SUBJECT: SECOND READING AND ADOPTION OF ORDINANCE NO. 1582
AMENDING TUSTIN CITY CODE CHAPTER 4, SECTION 1415 -
POWERS AND DUTIES GENERALLY
SUMMARY:
Adoption of Ordinance No. 1582 updates the Tustin City Code necessary to achieve
consistency with prior voter-authorized amendments to the City Code and with existing
practices established in the City’s Personnel Rules and Memoranda of Understanding.
RECOMMENDATION:
That the City Council have second reading by title only and adoption of Ordinance No.
1582.
FISCAL IMPACT:
There is no fiscal impact associated with this item.
CORRELATION TO THE STRATEGIC PLAN:
Updating the Tustin City Code to conform to the City’s established Personnel Rules and
the adopted MOUs with all City bargaining units supports Strategic Plan Goal E: to be a
high-performance organization with effective customer service provided by a professional
workforce.
BACKGROUND AND DISCUSSION:
On September 1, 2026, the City Council had first reading by title only of Ordinance No.

ORDINANCE NO. 1582
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA,
AMENDING CITY CODE CHAPTER 4, SECTION 1415 - POWERS AND DUTIES
GENERALLY
SECTION I: Subsection c (Powers as Director of Personnel) of Section 1415 (Powers
and Duties Generally) of Part 1 (City Administrator) of Chapter 4 (City Officers) of Article
1 (Administration) of the Tustin City Code is amended to read in its entirety as follows:
c It shall be the duty of the City Manager to act as Director of Personnel.
He shall have the authority to appoint, promote, discipline, demote, remove,
reassign, or dismiss all department heads, officers, and employees of the City,
except the City Attorney, subject to any and all applicable rules, regulations,
position allocations and financial appropriations. All department heads, officers,
and employees shall perform their duties subject to the direction of the City
Manager or that of the superior to whom the Manager may assign such officer or
employer. Provided, that the Manager may delegate to any other department
head, officer or employee the authority to hire or discharge any employees or
officers so designated by the Manager. For all department heads, officers and
employees, merit pay increases will be approved or denied by the City Manager.
SECTION II: If any section, subsection, subdivision, sentence, clause, phrase, word, or
portion of this Ordinance is, for any reason, held to be invalid or unconstitutional by the
decision of any court of competent jurisdiction, such decision shall not affect the validity
of the remaining portions of this Ordinance. The City Council hereby declares that it
would have adopted this Ordinance and each section, subsection, subdivision, sentence,
clause, phrase, word, or portion thereof, irrespective of the fact that any one or more
sections, subsections, subdivisions, sentences, clauses, phrases, words or portions
thereof be declared invalid or unconstitutional.
SECTION III: The Mayor shall sign and the City Clerk shall certify to the passage and
adoption of this Ordinance and shall cause the same, or the summary thereof, to be
published and posted pursuant to the provisions of law and this Ordinance shall take
effect thirty (30) days after adoption.
PASSED AND ADOPTED, at a regular meeting of the City Council for the City of
Tustin on this 15th day of September, 2026.
