A Resolution of the City Council of the City of
Tustin, California, AGREEING TO ACCEPT THE EXCHANGE OF
PROPERTY TAX REVENUES IN CONJUNCTION WITH INHABITED
ANNEXATIONS
WHEREAS, the City of Tustin in the conducting authority for certain
inhabited annexations of areas within Tustin's Sphere of Influence; and
WHEREAS, the Local Agency Formation Commission has approved the annexa-
tion to the City of Tustin of the areas known as Annexation No. 97 (Main
'Street/Freeway), Annexation No. 110 '(San Juan-Green Valley) , and Annexation
No. 122 (Tentative Tract Map No. 11050); and'
WHEREAS, Annexation No. 121 (Irvine Boulevard-Dean Street) has" been
submitted to the Local Agency Formation Commission for hearing and determina-
tion; and
WHEREAS, the Local Agency Formation Commission :.may not take action
until such time as an agreement is reached on the distribution of property
taxes within said area pursuant to Section 99 (b) of the California Revenue
and Taxation Code; and
WHEREAS, the agreement for the allocation of property taxes of subject
areas is a prerequisite for the completion of annexations proceedings; and
WHEREAS, the Board of Supervisors on September 2, 1980 adopted a policy
which allocates the property tax of developed areas on the basis of the
historical ratio for the City and County; and
WHEREAS, the County and Cities are in the process of negotiating a
master property tax transfer agreement with a time uncertain .for its approval
and .adoption; and

WHEREAS, Section 99(b)(4) of the Revenue and Taxation Code establishes
a 30-day maximum negotiation, period for an agreement for the exchange of the
property tax revenues;
NOW THEREFORE BE IT RESOLVED that the City Council accepts' the formula
as contained within paragraph 4 of the policy adopted by the Board of Super-
visors on September 2, 1980 for the distribution of property tax revenues for
the fully developed areas known as Annexation No. 97, 110, 121 and 122 to the
City of Tustin whereby property taxes are divided in accordance with the
historical division of property taxes within the City of Tustin as determined
by the County Auditor.
BE IT FURTHER RESOLVED that the City Council hereby consents to the
re-negotiation of this agreement for the purpose of consistency with an
approved master property tax transfer agreement.
A certified copy of this resolution shall be furnished-by the City.
