RESOLUTION NO. 81-8
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, AMENDING THE PERSONNEL RULES AND
REGULATIONS OF THE CITY OF TUSTIN.
The City Council of the City of Tustin hereby resolves
that the Personnel Rules and Regulations of the City of
Tustin be amended as follows:·
Section 3, subparagraph F is hereby amended to
read as follows:
F. Reclassification. Positions the duties
and responsibilities of which have been
.determined by job analysis to have changed
substantially shall be reallocated by the
City Council to new and appropriate classifi-
cations upon recommendation of the Department
Head and review and approval of the City
Administrator.
Ail reclassified positions shall be filled through
open, competitive examination, except as follows:
1) If a position with an incumbent is moved to
a class with a lower salary range, the
incumbent shall first be given the opportunity
of taking a voluntary demotion into the new
position without examination.
2) If a position with an incum.bent does not'
change salary range, the incumbent may be
pls~ed in the new position without examination.
3) If a position with an incumbent is moved to
a higher salary range, the Department Head
may ~equest a closed, promotional examination.'
Upon a determination of the City Administrator

that there would be no ..adverse impact on the
·
City's Affirmative Action efforts and it is
·
in the best interests Of the City, a closed
promotional 'examination may be authorized.
Such an examination shall be designed to
determine if those candidates .who apply are
fully qualified to perform the duties of the
new position, and, if so, which of the.
candidates is best qualified to assume those
duties.
Any incumbent in a position which is reclassified who does
not move to the new position' thzough one of the means
described in subparagraphs 1 to 3 above, or th~°ugh open,
competitive competition, shall have the opportunity to
compete fo~, or transfer to, any open position in the citY
as otherwise provided.in these rules and regulations. If
not hired for any.position prior to the date the reclassified
position is filled, the incumbent shall be laid off and the
employee's name placed on a re-employment list for an
appropriate class or classes.
2.. Section 6, subparagraph C (1) .is hereby amended
to read as follows:
C. (1) P~omotiona~.l.. and Open, Competit.%ve
Examination. Ail vacancies shall be filled
by open, competitive examination except as
otherwise provided in these Rules and Regula-
tions. Any person meeting the requirements
specified in the open, competitive examination
announcement may compete therein. Promotional
examinations may be used to fill vacancies.

Section 9,. subparagraph B is hereby amended to
read as follows:
9. B. Promotion. Ail vacamcies shall be filed
by open, competitive examination except as
otherwise specified in these Rules and Regula-
tions. Vacancies may be filled by promotional
examination from within the service when
determined by the City Administrator to be
necessary, in the best interests of the
City and not likely to adversely effect the
City's Affirmative Action .proq~am. The
City Administrator may conduct a combined,
promotional, open, competitive examination
when, in his judgment, this procedure will
expedite the filling of a position with the
most qualified individual available.
PASSED, APPROVED AND ADOPTED at a regular meeting of
the City Council of the City of Tustin, California, this ·
