as established by the Director of Community Development.
(1) 1o5 The applicant shall hold and defend the'City of Tustin
harmless for all claims and liabilities arising out of
City's approval of the entitlement process for this
project.
