SCHINDLER, CITY MANAGER MICHAEL GRISSO, DIRECTOR OF PUBLIC WORKS ACCEPT IMPROVEMENTS AND FILE A NOTICE OF COMPLETION FOR THE TUSTIN LEGACY NEIGHBORHOOD “D” SOUTH PHASE 2 – PACKAGE 1 INFRASTRUCTURE CONSTRUCTION PROJECT SUMMARY: Construction of the Tustin Legacy Neighborhood “D” South Phase 2 – Package 1 and South Hangar Infrastructure project has been completed to the satisfaction of the City Engineer and is now ready for City Council acceptance. RECOMMENDATION: It is recommended that the City Council: 1.Adopt Resolution No. 26-50 accepting the improvement of the Tustin Legacy Neighborhood “D” South Phase 2 Infrastructure Construction Project – Package 1 and the civil portion of the work for the South Hangar Renovation; and 2.Authorize the City Engineer to execute and file the Notice of Completion with the Orange County Recorder’s Office. FISCAL IMPACT: The final project construction cost was $9,564,523.94, approximately 9% above the original contract amount of $8,771,596.00. Approved contract change orders totaled $792,927.94 in additional contract costs, of which $674,623 was specific to Southern California Edison field redesign requirements and delays. Sufficient funds were budgeted and appropriated in the Capital Improvement Program using the Tustin Legacy Land Sale Proceeds and Tustin Legacy Backbone Program funds. Specifically, the project supports Strategy 1, which among other items, is to develop critical phases of Tustin Legacy. The civil portion of the work for the South Hangar project also contributes to fulfilling Goal B: Public Safety and Protection of Assets, specifically the project implementation of Strategy 5, which is to create and implement a plan to protect the City’s public assets. BACKGROUND AND DISCUSSION: Neighborhood “D” South Phase 2 is generally bounded by Airship Avenue, Warner Avenue, Compass Avenue, and Armstrong Avenue. The project scope of work included clearing and grubbing, grading, pedestrian bridge surcharge mounding, construction of storm drain, water, reclaimed water, sanitary sewer, and roadway improvements, as well as civil improvements to deliver electrical power to the South Hangar property for future potential use. On November 7, 2023, the City Council authorized the award of a construction contract to Boudreau Pipeline Corporation. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public works and improvement is found to be complete, and the same is hereby accepted. Said public works and improvement is more particularly described as follows: Tustin Legacy Neighborhood “D” South Phase 2 Infrastructure (CIP No. 70256) Construction Project – Package #1 and the civil portion of the work for the South Hangar Renovation (CIP No. 10076) BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is hereby authorized to execute and file a Notice of Completion for the acceptance of said public works and improvement described herein as required by law.
