HomeMy WebLinkAboutCC RES 81-056RESOLUTION NO. 81-56 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN OVER-RULING THE PLANNING AGENCY AND APPROVING A USE PERMIT FOR THE B'NAI ISRAEL CONGREGATICN AT SUITES II & I, 13112 NEWPORT AVENUE The City Council of the City of Tustin does hereby resolve as follows- I. The City Council finds and determines ss follows: A. That a proper application, (Use Permit No. 81-13), was filed on behalf B'Nai Israel Congregation by the Robert P. Warmington Company to authorize the use of Suites H and I, 13112 Newport Avenue for religious instruction assembly. B. That a public hearing was duly c~lled., noticed and held on said application on April 6, 1981. . C. That the Planning Agency, by Resolution No. 1955B denied the application on the basis of a conflict in parking accxxnodations between the cofmnercial use within the center and congregational uses. D. That an appeal was filed, duly noticed and a hearing conducted by the City Council on May 4, 1981. E. That evidence was presented to the Council showing that the establishment, maintenance, and operation of the use applied for at the site will be 'compatible with existing uses due to the assignment and monitoring of parking accomodations. II. The City Council hereby over-rules the denial of the Planning Agency and approves the use of Suites }t and I, 13221 Newport Avenue for congregational meetings and educational programs conducted by the B'Nai Israel Congregation subject to the following conditions: A. The congregation shall be responsible for the monitoring of parking to assure compatibility with comnercial estimates on the site. B. The occupancy of the structure shall comply with all health and safety requirements of the Uniform Building Code. Resolution No. 81-56 - . Page Two C. The Use Permit shall be subject to review on or about May 17, 1982 and shall be subject to termination if a determination is made by the Planning Agency that subject operations are not compatible with existing and authorized uses of the center.
