HomeMy WebLinkAboutCC RES 96-04I 2 RESOLUTION NO. 96-04 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN 4 REQUESTING THE ORANGE COUNTY TRANSPORTATION AUTHORITY TO RELEASE A PORTION OF THE COMBINED 5 TRANSPORTATION PROGRAM FUNDS FOR THE EDINGER AVENUE WIDENING PROJECT FROM 2500 FEET WESTERLY OF JAMBOREE 6 ROAD TO HARVARD AVENUE (PROJECT NO. 700127) 7 WHEREAS, the Orange County Transportation Authority approved a Combined 8 J Transportation Funding Program (CTFP) for fiscal year 1994-95; and 9' WHEREAS, the program includes '$483,450 in fiscal year 1994-95 for a street widening project on Edinger Avenue from 2500 feet weste~y of Jamboree Road to Harvard 10 'Avenue; and 11 .... WHEREAS, the C~ty Of Tustin has adopied a General Plan Circulation Elemeni which' 12 does not preclude implementation of the MPAH within its jurisdiction; and 13 NOW, THEREFORE, BE IT RESOLVED that the City of Tustin, hereby requests 14 the Orange County Transportation Authority allocate $383,933.47 of CTFP funds from the MPAH Program for construction of said project to the City. This request is in conformance 15 with the CTFP allocation process and does not exceed ninety (90) percent of the programmed amount or ninety (90) percent of the construction contract. 16 ' 17 BE IT FURTHER RESOLVED, that the City of Tustin, agrees to fund its share of the improvement costs during Fiscal Year 1995-96 and any additional costs over the identified 18 programmed amount. 19 BE IT FURTHER RE~OLVED, that the City of Tustin, has awarded the contract for 20 the project on December 4, 1995 for. $874,785.48. 21 BE IT FURTHER RESOLVED, that the City of Tustin has: 1) designed the project improvements; and 2) completed required preparatory work in accordance with the standards 22 required by the City and other affected jurisdictions involved with said projecL BE IT FURTHER RESOLVEI}, that the remaining ten (10) percent in CTFP ·funds 24 will be transferred to the City of Tustin when construction is completed and a Final Report on the project is accepted by the Orange County Transportation Authority.
