A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN DETERMINING THAT A PROJECT AREA
COMMITTEE SHALL NOT BE FORMED IN CONNECTION
WITH THE MCAS-TUSTIN REDEVELOPMENT PROJECT
The City Council of the City of Tustin DOES HEREBY RESOLVE as follows:

On February 27, 1996, the City Council of the City of Irvine authorized the Tustin
Redevelopment Agency to include a portion of Irvine within the scope of the
MCAS Tustin Redevelopment Plan and further authorized Tustin to administer all
redevelopment activities within the Irvine portion subject to a Redevelopment
Cooperation Agreement between all parties. On February 14, 1996, pursuant to
Section 33213 of the California Community Redevelopment Law (Health and
Safety Code Section 33000 et seq.) the City of Tustin, the Tustin Community
Redevelopment Agency, and the City of Irvine entered into a "Redevelopment
Cooperation Agreement" ( the "Agreement"). Said Agreement was subsequently
amended on November 13, 1997 by Amendment No. 1 and on April 3, 2000 by
Amendment No. 2.

On September 8, 1997, the Planning Commission of the City of Tustin selected
the boundaries for the MCAS-Tustin Redevelopment Project ( the "Project") ,
adopted a Preliminary Plan for the Project, and authorized submission of the
Preliminary Plan for the ProjeCt to the Tustin Community Redevelopment
,
Agency ("Agency") by Resolution No. 3544; and' '
"On September 15,1997, the Agency received the Preliminary Plan and directed
that the Redevelopment Plan for the MCAS-Tustin Redevelopment Project be
prepared by Resolution No. RDA 97-04; and

California .Community Redevelopment Law ( Health and Safety Code Section
33385 et seq.) requires that a project area committee be formed in a
redevelopment project area in either of the following situations:
1)
A substantial number of Iow-income persons or.moderate-income persons,
or both, reside within the project area, and the redevelopment plan as
adopted will contain authority for the agency to acquire, by eminent domain,
property on which any such persons reside; or
2)
The redevelopment plan as adopted contains one or more public projects
that will displace a substantial number of Iow-income persons or moderate-
income persons, or both; and

E. California Community Redevelopment Law (Health and Safety Code Section
33385 (f)) also requires that if the project area does not contain a substantial
number of low- and moderate-income individuals, the Agency shall consult with
and obtain the advice of, residents and community organizations concerning
those policy matters which deal with the planning and provision of residential
facilities or replacement housing for those to be displaced by project activities, if
any, as well as on other policy matters which affect the residents of the project,
and further requires that the proposed Redevelopment Plan be provided to such
residents and community organizations prior to submitting it to the City Council;

F. There are currently no military, non-military persons, or families that occupy
property at The United States Marine Corps transferred and relocated
individuals and families within the proposed Project Area and the site is currently
no occupied; and .
G. Because the Tustin Marine Corps Air Station Redevelopment Project does not
have any low-income or moderate-income persons residing within its boundaries,
who could be displaced or who would be subject to displacement by the Agency,
adoption and implementation of the Redevelopment Plan for the Project will not
result in displacement of a substantial number of low- and moderate-income
persons, either through Agency property acquisition or through public projects
implemented by the Agency.
NOW, THEREFORE, the City Council of the City of Tustin resolves as follows:
Section 1. The City Council of the City of Tustin finds and determines that the
proposed MCAS-Tustin Redevelopment Project does not contain a substantial number
of low- and moderate-income persons who could be displaced or who would be subject
to displacement by the Agency, and that formation of a Project Area Committee is not
required prior to the adoption of the Redevelopment Plan. The City Council further
determines that a Project Area Committee shall not be formed in connection with the
proposed Project.
Section 2. The Tustin Community Redevelopment Agency is hereby
authorized and directed to consult with and obtain the advice of residents, property
owners, businesses and community organizations (if any) within the MCAS-Tustin
Redevelopment Project, and to provide such residents, owners, businesses and
community organizations with the opportunity to review the proposed Redevelopment
Plan prior to its submission to the City Council.
