A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR IRVINE
BLVD. FAU PROJECT M-M023 (2) AND DIRECTING THE CITY CLERK TO
ADVERTISE FOR BIDS.
WHEREAS, it is the intention of the City Council of the City of Tustin,
California to construct certain traffic signal improvements, street
improven~nts and appurtenant work on Irvine blvd. between Yorba Street and
Redh Hill Avenue designated as Irvine Blvd. FAU Project M-M023 (2);
WH~, the City Engineer has presented plans and specifications for
the construction of said work;
NOW TH~~RE, BE IT RESOLVED that the plans and specifications
presented by the City Engineer be and are hereby approved as the plans and
specifications for the construction of Irvine Blvd. FAU Project M-M023 (2).
BE IT FURI~~ ~LVED that the City Clerk is hereby authorized and
directed to advertise as required by law for the receipt of sealed bids or
proposals for the doing of the work specified in the aforesaid plans and
specifications which said advertisement shall be substantially in the
following words and figures to-wit:

Tustin City Hall, 300 Centennial Way, Tustin, California, until 10:00 AM on
the 10th_ day of May, 1982 , at which time they will be publicly opened' and

The foregoing quantities are approximate only, being given as a basis for
the cc~parison of bids, and the City of Tustin does not, expressly or by
implication, agree that the actual amount of work will correspond therewith,
but reserves the right to increase or decrease the amount of any class or
portion of the work, or to cmi t portions of the w~rk as may be deemed
necessary or advisable by the Engineer.
Plans, specifications and proposal forms to be used for bidding on this
project can only be obtained by prospective bidders at the office of the City
Clerk, Tustin City Hall, 300 Centennial Way, TUstin, California, 92680, upon
payment of $15.00 per set, which amount shall be non-refundable.
Plans and specifications · will be mailed out upon payment of $25.00 per
set, which amount shall be non-refundable.
In conformance with Section 37931 of the Government Code, all bids shall
be presented under sealed cover on the proposal form provided and accompanied
by one of the following forms of bidder's security:
a. Cash
b. Cashier's check made payable to the City of Tustin.
c. Certified check made payable to the City of Tustin.
d. Bidder's bond executed by an accredited surety insurer, made payable
to the City of Tustin.
The security shall be in an amount equal to at least ten percent (10%)
of the amount of the bid. A bid shall not be considered unless one of the
forms of bidder's security is enclosed therewith.

A Security Bond for payment of labor and materials will be requ. ired in
the amount of fifty percent (50%) of the estimated total contract price and a
Faithful Performance Bond in the amount of one hundred percent (100%) of the
estimated total contract price in the form attached to the contract
documents. Said bonds shall be issued by a Surety Company rated grade A or
better and Class IX or better by the latest edition of Best's Key Rating
Guide.
City of Tustin reserves the right to reject any or all bids, and/or
waive any informality on a bid. No bidder may withdraw his bid for a period
of thirty (30) days after the date set for the opening thereof.
The contract will be awarded to the lowest qualified bidder.
Provisions of the State Contract Act are not applicable, and prospective
bidders will not be required to be prequalified.
All wo~ to be done under the direct supervision of the City Engineer,
City of Tustin.
Ail work to .be paid for at the unit prices bid frcm appropriated monies.
Federal Requirements and Federal minimum wages shall apply to this
project. Attention is directed to decision No. CA81-5154 of the Secretary of
Labor. Not less than said minimum wages shall be .paid to workers e~ployed on
this project.
Federal requ. ir~nts for this project require that the Contractor shall
perform work with his own organization which equals not less than 50 percent
of the total contract price.
Minimum wage rates for this project as predetermined by the Secretary of
Labor are set forth in the special provisions. If there is a difference
be~n the minimum wage rates predetermined by the Secretary of Labor and the
prevailing wage rates determined by the State for similar classifications of
labor, the Contractor 'and his subcontractors shall pay not less than the
higher wage rate.
Pursuant to Section 1773 of the Labor Code, the general .prevailing rate
of wages in the county in which the work is to be done has been determined and
the Department has listed these wage rates in the Department of Transportation
publication entitled Equ. ipment Rental Rates and General Prevailing Wage Rates,
dated February, 1977.
