implements Strategy #5, which among other items, is to ensure continuous maintenance
and improvement of transportation facilities.
BACKGROUND AND DISCUSSION:
Red Hill Avenue is a regionally significant principal arterial corridor, providing access for
residents, commuters, businesses, and regional travelers between Interstate 5 and
communities to the north, south, east and west. Within the project limits between Bryan
Avenue and Sycamore Avenue, Red Hill Avenue is generally a divided six-lane roadway
supporting high traffic volumes, with average daily traffic ranging from 9,300 to 34,600
vehicles. Existing bicycle facilities are discontinuous within the project corridor.
The Red Hill Avenue Rehabilitation Project was recently awarded a $7,000,000 federal
Surface Transportation Block Grant through the Southern California Association of
Governments, administered by the Orange County Transportation Authority, to fund
construction of the project. The proposed Consultant Services Agreement will provide the
engineering design services necessary to advance the project to construction.
The overall project scope includes pavement rehabilitation and resurfacing on Red Hill
Avenue between Bryan Avenue and Sycamore Avenue as warranted, continuous Class II
bike lanes, ADA improvements including curb ramp upgrades, drainage, utility cover
adjustments, traffic signal/detection modifications, lighting evaluation, water quality
management, potential median modifications, replacement of pavement markers, signing
and striping, and other corridor improvements identified through final design.
Staff developed a Request for Proposals (RFP) solicitation containing requirements and a
scope of services detailing the need for professional engineering consulting services for
the preparation of Plans, Specifications, and Engineer’s Estimate. The RFP was published
on July 6, 2026, on the City's electronic public procurement platform, OpenGov, and
distributed directly to known consultants/firms providing these services. The RFP
submission deadline was August 24, 2026, and the process yielded eight (8) proposals,
with all qualifying for further review.
The proposals were evaluated by a panel consisting of staff from the City's Public Works
Department in accordance with the evaluation criteria identified in the RFP. Based on the
initial proposal evaluations, the four highest-ranked firms were invited to participate in
interviews:
1. BKF Engineers
2. Onward Engineering
3. Dokken Engineering
4. Harris and Associates

Following the interviews and completion of reference checks, the evaluation panel finalized
the consultant rankings based on the following criteria:
•Qualification and Experience of Firm
•Approach and Work Plan
•Qualifications and Experience of the project manager and other key individuals
•Schedule of Delivery
•Reference Checks
BKF Engineerswas ranked as the top-rated proposer based on the proposal evaluation,
interview, and reference checks. The evaluation panel determined that BKFdemonstrated
the strongest understanding of the City's project objectives, including pavement
rehabilitation, a constrained Class II bicycle facility design, federal-aid/Caltrans
requirements, constructability/QA-QC, and preparation of a bid-ready Plans, Specifications,
and Engineer’s Estimate package. BKFalso demonstrated extensive experience delivering
similar roadway rehabilitation projects for local agencies, and a project team familiar with
the corridor through their recently completed topographic survey. Their proposed costs are
within the City's budgetary expectations.
Based on these factors, staff is recommending theapproval of the proposed Consultant
Services Agreement with BKF Engineersforthe engineering design servicesfor the Red
Hill AvenueRehabilitation Project.

services. Should the City staff be unable to negotiate a satisfactory contract with the firm
considered to be the most qualified, negotiations with that firm shall be formally terminated.
Negotiations will then be undertaken with the next most qualified firm. Failing accord with the
second most qualified firm, the City staff will terminate negotiations and continue the
negotiation process with the next most qualified firms in order of their evaluation ranking until an
agreement is reached and a firm is selected and an agreement is executed.
Additional information related to the consultant selection process will be made available in the
future once the City has executed this contract. Please refrain from making any verbal inquires

consultants and will be evaluated only during negotiations with the highest-ranked firm.
Q9 - Can font within graphics, captions, and sidebars be smaller than 11 pt font if reasonably
legible.
A - Yes
Q10 - How recent is the survey information that is in the existing topographic survey data and
AutoCAD Civil 3D survey files that the City will provide for the Consultant's use?
A - The topographic survey was completed in the past six years or so and represents the most
current survey information available to the City. The survey files provided are intended to
support completion of the final PS&E. As stated in the RFP, consultants are expected to review
the available survey information during proposal preparation and include any anticipated
supplemental survey or field verification in their proposal, if deemed necessary.
Q11 - The RFP states that City-prepared preliminary design documents include preliminary
pavement rehabilitation recommendations. Does the City anticipate that consultants will include
geotechnical and pavement investigation services for this project?
A - The Consultant shall include pavement engineering services necessary to evaluate existing
pavement conditions and recommend the final pavement rehabilitation strategy. The City has not
completed a final geotechnical/pavement investigation for this project. If the Consultant
determines additional pavement investigation or geotechnical work is necessary to support the
final design, such services shall be included in the proposal.
Q12 - Please provide all plan sheet-referenced files (e.g., topographic survey, X_Topo_Red
Hill_South.dwg) so that we may adequately determine how much additional topographic survey
will be needed for the proposed improvements.
A - The City will upload all available referenced files through OpenGov via addendum.
Q13 - The Bucknam report includes locations outside the project limits. Should the scope of
work include areas outside the project limits (Sycamore to Bryan)?
A - The design scope is limited to the project limits between Bryan Avenue and Sycamore
Avenue. The Bucknam Report is provided as reference information. Only deficiencies located
within the project limits are intended to be incorporated into the project unless otherwise directed
by the City.
Q14 - Please confirm whether a pavement/geotechnical investigation is to be provided by the
Consultant as part of the scope of work, or if the City will provide a geotechnical report.
A - The City has not prepared a final geotechnical report for this project. The Consultant shall
include any pavement engineering and geotechnical services necessary to support the
recommended pavement rehabilitation design and final PS&E.
Q15 - The 30% plans generally indicate a pavement rehabilitation method of cold milling. Are
Consultants expected to independently assess pavement conditions and identify the
recommended pavement rehabilitation along the corridor?
A - The City's preliminary recommendations included in the 30% design are provided as a
starting point for design. The Consultant shall independently evaluate the existing pavement
conditions, review the City's preliminary recommendations, and recommend the final pavement
rehabilitation strategy as part of the design.
Q16 - Please confirm that the required traffic signal modification plans are limited to loop
detector replacement and relocation, or if additional upgrades and modifications may be required
to complement the lane reconfigurations.
A - Traffic signal modifications are anticipated to be limited to vehicle detection adjustments
(including loop detector replacement or relocation, where required) necessary to accommodate
the proposed roadway improvements. No signal timing, controller, or operational upgrades are
currently anticipated.
Q17 - Please confirm that the six-lane divided roadway configuration is to be maintained and
that the addition of Class II bike lanes is to be accommodated within the existing roadway cross-
section using narrowed travel lanes consistent with the recommendations in the Red Hill Avenue
Specific Plan.
A - Correct. The existing six-lane divided roadway configuration is anticipated to remain. The
proposed Class II bicycle lanes are expected to be accommodated within the existing roadway
width through lane reconfiguration, including evaluation of raised center median narrowing
where appropriate. Final lane configurations will be confirmed during design.
Q18 - Please confirm whether Consultants should prepare the cost proposal using the Caltrans
LAPM Exhibit 10-H cost proposal format, incorporating the audited Indirect Cost Rate (ICR).
A - The Cost Proposal shall be prepared using Caltrans Local Assistance Exhibit 10-H or Exhibit
10-H1, as applicable, including the Consultant's audited Indirect Cost Rate (ICR), if applicable.
The Cost Proposal shall be submitted separately from the Technical Proposal in OpenGov and
will not be used during the qualifications-based evaluation. It will only be reviewed during fee
negotiations with the highest-ranked consultant.
Q19 - The RFP assumes construction will occur entirely within the existing right-of-way. If
ADA ramp or driveway retrofits, or other elements, cannot fit within the existing right-of-way, is
right-of-way acquisition and/or temporary construction easements (TCEs) a City responsibility
and outside the Consultant's scope?
A - No. The project is intended to be designed and constructed entirely within the existing public
right-of-way. The Consultant shall prepare the design to avoid the need for permanent right-of-
way acquisition or Temporary Construction Easements (TCEs). If the Consultant identifies a
location where improvements cannot reasonably be accommodated within the existing public
right-of-way, the Consultant shall promptly notify the City and evaluate alternative design
solutions to remain within the existing right-of-way. Acquisition of additional right-of-way or
TCEs is not anticipated as part of this project.
Q20 - So that fees are comparable across proposers, can the City specify assumptions for bid and
construction support (e.g., number of RFIs, submittals/shop drawing reviews, construction
duration, and meetings), or should these be carried as budget allowances?
A - Consultants shall propose the level of effort they determine appropriate based on the scope of
services described in the RFP and their professional judgment. Construction support services
shall be based on the anticipated scope identified in the RFP. The City will evaluate the proposed
scope and negotiate a final level of effort with the highest-ranked consultant, if necessary.
Q21 - Since proposals are to be submitted electronically via OpenGov, please confirm how the
15 double-sided page limit will be applied. Specifically, should the limit be interpreted as 30
PDF pages (excluding front and back covers, section dividers, resumes, and forms), and does
each 11" x 17" exhibit count as one page or two pages? In addition, please confirm whether the
required organization chart, deliverables matrix, and project schedule are included in the page
limit.
A - Proposal should be limited to a max of 30 pages. The cover letter, table of contents, front and
back covers, and section dividers are excluded from the page count. All project qualifications
should be included in the main body of the proposal. 11x17 exhibit counts as one page.
Q22 - Please provide the referenced Letter Agreement (Attachment B) associated with
professional liability coverage.
A - The reference to "Attachment B" is incorrect. The RFP is hereby revised to remove the
reference to Attachment B. If the selected consultant provides claims-made professional liability
coverage, written evidence of compliance with the insurance requirement shall be submitted on
the Consultant's letterhead prior to execution of the Consultant Services Agreement.

NON-DISCRIMINATION CERTIFICATION
The undersigned consultant or corporate officer, during the performance of this contract, certifies as
follows:
1. The Consultant shall not discriminate against any employee or applicant for employment because of
race, color, religion, sex, or national origin. The Consultant shall take affirmative action to ensure that
applicants are employed, and that employees are treated during employment without, regard to their
race, color, religion, sex, or national origin. Such action shall include, but not be limited to, the
following: employment, upgrading, demotion, or transfer; recruitment or recruitment advertising;
layoff or termination; rates of pay or other forms of compensation; and selection for training, including
apprenticeship. The Consultant agrees to post in conspicuous places, available to employees and
applicants for employment, notices to be provided setting forth the provisions of this nondiscrimination
clause.
2. The Consultant shall, in all solicitations or advertisements for employees placed by or on behalf of the
Consultant, state that all qualified applicants will receive consideration for employment without regard
to race, color, religion, sex, or national origin.
3. The Consultant shall send to each labor union or representative of workers with which he/she has a
collective bargaining agreement or other contract or understanding, a notice to be provided advising
the said labor union or workers’ representatives of the Consultant’s commitments under this section,
and shall post copies of the notice in conspicuous places available to employees and applicants for
employment.
4. To the extent required by Executive Order 14173 (“Ending Illegal Discrimination and Restoring
Merit-Based Opportunity,” effective January 21, 2025) or any applicable federal contract terms, the
Consultant further certifies that it does not operate any programs promoting diversity, equity, and
inclusion (DEI) that violate any applicable Federal anti-discrimination laws. The Consultant
acknowledges that a false certification may give rise to liability under the False Claims Act (31 U.S.C.
§ 3729 et seq.).
5. The Consultant certifies that it complies in all respects with all applicable Federal anti-discrimination
laws, including but not limited to Title VII of the Civil Rights Act of 1964 (42 U.S.C. § 2000e et seq.),
the Age Discrimination in Employment Act of 1967 (29 U.S.C. § 621 et seq.), the Americans with
Disabilities Act of 1990 (42 U.S.C. § 12101 et seq.), and Title VI of the Civil Rights Act of 1964 (42
U.S.C. § 2000d et seq.), as applicable to this contract. The Consultant further certifies compliance with
Section 503 of the Rehabilitation Act of 1973, as amended (29 U.S.C. § 793; 41 C.F.R. Part 60-741),
and the Vietnam Era Veterans’ Readjustment Assistance Act of 1974, as amended (38 U.S.C. § 4212;
41 C.F.R. Part 60-300) (“VEVRAA”), which impose both non-discrimination requirements and
affirmative action obligations with respect to qualified individuals with disabilities and protected
veterans, respectively, to the extent the Consultant is subject to those requirements based on contract
value and workforce size.
6. The Consultant shall comply with the California Fair Employment and Housing Act (FEHA),
(California Government Code §§ 12900–12999), which prohibits discrimination and harassment in
employment on the basis of any protected characteristic defined in Government Code sections 12926

more employees (and to all employers for harassment claims) and is enforced by the California Civil
Rights Department. FEHA applies independently of federal requirements and is unaffected by any
changes to federal executive orders. This obligation also encompasses California Labor Code § 1735,
which expressly incorporates FEHA’s protected categories by reference and applies those non-
discrimination obligations specifically to contractors on public works; violations of § 1735 are subject
to the public works penalty and debarment provisions of Labor Code Chapter 1 (Part 7, Division 2),
which are in addition to and independent of any civil remedies available under FEHA.
7.The Consultant shall include the provisions of the above paragraphs to the extent applicable based on
