HomeMy WebLinkAboutCC RES 82-8810 11 12 14 15 16 17 18 19 20 21 22 22 24 25 27 28 RESOLUTION NO. 82-88 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN UPHOLDING PLANNING AGENCY APPROVAL OF USE PERMIT 82-22 WITH CONDITIONS The City Council of the City of Tustin does hereby resolve as fol 1 ows' I. The City Council finds and determines as fol lows- A. That a proper application (Use Permit No. 82-22), was filed on behalf Goldwyn Enterprises by Arthur Johnson to authorize 45 seats for sit down eating and wi ne tasting at 151 N. Tustin Ave. B. That a public hearing was duly called,l noticed and held on said application on October 4, 1982. C. That the Planning Agency, by Resolution No. 2062, approved Use Permit 82-22. D. That an appeal was filed, duly noticed and a hearing conducted by the City Council on November 1, 1982. E. That evidence was presented to the Council showing the establishment, maintenance, and operation of the use applied for alt the site will be compatible with . lexisting uses if the maximum number of seats is limited to 36 in lieu of the previously approved-45 seats.' II. The City Council hereby uphold~ the decision of the Pl anRing Agency and approves the use of 36 seats for eating and wine tasting at 151 N. Tustin Ave. subject to the fol 1 owing conditi OhS' A. That the applicant shall provide, at his ownI expense, parking signs identifying parking spaces for 131 N. Tusti n Ave form offi ce vi si tors only. B. That a one-year review period be imposed; and that if after one year it is determined by the Planning Agency that a parking problem has developed, all necessary modifications to the site to resolve the problem shall be required. C. That a reciprocal parking agreement (or similar guarantee) with 171 N. In the future, if the use at 171 N. Tustin Avenue is changed to a more intense use, the Heritage House will have to modify their seating capacity accordingly. E. Construction drawings shall be submitted by a licensed architect which show the change of occupancy as required by the Uni form Buil ding Code.
