YASUDA, CITY CLERK SUBJECT: 2026 BIENNIAL CONFLICT OF INTEREST CODE REVIEW SUMMARY: Biennially, the City is required to review the list of designated positions identified in the Conflict of Interest Code to ensure it accurately reflects the City's current organizational structure and designated positions. RECOMMENDATION: That the City Council adopt Resolution No. 26-53. FISCAL IMPACT: There is no fiscal impact associated with this item. CORRELATION TO THE STRATEGIC PLAN: Accurate disclosure of the designated positions in the City’s Conflict of Interest Code contributes to a core value of the Strategic Plan – Transparency. The biennial review ensures that the City’s Code accurately designates all positions that make or participate in making governmental decisions and helps to ensure public trust in government. BACKGROUND AND DISCUSSION: The Appendix (Designated Positions) of the City's Conflict of Interest Code identifies those officials and employees who are required to file Statements of Economic Interests (Form 700). Pursuant to Government Code requirements, the City conducts a biennial review of its Conflict of Interest Code to ensure that designated positions accurately reflect the City's current organizational structure and disclosure categories. Amendments may be necessary to incorporate newly created positions, revise existing classifications, or remove positions that are no longer utilized. Periodic updates to the Conflict of Interest Code ensure that disclosure requirements remain aligned with employees' assigned duties and decision-making responsibilities. Resolution No. 26-53 amends the Appendix (Designated Positions) of the City's Conflict of Interest Code. The proposed revisions include the addition, modification, and deletion of designated positions, as appropriate, and updates to the corresponding disclosure categories to ensure compliance with applicable conflict of interest laws and regulations. _____________________ Erica N. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Tustin that: Section 1. The foregoing recitals are true and correct and are incorporated by reference herein. Section 2. The Appendix of the Conflict of Interest Code of the City of Tustin, is hereby amended to reflect the position title changes and disclosure categories as noted in the exhibit. Section 3. The revised Appendix, attached hereto, is approved and the Conflict of Interest Code shall be modified accordingly. Section 4. Pursuant to the adopted Conflict of Interest Code of the City of Tustin, the City Council, as the Code-reviewing body, hereby instructs all persons occupying a Designated Position to file with the City Clerk a Statement of Economic Interests as required: assuming position, annually, and leaving position.
