2. APPROVAL OF MINUTES — THE SPECIAL CLOSED SESSION MEETING AND
REGULAR MEETING OF THE CITY COUNCIL HELD ON APRIL 7, 2026.
Motion: The City Council approved the Action Minutes of the City Council Special
Closed Session Meeting and the Regular Meeting held on April 7, 2026.
3. RATIFICATION OF PAYROLL AND DEMANDS
The City Council has approved the use of Government Code Section 37208 to
expedite the payment of City of Tustin obligations that are in accordance with the
approved budget or continued operations authorizations.
Motion: The City Council approved Payroll in the amount of $1,138,859.73 and
Demands in the amount of $3,914,794.08.

4. 2026 CITYWIDE RECORDS RETENTION SCHEDULE AMENDMENT
Staff proposed the adoption of a revised Records Retention Schedule.
Motion: The City Council adopted Resolution No. 26-18 (Attachment 1), amending
the City's Records Retention Schedule.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA,
ADOPTING AN AMENDED RECORDS RETENTION SCHEDULE, AUTHORIZING
THE DESTRUCTION OF CERTAIN CITY RECORDS, AND RESCINDING
PREVIOUS RESOLUTION NO. 25-32
Fiscal Impact: There was no fiscal impact associated with this item.
5. REINSTATEMENT AND AMENDMENT OF EXCLUSIVE NEGOTIATING
AGREEMENT WITH CD-CW (TUSTIN) LLC FOR A PORTION OF LAND AT
TUSTIN LEGACY
Request for approval to reinstate, amend and extend the Exclusive Negotiating
Agreement with CD-CW (Tustin) LLC to continue the negotiating period for the
disposition and development of a portion of Disposition Area 8B at Tustin Legacy in
order to facilitate a close of escrow of the property by the end of this year. The
extension would provide an initial 60-day period for CD-CW (Tustin) LLC to secure
an equity partner for the project with an executed Letter of Intent. Further extensions
of the Exclusive Negotiating Agreement through October 2026 would be permitted,
as needed, for CD-CW (Tustin) LLC to achieve milestones consisting of entitlement
approvals, completion of DDA negotiations and execution, and completion of
construction plans for permit review submittal.
Motion: The City Council took the following action:
Authorized the City Manager to execute a reinstatement and amendment to
the Exclusive Negotiating Agreement reflecting the extensions as requested
by CD-CW (Tustin) LLC, established a milestone schedule of performance for
CD-CW (Tustin) LLC to adhere to, and make any non -substantive additions or
modifications as may be deemed necessary and/or recommended by the
City's special real estate counsel or the City Attorney.
Fiscal Impact: The Exclusive Negotiating Agreement will be amended to require a
$300,000 extension deposit for the first 60-day extension and a $100,000 monthly
extension deposit for the remainder of the ENA Negotiating Period. The extension
deposits are non-refundable, however, if the Disposition and Development
Agreement is executed and close of escrow occurs, the extension deposits (without
interest accrued) are applicable to the purchase price and the purchase price deposit.

CD-CW (Tustin) LLC also has a deposit account with the City that will continue to
fund the City transaction expenses incurred by staff and third -party consultants
including the retention of legal counsel associated with the negotiation and drafting
of the transaction documents.
6. 2025 YEAR IN REVIEW — COMMUNITY DEVELOPMENT
The 2025 Year in Review summarizes the Community Development Department's
programs and activities conducted from January 2025 through December 2025.
Motion: It was moved by Council Member Fink and seconded by Mayor Pro Tern
Schnell that the City Council received and filed the report.

7. AWARD CONSTRUCTION CONTRACT FOR THE HEIDEMAN SCHOOL PARK
PROJECT
Staff is requesting the City Council award a construction contract to the lowest
responsive/responsible bidder for the Heideman School Park Project. Construction
is anticipated to begin June 2026, with completion estimated in Summer 2027.
Motion: It was moved by Council Member Nielsen and seconded by Mayor Lumbard
that the City Council:
1. Awarded a construction contract to the lowest responsive/responsible bidder,
Horizons Construction Company Int'I Inc. in the amount of $6,324,767.70 for
the Heideman School Park Project and authorized the Mayor and the City
Clerk to execute the contract documents on behalf of the City; and
2. Appropriated $2,583,196 from Park Development Fund (Fund 131).

Fiscal Impact: The adopted Fiscal Year 2025-2026 Capital Improvement Program
budget includes funding in the amount of $5,042,804 from Proposition 68 Statewide
Parks Program Grant for the Heideman School Park project. Of this grant amount,
$200,000 has been spent on pre -construction activities and the remaining
$4,842,804 is available for the construction phase.

The total construction cost as outlined below is $7,426,000. The requested
appropriation of $2,583,196 is required to fully fund the Heideman School Park
Project, the Park Development Fund (Fund 131) has sufficient funds to support the
above appropriation request.

8. COMMUNITY DEVELOPMENT BLOCK GRANT ANNUAL ACTION PLAN FOR
PROGRAM YEAR 2026-2027
Public Hearing opened at 6:32 p.m.
Senior Management Analyst Adrianne DiLeva provided a PowerPoint presentation.
The Housing and Community Development Act of 1974 established the Community
Development Block Grant program to provide federal funding to local communities
for viable urban development, including decent housing, suitable living environments,
and expanded economic opportunities for low- and moderate -income persons.
Every five years, the City of Tustin prepares a five-year Consolidated Plan identifying
local needs related to affordable housing, supportive services, community
development, and economic opportunity. The attached Annual Action Plan
implements the Consolidated Plan's goals and objectives for the 2026-27 program
year and acts as the City's application for Community Development Block Grant
funding.

COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDS FOR
SUBMISSION TO THE U.S. DEPARTMENT OF HOUSING AND URBAN
DEVELOPMENT
Fiscal Impact: The proposed 2026-27 Annual Action Plan programs and
expenditures will be funded through the Community Development Block Grant. The
City anticipates a Program Year 2026-27 allocation of $772,043. No General Fund
impact is anticipated.
9. CONDUIT FINANCING FOR USA TUSTIN LEGACY 5 & 6 APARTMENTS
PROJECT

Conduct a public hearing under the Tax and Equity Fiscal Responsibility Act
("TEFRA") on April 21, 2026 in connection with the proposed issuance of revenue

RESOLUTION NO. 26-19
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN APPROVING A
PLAN OF FINANCE INCLUDING THE ISSUANCE OF EXEMPT FACILITY BONDS
BY THE CALIFORNIA MUNICIPAL FINANCE AUTHORITY IN AN AGGREGATE
OUTSTANDING PRINCIPAL AMOUNT NOT TO EXCEED $80,000,000 TO
FINANCE AND REFINANCE A QUALIFIED RESIDENTIAL RENTAL PROJECT
FOR THE BENEFIT OF TUSTIN 738, L.P. (OR AN AFFILIATE), AND CERTAIN
OTHER MATTERS RELATING THERETO
Fiscal Impact: The Bonds to be issued by the CMFA for the Project will be the sole
responsibility of the borrower, Tustin 738, L.P., and the City will have no financial and
legal obligations, liability or responsibility for the Project or the repayment of the
Bonds for the financing of the Project. All financing documents with respect to the
issuance of the Bonds will contain clear disclaimers that the Bonds are not obligations
of the City of Tustin, the County of Orange, or the State of California but are to be
paid for solely from funds provided by the Borrower.
The Board of Directors of the California Foundation for Stronger Communities, a
California nonprofit public benefit corporation (the "Foundation"), acts as the Board
of Directors for the CMFA. Through its conduit issuance activities, the CMFA shares
a portion of the issuance fees it receives with its member communities and donates
a portion of these issuance fees to the Foundation for the support of local charities.
With respect to the City of Tustin, it is expected that a portion of the issuance fee
attributable to the City will be granted by the CMFA to the general fund of the City.
Such grant may be used for any lawful purpose of the City. The Borrower will be the
beneficiary of the CMFA's charitable donation through a 25% reduction in issuance
fees.

Announced the Main Street Per- and Polyfluoroalkyl Substances (PFAS) Water Treatment
Plant Improvement Project was selected as the recipient of the American Society of Civil
Engineers Orange County Branch as a 2026 Outstanding Water/Wastewater/Recycle
Water Treatment Project Award; this is a joint award with the Orange County Water District;

the City and the District will be recognized at the American Society of Civil Engineers
Orange County Branch Awards Dinner on the evening of May 6; the event invitation will be
extended to the members of City Council; congratulated the Public Works Department on
this achievement.
The City's Building Division, in cooperation with the City's Economic Development Division,
will host a free Accessibility Workshop tailored for architects, designers, and business
owners; the workshop will take place on April 27; the event will be offered both in person
and via Zoom and will help businesses understand accessibility requirements and the
resources available to assist them with any upgrades they may need.

Attended the Transportation Corridor Agencies Joint Meeting of the Board of Directors in
place of Mayor Pro Tern Schnell; discussed the 241/91 Express Connector Project and
assisted with facilitating approval of $5.9 million in funds for the project; meeting also
consisted of a budget workshop for Fiscal Year 2027, discussing the collection and
spending of funds, debt reduction, transactions, and revenues for the Foothill Eastern
Board.
April 14
Attended an Orange County Council of Scouting America Committee Meeting; covered
restructuring operational activities for the Scout Council for the coming year; expressed his
excitement about the planning and for the programs ahead.
April 15
Attended the Tustin Host Lions Club General Meeting; reviewed results of the Free Vision
Screening and Recycled Glasses Event; 335 individuals were served, and almost all
participants left with a free pair of glasses; partnered also with CalOptima for the event to
offer additional services to attendees.
April 16
Attended the Veterans Ad Hoc Committee meeting with Mayor Pro Tern Schnell.
April 20
Attended and assisted with the Tustin Community Foundation's Superheroes event;
enjoyed assisting with putting superhero capes on honorees; had fun and enjoyed
participating.

Attended the Tustin Community Foundation's Superheroes event; was a great event.
April 16
Attended the Tustin Area Council Fine Arts Student Art Invitational; tremendous and
amazing artwork by the students; Dr. Kathy Copeland, Tustin Unified School Board Member
was in attendance.
Attended the grand opening of the Own It Now Realty office in the Artz Building on Main
Street next to Good Society; noted that the Artz Building is filling up with new tenants; there
are still more new businesses to come.
Hosted a community meeting at Baskin Robbins; noted is trying to host community meetings
on a monthly basis to allow residents to share thoughts and feedback; added that he
received great input, especially with regard to the Active Transportation Plan and the
Enderle Center becoming Campo on 17th Street; elaborated on the project, clarifying that,
though roughly 100 new residences will be included, that the core of the Center will remain
and that Zov's will return.
Addressed comments he received related to the Active Transportation Plan and a -bike
concerns, emphasizing that staff is working on an a -bike ordinance; identified that an Active
Transportation Plan and a -bike plan will support safety for all residents and visitors;
discussed comments made related to difficulties related to bicyclist signaling at intersections
and emphasized bicycle safety; reiterated his belief in establishing an updated Active
Transportation Plan.
Expressed his appreciation for residents' interest in a community reinvestment fund related
to the Bel Air Hotel; also expressed interest in providing city assistance to existing
resources, such as longstanding city businesses like Black Marlin and American Grub, who
have experienced hardship.
Spoke with members of the Arvida Book Company Foundation, the nonprofit arm of Arvida
Book Company, regarding funding for the Dolly Parton Imagination Library, which was part
of the community grants program that the Tustin Community Foundation awarded on April
20; noted he spoke to Mayor Lumbard about reaching out to the District Supervisors to
assist with discretionary funding; added that the program sends one book per month to
children ages 5 and under and costs $2.60 per month for printing and mailing each book,
with a State law which already covers half of the cost; the program is running in 44 other
counties in California but has not yet reached Orange County; hopes to get the program
running with the support of the City and the assistance of the Tustin Community Foundation
grant funding.

Addressed Vibrant Neighborhoods Tustin and thanked them for attending the meeting to
speak; added they were respectful, well-spoken, and gave a wonderful message;
encouraged the group to attend the upcoming Community Workshops at the Tustin
Community Center at The Market Place to provide input on future plans for Tustin Legacy;

noted that the City has opportunities in the Legacy area for transportation developments;
hoped for the City to have the opportunity to hear their input at the Community Workshops
and was glad to hear their feedback.
Addressed the community reinvestment fund in response to a public comment provided by
Veronica Ocon; explained the City had a Redevelopment Agency, which was dissolved in
2012 along with all other similar agencies due to State legislation; identified that the Bel Air
Hotel was considered as a potential redevelopment opportunity for affordable housing prior
to 2012; encouraged the public to call in illicit activity who expressed interest in the City
establishing a fund to address problematic places in Tustin and added that there are tools
they can employ if the property becomes a source of difficulty for the City, including, but not
limited to, working with the owner to invest in the property.

• Attended the Pacific Center East Ad Hoc Committee meeting with Mayor Pro Tern
Schnell.
• Attended an Orange County Water Association presentation on the City of Tustin's
new Per- and Polyfluoroalkyl Substances (PFAS) system provided by Water
Services Manager Michael Chandler and joined Public Works Director Michael
Grisso to view the presentation.

Thanked Council Member Nielsen for attending the Transportation Corridor Agencies Joint
Meeting of the Board of Directors in his place while he was out of town.
April 14
Visited the Orange County Rescue Mission with Mayor Lumbard; took a tour of their new
tattoo removal clinic; noted that the space and equipment were very impressive and that
the time from dermatologists and laser technicians to see patients is generously donated;
added that the CEO of the Orange County Rescue Mission explained that the tattoo removal
process is a crucial part of the recovery journey to remove past memories.
April 18
Attended the public mural painting at the Tustin Family and Youth Center; noted that he
spent time with Parks and Recreation Director Chad Clanton and Mayor Lumbard and his
son; explained that the mural was a paint -by -numbers style, featuring outlined pictures with
numbers that indicated which colors to apply; spent several hours painting La Chickies,
which was a chicken drinking coffee; lots of people participated; commented that it was a
great day.
April 20
Attend the Tustin Community Foundation's Superheroes of Tustin event; commented the
event dovetails nicely with the Community Development Block Grants and the reflection of
Tustin as a city with a big heart for giving back.

Attended the Tustin Buick GMC Ribbon Cutting at the Tustin Auto Mall.
Announced the upcoming Community Workshop at the Tustin Community Center at The
Market Place from 5-7 p.m.; joined Council Member Gallagher in encouraging community
members to attend and provide their input for the future of Tustin Legacy.
April 23
Announced that Coffee with a Cop will take place at McDonald's on 14601 Red Hill Avenue
from 9-10:30 a.m.; encouraged meeting attendees to attend and get to know their local
Tustin police officers.
Congratulated the Transportation Corridor Agencies for being awarded the 2025
Organization of the Year by the California Transportation Foundation; the Foundation
acknowledged the Transportation Corridor Agencies' leadership across a range of
initiatives, including the 241/91 express connector, and were commended for their strong
fiscal management, strong credit rating, and innovations in toll operations; noted he is proud
to be involved with the organization.

Attended the Orange County Fire Authority Budget and Finance Committee meeting; noted
that the agency continues to be in great fiscal shape; thanked all who work for the agency.
April 11 and 12
Attended the Heritage Elementary annual musical; shared that his son participated and that

as the Mayor of Whoville and congratulated him on a great performance.
April 18
Attended the painting of the community mural at the Tustin Family and Youth Center;
thanked staff for facilitating the public participation in the mural painting; noted that Mayor
Pro Tern Schnell and other community members were able to contribute to their mural; was
grateful for staff's organization to provide the community with a mural for the community to
enjoy for years to come.
Announced the following upcoming events.
Community Workshops at the Tustin Community Center at The Market Place
Announced that the City of Tustin will host two Community Workshops on April 22 and 23
from 5-7 p.m. at the Tustin Community Center at The Market Place to help shape the future
of Tustin Legacy; noted that these workshops will allow the public to provide their input
about what they would like the future of Tustin Legacy to look like; emphasized that all public
opinions are welcome and attendance is encouraged.
Coffee with a Cop
Shared that Coffee with a Cop will take place on Thursday, April 23 from 9-10:30 a.m. at
McDonald's at 14601 Red Hill Avenue.

Viva Tustin
Announced that the Viva Tustin event will take place on Friday, May 1 from 3-6 p.m. at

Youth Talent Show Applications Due
Noted that applications for the upcoming Youth Talent Show will be accepted through
Monday, April 20, with tryouts taking place Saturday, May 16 and the main event taking
place Saturday, June 13 at 2:00 p.m. at the Community Center at the Market Place; for
