RESOLUTION NO. 83-10
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, INITIATING REORGANIZATION
PROCEDURES AND SCHEDULING A HEARING FOR
THE ANNEXATION AND DETACHMENT OF CERTAIN
INHABITED TERRITORY IN THE CITY OF IRVINE
AND THE CITY OF TUSTIN DESIGNATED AS
REORGANIZATION NO. 53
WHEREAS, the Local Agency Formation Commission, by Resolution No.
81-6 on January 14, 1981, determined at the request of the cities of Tustin
and Irvine that the City of Tustin's sphere of influence should coincide
with the center line of the realignment and .extension of Myford Road; and
WHEREAS, by Resolution No. 80-109, October 10, 1980, the City
Council of Tustin initiated preliminary proceedings to transfer territory
between the cities of Tustin and Irvine and said proposal was concurred
with by Resolution No. 1240 of the City of Irvine; and
WHEREAS, the proposal was first scheduled for a hearing before the
Local Agency Formation Commission on June 24, 1981 and continued at various
intervals at the request of property owners and interested parties for the
purpose of developing a consensus on the ultimate alignment of Myford Road
to Jamboree, southerly of the Marine Corps Air Station, Tustin; and
WHEREAS, the Local Agency Formation Commission, at the request of
the cities of Tustin and Irvine, and the Irvine Company, conducted a public
hearing on the proposed reorganization on January 26, 1983 and approved the
proposed "Municipal Reorganization No. 53" and designated the Tustin City
Council as the conducting authority for completing proceedings;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUSTIN DOES HEREBY
RESOLVE AS FOLLOWS:

Preliminary proceedings were commenced by the City Council of Tustin
with the concurrence of the City Council of Irvine and the Irvine
Company.
The City of Tustin and the City of Irvine are affected cities and
district boundaries, including those of the Tustin and 1trine School
iDi stricts, remain unchanged.
The proposed reorganization transfers undeveloped property northerly
of the main line Santa Fe Railroad and westerly of the centerline of
the new Myford Road from the City of Irvine to the City of Tustin.
Inhabited property of the MCAS (H) Tustin easterly of the Peters
Canyon Flood Control Channel and the proposed alignment of Myford
Road would be transferred to the City of Irvine.

The proposed reorganization is for the purpose of realigning the
city boundaries along the realignment of Myford Road to create fixed
and identifiable service boundaries. Residents of the Marine Corps

Housing Project who are the beneficiaries of the City of Irvine
street system, parks and recreation facilities, and emergency
services would be within the jurisdictional limits of the City of
Irvine.

The Local Agency Formation Commission on January 26, 1983 certified
that the transfer of the subject parcels will not have a significant
effect on the environment; designated the Tustin City Council as the
conducting authority; authorized a protest hearing; and determined
that the expenses for conducting the proceedings shall be paid by
the City of Tustin, except as otherwise provided by agreement with
the interested agenc i es.

A public hearing will be conducted by the City Council of Tustin at
7' 30 p.m. on March 21, 1983 in the Council Chambers, 300 Centennial
Way, Tustin, California. Any interested person desiring to make
written protest against the proposed reorganization shall do so by
written communication filed with the City Clerk of Tustin not later
than 7:30 p.m., March 21, 1983. Any owner of land or any registered
voter within the territory proposed for annexation may file a
written p~otest with the City Clerk of Tustin at any time prior to
the conclusion of the City Council hearing on the proposed
reorgan i zati on.

The City Clerk shall cause notice of' hearing on the proposed
reorganization to be given as required by 1 aw.
PASSED AND ADOPTED by the City Council of the City of Tustin at a
regular meeting held on the 7th day of February, 1983.
