2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, RE-CERTIFYING THE FINAL NEGATIVE
3 DECLARATION AS ADEQUATE FOR GENERAL PLAN AMENDMENT
96-002 AND AMENDMENT TO TENTATIVE TRACT 14022
4 INCLUDING REQUIRED FINDINGS PURSUANT TO THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT.

The City Council of the City of Tustin does hereby resolve as
6 follows:
7 I. The City Council finds and determines as follows:
8 A. The request to approve General Plan Amendment 96-
002 and Amendment -to Tentative Tract 14022 are
9 considered "projects" pursuant to the California
Environmental Quality Act.

B. A Negative Declaration was previously prepared and
11 certified on January 8, 1990 for this project and
was distributed for public review.

C. Whereby, the City Council of the City of Tustin has
13 considered evidence presented by the Community
Development Director and other interested parties
14 with respect to the subject Negative Declaration.
15 D. The City Council has evaluated and determined the
final Negative Declaration to be adequate and
16 complete.
17 IIo A Final Negative Declaration has been previously prepared
and certified on January 8, 1990 in compliance with CEQA
18 and State guidelines.. The City Council, having approval
authority over General Plan Amendment 96-002 and
19 Amendment to Tentative Tract 14022, has received and
considered the information contained in the Negative
20 Declaration, prior to approving the proposed project, and
found that the Negative Declaration adequately discussed
21 the environmental effects of.the proposed project. On
the basis of the initial study and comments received
22 during the public review process, the City Council has
found that although the proposed projects could have
23 impacts, there will not be a significant effect because
mitigation measures identified in the Negative
24 Declaration have been incorporated into the project which
mitigate any potential significant environmental effects
25 to a point where clearly no significant effect.would
occur. The mitigation measures are identified in Exhibit
26 A of the Negative Declaration and Initial Study and are
adopted as findings and conditions of Planning Commission
27 Resolution Nos. 3437 and 3438.

Council of the City of Tustin, California, do hereby certify
12 that the whole number of the members of the City Council of
the City of Tustin is five; that the above and foregoing
13 Resolution Noo 96-47 was duly passed and adopted at a regular
meeting of the Tustin City Council, held on the 6th day of
1~ May, 1996, by the following vote:
