HomeMy WebLinkAboutCC RES 96-421 RESOLUTION NO. 96-42 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 3 TUSTIN, CALIFORNIA, ADOPTING THE DETERMINATION OF THE RETIREMENT REVIEW BOARD FINDING THE 4 INDUSTRIAL DISABILITY OF RONALD FRAZIER ORDERING CERTIFICATION TO PERS AND ORDERING 5 ADVANCE DISABILITY PAYMENTS. 6 The City Council of the City of Tustin hereby resolve as follows: 7 8 WHEREAS, the City of Tustin is a contracting agency of the Public Employees' Retirement SyStem; 9 WHEREAS, the Public Employees' Retirement Law requires that a 10 'contracting agency determine whether an employee of such agency who is in a 11 position of employment in which he is classified as a local safety member is disabled for purposes of the Public Employees' Retirement Law and whether such 12 'disability is "industrial" within the meaning of such law; 13 WHEREAS, an application for disability retirement of Ronald Frazier, 1-4 employed by the City of Tustin in the position of Police Officer has been filed with the Public Employees' Retirement System; and 15 16 WHEREAS, the Retirement Review Board has reviewed evidence presented by the Personnel Department concerning the disability of Ronald Frazier, and has 17 determined, based on medical and other relevant evidence, that Mr. Frazier is disabled and that this resolution shall be forwarded to PERS as certification of the 18 industrial disability. 19 NOW, THEREFORE, BE IT RESOLVED, that the City Council of the 20 City of Tustin, adopts the determination of the Retirement Review Board and that 21 such disability is a result of injury or disease arising out of and in the course of said employment and; 22 BE IT FURTHER RESOLVED, that the member was separated from his 23 employment in the position of Police Officer effective April 9, -1996. 24 There is a possibility of third party liability. 25 26 Advanced disability pension payments shall be made every other week in the amount of $951.46, beginning.May 10, 1996. 27 9-8. 1 The primary disabling condition is knee instability. 2 X 3 PASSED AND ADOPTED by the City Council of the City of TuStin at '2 regular meeting held. on the 6th day of May, 1996. ~ 4 7 Worley, 8 9 11 P;n'eid Stoker, CityuClerk 12 STATE OF CALIFORNIA) 13 COUNTY OF ORANGE ) SS 14 CITY OF TUSTIN ) 15 CERTIFICATION FOR RESOLUTION NO. 96-42 16 Pamela Stoker, City Clerk and ex-officio Clerk of the City Council of the City of 17 Tustin, California, does hereby certify that the whole number of the members of the City Council is five;. that the above and foregoing Resolution was duly and 18 regularly passed and adopted at a regular meeting of the City Council held on the 19 6th day of May, 1996 by the following vote: 20 COUNCILMEMBER AYES: Worl ey, Thomas, Doyle, Potts, Saltarelli 21 COUNCILMEMBER NOES: None COUNCILMEMBER ABSTAINED: None 22 COUNCILMEMBER ABSENT: None 24 Pamela S~ceT,%ity Clerk 25 B.CS::F~ZmR.~.tS 26 27 28
