Timeline
May 28, 2026: City received formal request of the property owner to vacate
Enderle Center Drive.
June 16,
2026: Pursuant
to CA Street &
Highway Code Sections 8320-8325,
the
City
Council
adopted
Resolution
No.
26-30 declaring
intent
to vacate.
July 28, 2026: Tustin Planning Commission Adopted Resolution No. 4552,
approving General Plan Conformity pursuant to Government Code 65402.
Sept. 15, 2026: Notice of
tonight's
Public Hearing
was advertised
in the
Tustin
News
and
posted
at
three
locations
within
Enderle
Center
Drive.
Findings
The City does not own the land in fee, which Endler Center Drive is constructed
upon.
The former Enderle Center Trust, now BWP Campo 1, LLC and Intracorp Socal-1
LLC, owns this land in fee.
Enderle Center Drive has been found unnecessary for present and prospective public
uses.
Vacation of Enderle Center Drive does not constitute a gift of public funds, as the
City operates the roadway via an access easement without ownership of property
Vacating the roadway reduces current and long-term financial obligations of the City
for routine maintenance.
California Street and Highway Code Section 8324
(a) At the hearing, the legislative body shall hear the evidence offered by
persons interested.
(b) If the legislative body finds, from all the evidence submitted, that the
street, highway, or public service easement described in the notice of hearing
or petition is unnecessary for present or prospective public use, the legislative
body may adopt a resolution vacating the street, highway, or public service
easement.
Recommendation
Adopt Resolution No. 26-49 ordering the vacation of Enderle Center Drive;
and
Authorize the City Manager to take all actions and execute agreements
necessary or appropriate to complete the vacation.
